He submitted that he is not involved in commission of<br \/>\n\toffence and is not named in the First Information Report.\n<\/p>\n<p id=\"p_5\">\tLearned<br \/>\n\tA.P.P. Ms.Nair resisted the present application and submitted that<br \/>\n\tthere are two cases registered against the applicant accused and,<br \/>\n\ttherefore, the present application may not be entertained.\n<\/p>\n<p id=\"p_6\">\tHaving<br \/>\n\theard learned advocate Mr.Chaudhry for the applicant and learned APP<br \/>\n\tMs. Nair for the State and considering the nature of offence and the<br \/>\n\tfact that charge sheet has now been filed, present application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p id=\"p_7\">\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.536\/2009 at<br \/>\n\tsector 7 Police Station, Gandhinagar on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p id=\"p_8\">(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p id=\"p_9\">(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p id=\"p_10\">(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p id=\"p_11\">(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p id=\"p_12\">(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English Calender between 11:00 AM to 2:00 PM.\n<\/p>\n<p id=\"p_13\">(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p id=\"p_14\">(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p id=\"p_15\">\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_16\">\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p id=\"p_17\">\tRule<br \/>\n\tis made absolute to the aforesaid extent.
