No. 58615 of 2009 :\n<\/p>\n<p id=\"p_4\">             Application is allowed and reply on behalf of the respondent,<br \/>\nfiled today in Court, is taken on record.\n<\/p>\n<p id=\"p_5\">Main Case :\n<\/p>\n<p id=\"p_6\">             Manish Madan has filed this petition under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the<br \/>\nCode of Criminal Procedure (in short &#8211; <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.) for quashing of order dated<br \/>\n13.10.2007 (Annexure P-4) and order dated 16.04.2009 (Annexure P-7)<br \/>\narising out of the Award of Lok Adalat.\n<\/p>\n<p id=\"p_7\">             The petitioner had filed criminal complaint (Annexure P-1)<br \/>\nagainst respondent Vasdev under Sections 138 and 142 of the Negotiable<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          Crl. Misc. No. M-20007 of 2009 (O&amp;M)              2<\/span><\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_2\">Instruments Act<\/a>, 1881.     When the complaint was at the final stage,<br \/>\nrespondent made statement (Annexure P-3) dated 13.10.2007 in Lok Adalat<br \/>\nagreeing to pay Rs.76,500\/- against cheque amount of Rs.90,000\/-. The<br \/>\nrespondent paid Rs.3,000\/- at the time of making the aforesaid statement<br \/>\nand agreed to pay Rs.20,000\/- on 22.10.2007 and the remaining amount in<br \/>\nmonthly instalments of Rs.3,000\/- each commencing from 10.11.2007. In<br \/>\nview of said statement made by the respondent regarding compromise<br \/>\neffected in Lok Adalat, the petitioner got the complaint dismissed as<br \/>\nwithdrawn, vide order dated 13.10.2007 (Annexure P-4) passed by learned<br \/>\nJudicial Magistrate Ist Class, Karnal, which has been assailed in the instant<br \/>\npetition. The petitioner also filed execution petition (Annexure P-5) for<br \/>\nrecovery of the balance amount as per compromise, but by making<br \/>\nstatement (Annexure P-6) on 16.04.2009, the said execution petition was<br \/>\ndismissed as withdrawn vide order dated 16.04.2009 (Annexure P-7). The<br \/>\npetitioner stated that he would initiate proceedings for revival of the<br \/>\ncomplaint and for action against the respondent. Accordingly, the instant<br \/>\npetition has been filed for revival of complaint by setting aside order dated<br \/>\n13.10.2007 (Annexure P-4) and also by setting aside order dated 16.04.2009<br \/>\n(Annexure P-9).\n<\/p>\n<p id=\"p_8\">             In reply, respondent has pleaded that by way of compromise, he<br \/>\nhad agreed to pay Rs.3,000\/- only and signed the statement in the Court, but<br \/>\nhe was not aware that he had to make any further payment because he had<br \/>\nnot borrowed any amount from the petitioner.\n<\/p>\n<p id=\"p_9\">             I have heard learned counsel for the parties and perused the<br \/>\ncase file.\n<\/p>\n<p id=\"p_10\">             The plea of the respondent that he was to make payment of<br \/>\nRs.3,000\/- only, which he paid on 13.10.2007 at the time of making<br \/>\nstatement and that he was not to make any further payment, cannot be<br \/>\naccepted.    There is categorical statement (Annexure P-3) made by the<br \/>\nrespondent undertaking to pay a total sum of Rs.76,500\/-.          The said<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          Crl. Misc. No. M-20007 of 2009 (O&amp;M)                3<\/span><\/p>\n<p>statement was recorded in Hindi and had been signed by the respondent in<br \/>\nEnglish. Consequently, the plea of respondent that he was not aware of his<br \/>\nliability to make further payment being illiterate, cannot be accepted. The<br \/>\nsaid statement has also been counter-signed by counsel for the respondent<br \/>\nin the lower court. On the basis of said statement, the complaint was<br \/>\ndismissed as withdrawn. However, the respondent has turned dishonest and<br \/>\nhas not complied with his statement (Annexure P-3) made in the trial court.<br \/>\nThe respondent has thus committed fraud with the Court. This Court, in<br \/>\nexercise of inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a> Cr.P.C., can pass<br \/>\nappropriate order to serve the ends of justice and to undo the fraud<br \/>\ncommitted by the respondent. Purity of the system of administration of<br \/>\njustice has to be maintained and it is the duty of this Court to do so by<br \/>\npassing appropriate order.     The respondent has polluted the stream of<br \/>\nadministration of justice by making statement on oath before the trial court<br \/>\nregarding compromise and then by not complying with the terms thereof,<br \/>\nalthough the respondent secured withdrawal of the complaint on the basis<br \/>\nof statement made by him regarding compromise.            The respondent is<br \/>\nestopped from challenging said statement having taken advantage thereof.\n<\/p>\n<p id=\"p_11\">              In view of the aforesaid, the instant petition is allowed and<br \/>\norder dated 13.10.2007 (Annexure P-4) passed by learned Judicial<br \/>\nMagistrate Ist Class, Karnal is set aside and criminal complaint (Annexure<br \/>\nP-1) filed by the petitioner against the respondent is restored to the files of<br \/>\nlearned Judicial Magistrate Ist Class, Karnal for proceeding therewith in<br \/>\naccordance with law from the stage at which it was pending before passing<br \/>\nof the impugned order dated 13.10.2007 (Annexure P-4).\n<\/p>\n<p id=\"p_12\">              The parties are directed to appear before trial Magistrate on<br \/>\n21.12.2009.\n<\/p>\n<pre id=\"pre_1\">November 18, 2009                                   ( L.
