No body has appeared on behalf of the<\/p>\n<p>                  State. Let it be recorded that this matter was taken up on Friday<\/p>\n<p>                  (25.06.2010) also but owning to non-appearance of the counsel<\/p>\n<p>                  representing the state, the matter was adjourned to be heard today.<\/p>\n<p id=\"p_1\">                            Petitioner, who is the Receiver agent duly appointed by<\/p>\n<p>                  the Advocate Receiver under the order of the VIIth Bench of the<\/p>\n<p>                  City Civil Court at Calcutta in Miscellaneous Case no. 5012 of 2009<\/p>\n<p>                  (Zenith Credit Ltd. versus Pawan Kumar Singh) (Annexure-2),<\/p>\n<p>                  assails the order dated 11.9.2009 passed by the learned Additional<\/p>\n<p>                  Sessions Judge, F.T.C.-IV, Gaya in S.T. no. 175 of 2009 whereby<\/p>\n<p>                  the prayer made on behalf of the petitioner for release of ALTO car<\/p>\n<p>                  bearing registration no. BR-2E\/5628 has been considered and<\/p>\n<p>                  rejected on the grounds\/reasonings as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                             &#8220;It is clear from the aforesaid facts and<br \/>\n                           circumstances that the Calcutta City Court has not<br \/>\n                           passed an order for release of the aforesaid vehicle<br \/>\n                           which is an evidence in this case rather it has only<br \/>\n                           advised the master of the petitioner to take steps for<br \/>\n                           its release. Further more the case law filed on behalf<br \/>\n                           of this petitioner is differenciable from the<br \/>\n                           circumstances of this case and does not hold good in<br \/>\n                           this case. The aforesaid car is an important evidence<br \/>\n                           in this case and this petition appears to be an<br \/>\n                           endevour to remove the evidence of this case, so that<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     2<\/span><\/p>\n<p>         it could not be produced as an evidence during the<br \/>\n         trial. For the aforesaid reasons this application of<br \/>\n         petitioner Manikant Manish is hereby rejected.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_2\">           Relevant facts necessary for the disposal of the case<\/p>\n<p>may be indicated. Opposite party no. 2 herein had obtained the<\/p>\n<p>aforesaid vehicle on Hire Purchase agreement dated 9.6.2005<\/p>\n<p>executed by and between opposite party no. 2 and the aforesaid<\/p>\n<p>Zenith Credit Ltd. Admittedly the petitioner defaulted in making<\/p>\n<p>payment of the installments as contemplated thereunder. That<\/p>\n<p>promoted the company to file the aforesaid civil litigation before the<\/p>\n<p>Calcutta Court. As indicated in this order, on the application of the<\/p>\n<p>company, learned Civil Judge appointed Sri Dipak Kumar Das as<\/p>\n<p>Advocate Receiver for the purpose of taking over possession of the<\/p>\n<p>aforesaid vehicle. The Receiver was also authorised to take all<\/p>\n<p>possible steps including appointment of an agent and also to take<\/p>\n<p>police help if at all necessary. He\/she was directed to submit his\/her<\/p>\n<p>report by the next date. It appears from the documents placed on<\/p>\n<p>record that the petitioner herein was appointed as the Receiver<\/p>\n<p>agent by the Advocate Receiver so appointed by the Court. It<\/p>\n<p>further appears from the record that the aforesaid vehicle was<\/p>\n<p>seized in connection with Gaya Mufassil P.S. case no. 175 of 2008<\/p>\n<p>instituted under diverse sections<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of Indian Penal Code<\/a> including<\/p>\n<p><a href=\"\/doc\/1560742\/\" id=\"a_1\">Section 302<\/a> IPC which gave rise to aforesaid S.T. no. 175 of 2009.<\/p>\n<p id=\"p_3\">           Learned counsel for the petitioner submits that it will not<\/p>\n<p>be in the interest of justice to allow the vehicle to be kept seized<\/p>\n<p>and rot. It is next contended that the Court ought to have<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                          3<\/span><\/p>\n<p>      considered the application of the petitioner favourably as the<\/p>\n<p>      petitioner is prepared to furnish appropriate undertakings and<\/p>\n<p>      furnish sureties for production of the aforesaid vehicle as and when<\/p>\n<p>      called upon by the Court. Learned counsel for the petitioner states<\/p>\n<p>      before this Court that the petitioner is prepared to furnish a bond<\/p>\n<p>      and appropriate sureties as may be fixed by the learned Trial Court<\/p>\n<p>      and also to abide by the conditions that may be imposed by the<\/p>\n<p>      learned Trial Court while releasing the vehicle in question. It is<\/p>\n<p>      pointed out that forensic examination of blood stain etc. allegedly<\/p>\n<p>      found on the vehicle has already been made. Allowing the vehicle<\/p>\n<p>      to rot in these circumstances shall not sub-serve the cause of<\/p>\n<p>      justice.\n<\/p>\n<p id=\"p_4\">                 Learned counsel appearing on behalf of opposite party<\/p>\n<p>      no. 2 states before this Court that he has absolutely no objection in<\/p>\n<p>      such release in favour of the petitioner who is a representative of<\/p>\n<p>      the Court. He also submits that in the fitness of things, continued<\/p>\n<p>      seizure of the vehicle shall not serve any bona fide purpose.<\/p>\n<p id=\"p_5\">                 Having heard both sides, this Court is inclined to allow<\/p>\n<p>      this application. Consequently the impugned order dated 11.9.2009<\/p>\n<p>      passed in S.T. no. 175\/08 (State versus Pawan Singh) refusing to<\/p>\n<p>      release the vehicle in question is set aside and the learned Trial<\/p>\n<p>      Court is directed to release the vehicle in question on furnishing<\/p>\n<p>      appropriate sureties and the undertakings as may be deemed fit<\/p>\n<p>      and proper by the learned Trial Court.\n<\/p>\n<p id=\"p_6\">\n<pre id=\"pre_1\">pkj                          ( Kishore K.
