BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                     B.A.No. 7705 of 2007\n                  - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 14th day of December, 2007\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail.             The petitioner is the<\/p>\n<p>husband of the defacto complainant. The marriage took place on<\/p>\n<p>24.1.2007. One child has been born in the wedlock. Crime has<\/p>\n<p>been registered u\/s. 489A <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>. on the basis of the private<\/p>\n<p>complaint filed before the learned Magistrate by the defacto<\/p>\n<p>complainant and referred by the learned Magistrate to the police<\/p>\n<p>under <a href=\"\/doc\/99487\/\" id=\"a_1\">Section 156(3)<\/a> Cr.P.C. Investigation is in progress. The<\/p>\n<p>petitioner apprehends imminent arrest.<\/p>\n<p id=\"p_1\">      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent. There is strain in the marital tie<\/p>\n<p>and on account of such strain, fanciful, false and exaggerated<\/p>\n<p>allegations are being made against the petitioner. The defacto<\/p>\n<p>complainant is employed abroad.               She has not suffered any<\/p>\n<p>external injuries as a result of the alleged physical cruelty. The<\/p>\n<p>B.A.No. 7705 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p>petitioner may be saved of the undeserved trauma of arrest and inc<\/p>\n<p>rceration in prison, submits the learned counsel.<\/p>\n<p id=\"p_2\">      3. The    learned counsel for the petitioner prays, the learned<\/p>\n<p>Prosecutor does not oppose the said prayer and I am satisfied that<\/p>\n<p>directions under <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section 438<\/a> Cr.P.C. can be issued in favour of the<\/p>\n<p>petitioner. Subject to appropriate conditions, anticipatory bail can be<\/p>\n<p>granted to the petitioner, I am satisfied.<\/p>\n<p id=\"p_3\">      4. In the result:\n<\/p>\n<p id=\"p_4\">      (1) This application is allowed.\n<\/p>\n<p id=\"p_5\">      (2)   The following directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_3\">Section 438<\/a><\/p>\n<p>Cr.P.C.\n<\/p>\n<p id=\"p_6\">      (a) The petitioner shall surrender before the learned Magistrate<\/p>\n<p>on 21.12.2007 at 11 a.m. The learned Magistrate shall release the<\/p>\n<p>petitioner on regular bail on condition that he executes a bond for<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only) with two solvent<\/p>\n<p>sureties each for the like sum to the satisfaction of the learned<\/p>\n<p>Magistrate.\n<\/p>\n<p id=\"p_7\">B.A.No. 7705 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p id=\"p_8\">      (b) The petitioner shall make himself available for interrogation<\/p>\n<p>before the Investigating Officer between 10 a.m. and 3 p.m. on<\/p>\n<p>22.12.07 and 24.12.2007 and thereafter on all Mondays and Fridays<\/p>\n<p>between    10 a.m. and 12 noon      for a period of two months and<\/p>\n<p>subsequently as and when directed by the Investigating Officer in<\/p>\n<p>writing to do so.\n<\/p>\n<p id=\"p_9\">      (c)   If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (1) above, these directions shall lapse<\/p>\n<p>on 21.12.07 and the police shall be at liberty thereafter to arrest the<\/p>\n<p>petitioner and deal with him in accordance with law.<\/p>\n<p id=\"p_10\">      (d) If the petitioner were arrested prior to his surrender on<\/p>\n<p>21.12.2007 as directed in clause (1) above, he shall be released on bail<\/p>\n<p>on his executing a bond for Rs.25,000\/-           without any surety<\/p>\n<p>undertaking to appear before the learned Magistrate on 21.12.2007.<\/p>\n<p id=\"p_11\">                                             (R.
