C.A.V. JUDGEMENT\n<\/p>\n
     1.Heard learned counsel for the parties.        The
\n     counsel for the petitioner states that the petitioner
\n     No.1 has already left the Government service, and as
\n     such, his name should be deleted, to which the counsel
\n     for the respondents has no objection. Order accordingly.
\n     The name of petitioner No.1 is deleted from this Special
\n     Civil Application.    The Special Civil Application is
\n     dismissed so far it relates to the petitioner No.1.\n<\/p>\n
 2.The petitioners, Probation Officers in the office
\nof the Director of Social Defence Department, Gujarat
\nState, Ahmedabad, filed this Special Civil Application
\nbefore this Court and challenge has been made to the
\norder of the respondent No.1 to terminate their services.
\nThe   petitioners    have challenged the order of the
\ntermination of their services on the ground that it is
\nillegal,    arbitrary, discriminatory and violative of
\nArticles 14 and 16 of the Constitution of India, and
\ncontrary to the administrative policy laid down by the
\nGovernment from time to time. Both the petitioners were
\nappointed as Probation Officer in the pay-scale of
\n425-700 under the order dated 12th May, 1977, and they
\nhave been appointed after selection and have been placed
\non probation.     As per the recruitment     rules,   the
\npetitioners    were required to pass the departmental
\nexamination and examination in Hindi and Gujarati.    The
\nother conditions have been fulfilled by the petitioners,
\nbut the condition of the passing of the departmental
\nexamination as required under the aforesaid rules was not
\nfulfilled.\n<\/p>\n
3.Now it is not necessary to give out all the
\ndetailed facts of the case as it is not in dispute that
\nthe   petitioner   No.3   has   passed the departmental
\nexamination later on and his services were regularised.
\nSo far as the petitioner No.2 is concerned, he has been
\ngiven one more chance for passing of the departmental
\nexamination by the department, subject to the approval of
\nthe State Government.    It is not in dispute between the
\nparties that the petitioner No.2       has   passed   the
\nexamination, but his result was not declared as it was
\nsubject to the approval of the State Government, and the
\nlatter declined to approve the same. However, the record
\nof the examination of the petitioner No.2 has been called
\nand he passed the examination.\n<\/p>\n
4.The learned counsel for the respondents contended
\nthat the chance has been given by the department subject
\nto the approval of the Government, and as such, when the
\napproval was not granted, the passing of the examination
\nby the petitioner No.2 is of no consequence and his
\ntermination order does not call for interference.\n<\/p>\n
5.I do not find any       justification   in   this
\ncontention of the counsel for the respondents.        The
\npetitioner No.2 was appointed, as stated earlier, after
\nselection and it was a regular appointment. It is not
\nthe case of temporary appointment or adhoc appointment or
\na back-door entry. It is true that the appointment of
\n the   petitioner was subject to the passing of the
\ndepartmental examination, but when the petitioner No.2
\nhas already passed the examination, I fail to see any
\njustification in the action of the respondent-State not
\nto accord the sanction to the result of the examination.
\nMoreover, the services of the petitioners were terminated
\nunder the order dated 17th October, 1984 only on the
\nground of non-passing of the departmental examination,
\nthat is after seven      years,   their   services   were
\nterminated.   The order of termination has been stayed by
\nthis Court as it transpires from the order of this Court
\ndated 23rd October, 1984. So the petitioners are working
\nin the department since 1977 and more than 19 years have
\nalready passed. In view of this fact, now it will not be
\nin the interest of justice to ask the petitioner to go to
\nhome. The departmental examination has to be passed and
\nthat examination has been passed, may be on a grace
\nchance given to the petitioner No.2.\n<\/p>\n
6.Taking into consideration the totality of the
\nfacts of this case, this writ petition deserves to be
\naccepted and the same succeeds. The orders annexure `G’
\ndated 17th October, 1984 at page Nos.31 and 33 relating
\nto the termination of the services of the petitioners
\nNo.2 and 3 are quashed and set aside. Rule is made
\nabsolute with no order as to costs.\n<\/p>\n
