This appeal is directed against the judgment<br \/>\nof learned Sessions Judge, Bhatinda dated September 17,<br \/>\n1992, vide which Joginder Singh son of Mukhtiar Singh<br \/>\nrespondent stands acquitted of the charge under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Section<br \/>\n302<\/a> of the Indian Penal Code for allegedly committing<br \/>\nthe murder of his wife Chhinder Kaur on October 18,<br \/>\n1990.\n<\/p>\n<p id=\"p_2\">2. Brief diary of the prosecution case is that<br \/>\nChhinder Kaur deceased, daughter of Gurbachan Singh<br \/>\n(PW-2) was married to Joginder Singh respondent three<br \/>\nyears prior to her death. No child was born out of the<br \/>\nwed-lock. Joginder. Singh had allegedly started<br \/>\nmaltreating and beating her as he was not satisfied<br \/>\nwith the dowry given at the time of marriage and also<br \/>\nbecause she did not bear a child. She was turned out<br \/>\nor her matrimonial home and started living with her<br \/>\nfather. However, due to the intervention of the<br \/>\nPanchayat, she again started living with the<br \/>\nrespondent.\n<\/p>\n<p id=\"p_3\">3. Gurdip Singh (PW3), brother of Chhinder Kaur<br \/>\nhad allegedly gone to the house of the respondent a day<br \/>\nprior to Diwali (i.e. on 17-10-1990) alongwith<br \/>\ncertain Diwali gifts and had stayed at the house of the<br \/>\nrespondent overnight. The respondent and Chhinder Kaur<br \/>\nhad some altercation before going to bed. In the<br \/>\nmorning Gurdip Singh heard cries of his sister, went to<br \/>\nthe place where she was sleeping and saw that the<br \/>\nrespondent was siting on the chest of his sister and<br \/>\nwas strangulating her with a string. He allegedly made<br \/>\nan attempt to intervene but was pushed by the<br \/>\nrespondent. The respondent filed away from the spot.<br \/>\nGurdip Singh made an attempt to save his sister but she<br \/>\nwas already dead. Gurdip Singh then went to Talwandi<br \/>\nSabo, which is at a distance of 16-17 miles from the<br \/>\nplace of occurrence and informed his father.<br \/>\nThereafter they came to Bhatinda at the house of the<br \/>\nrespondent, saw the dead body and then went to the<br \/>\nconcerned police station and lodged the First<br \/>\nInformation Report against the respondent.\n<\/p>\n<p id=\"p_4\">4. Originally, the case was registered under<br \/>\n<a href=\"\/doc\/653797\/\" id=\"a_1\">Section 304-B<\/a> IPC but the challan against the<br \/>\nrespondent was presented under <a href=\"\/doc\/1560742\/\" id=\"a_2\">Section 302<\/a> IPC. He was<br \/>\ncharged under <a href=\"\/doc\/1560742\/\" id=\"a_3\">Section 302<\/a> IPC and on a consideration of<br \/>\nthe entire evidence, the learned trial Judge acquitted<br \/>\nhim of the charge. Hence this appeal by the State of<br \/>\nPunjab.\n<\/p>\n<p id=\"p_5\">5. We have heard Mr. G.S. Gill, learned Deputy<br \/>\nAdvocate General for the State of Punjab and Mr.<br \/>\nA.P.S. Deol, learned counsel for the respondent. With<br \/>\nthe assistance of both the learned counsel, the<br \/>\nevidence recorded by the trial Court and the other<br \/>\nrelevant documents have been perused by us minutely.\n<\/p>\n<p id=\"p_6\">6. Mr. G.S. Gill, learned Deputy Advocate General<br \/>\nhas vehemently argued that the case of the prosecution<br \/>\nis proved to the hill and that the acquittal of the<br \/>\nrespondent for the offence punishable under <a href=\"\/doc\/1560742\/\" id=\"a_4\">Section 302<\/a><br \/>\nIPC is bad. Advancing his arguments, Mr. Gill submitted<br \/>\nthat there is no reason to disbelieve Gurdip Singh<br \/>\n(PW3), the real brother of the deceased, who had<br \/>\nwitnessed the respondent sitting on her chest and<br \/>\nstrangulating it with a string. Simultaneously, it has<br \/>\nalso been argued by Mr. Gill that in case the<br \/>\nprosecution story is not believed for the purpose of<br \/>\nbringing home the guilt to the respondent within the<br \/>\nfour corners of <a href=\"\/doc\/1560742\/\" id=\"a_5\">Section 302<\/a> IPC, he should have been<br \/>\nconvicted under <a href=\"\/doc\/653797\/\" id=\"a_6\">Section 304-B<\/a> IPC on the basis of the<br \/>\ncogent evidence on the file which shows that Chhinder<br \/>\nKaur was being harassed and maltreated on account of<br \/>\nbringing less dowry and that she had died an unnatural<br \/>\ndeath at the house of the respondent within seven years<br \/>\nof her marriage. Mr. Gill thus prays that acquittal of<br \/>\nthe respondent is bad and he may be convicted under<br \/>\n<a href=\"\/doc\/653797\/\" id=\"a_7\">Section 304-B<\/a> IPC if not under <a href=\"\/doc\/1560742\/\" id=\"a_8\">Section 302<\/a> IPC.\n<\/p>\n<p id=\"p_7\">7. On the other hand, APS Deol, learned counsel<br \/>\nfor the respondent has strenuously argued that the<br \/>\nprosecution has miserably failed to establish that it<br \/>\nwas a case of strangulation in any manner to prove the<br \/>\ncharge under <a href=\"\/doc\/1560742\/\" id=\"a_9\">Section 302<\/a> IPC against the respondent.<br \/>\nAccording to Mr. Deol, the statement of Gurdip Singh<br \/>\n(PW-3) is most unreliable on the face of it and<br \/>\npossibly he had not witnessed the respondent killing<br \/>\nhis sister, as alleged. Advancing his arguments on<br \/>\nthis count, Mr. Deol has submitted that the medical<br \/>\nevidence on the record is also not corroborating the<br \/>\nversion given by Gurdip Singh (PW-3) because according<br \/>\nto his statement two turns around the neck wee made by<br \/>\nthe respondent with the string and that the sides were<br \/>\nthen pulled, whereas according to Dr. Charanjit Garg,<br \/>\nthe Autopsy Surgeon (PW-1), he found only one reddish<br \/>\nbrownish groove above the thyroid cartilage on the<br \/>\nright side of the neck and a similar groove on the left<br \/>\nside of the neck at the level of angle of mandible. As<br \/>\nsuch, according to Mr. Deol, the learned trial Court has<br \/>\nrightly disbelieved the prosecution story on this<br \/>\ncount. He has further submitted that the evidence of<br \/>\nDr. Charanjit Garg (PW-1) is enough to uproot the<br \/>\nprosecution story in its totality because the statement<br \/>\nof this witness makes it crystal clear that Chhinder<br \/>\nKaur died because of asphyxia on account of hanging and<br \/>\nnot because of strangulation.\n<\/p>\n<p id=\"p_8\">8. To meet the second submission of learned<br \/>\ncounsel for the appellant, Mr. Deol has submitted that<br \/>\nthere is no cogent evidence worth the name adduced by<br \/>\nthe prosecution to prove any specific demand of dowry<br \/>\nwithin three years of marriage. In this context, Mr.<br \/>\nDeol has taken us through the statement of Gurbachan<br \/>\nSingh (PW-2), the father and Gurdip Singh (PW-3), the<br \/>\nbrother of the deceased, in which they have not stated<br \/>\neven a word about any specific demand of dowry from the<br \/>\nside of the respondent. Mr. Deol at the same time has<br \/>\nread out the statement of Sohan Singh son of Kartar<br \/>\nSingh (PW-5), who is read brother of the deceased&#8217;s<br \/>\nmother (Mama) and has stated in his cross-examination<br \/>\nthat he had not mentioned anything regarding the demand<br \/>\nof dowry in his statement before the police and that he<br \/>\nhad only told the police about the strained relations<br \/>\nbetween the deceased and the respondent. He, in fact,<br \/>\nis a common relative of both the sides and had brought<br \/>\nabout the marriage between the deceased and the<br \/>\nrespondent (as Bachola). Mr. Deol, picking up the<br \/>\nthread from this evidence, has submitted that in fact<br \/>\nChhinder Kaur was not bearing a child for a continuous<br \/>\nperiod of three years after her marriage and that she<br \/>\nused to get aborted after the conception, which brought<br \/>\na lot of depression on her and consequently she<br \/>\ncommitted suicide by hanging herself and as such, there<br \/>\nis no inherent infirmity in the appreciation of<br \/>\nevidence by the trial Court for acquitting the<br \/>\nrespondent of the charge framed against him and that<br \/>\nthe present appeal merits dismissal.\n<\/p>\n<p id=\"p_9\">9. Since it is an appeal against acquittal, we<br \/>\nare alive to the proposition laid down by the Apex<br \/>\nCourt that the Appellate Court should not interfere in<br \/>\nan appeal against acquittal as long as the view taken<br \/>\nby the trial Court is most unreasonable and perverse.<br \/>\nAlthough the Appellate Court is fully competent to<br \/>\nre-appreciate the materials on record and in coming to<br \/>\nits conclusion, at the same time, it is also expected<br \/>\nfrom the Appellate Court to bear in mind the reasons<br \/>\nadvanced by the trial Court while acquitting the<br \/>\naccused. No doubt, the acquittals shake the confidence<br \/>\nof the people in the system but much worse is the<br \/>\nwrongful conviction of an innocent person.\n<\/p>\n<p id=\"p_10\">10. We have minutely scanned the entire evidence<br \/>\non record and are of the view that the prosecution has<br \/>\nmiserably failed to prove its case against the<br \/>\nrespondent on any count. Gurdip Singh (PW-3), the<br \/>\nso-called eye witness of the occurrence has rendered<br \/>\nhimself most unreliable. If his evidence is<br \/>\nappreciated in the light of the medical evidence, it<br \/>\nleaves no room of doubt that he was not present on the<br \/>\nnight a day prior to Diwali at the house of the<br \/>\nrespondent. The charge under <a href=\"\/doc\/1560742\/\" id=\"a_10\">Section 302<\/a> IPC is, thus,<br \/>\nnot proved to the hilt.\n<\/p>\n<p id=\"p_11\">11. So far as the second contention of Mr. Gill<br \/>\nregarding involvement of the respondent in the offence<br \/>\nunder <a href=\"\/doc\/653797\/\" id=\"a_11\">Section 304-B<\/a> IPC is concerned (though no charge<br \/>\nframed by the trial Court on this count), after<br \/>\nminutely scanning the statement of the two star<br \/>\nwitnesses, viz. Gurbachan Singh (PW-2) and Gurdip<br \/>\nSingh (PW-3), we are of the considered view that they<br \/>\nare of no help to the prosecution. These two<br \/>\nwitnesses, being father and brother of the deceased, do<br \/>\nnot talk of even a word about any specific demand from<br \/>\nthe side of the respondent during the period of three<br \/>\nyears of the marriage of Chhinder Kaur. There is a<br \/>\ngeneral allegation of demand for dowry, which in the<br \/>\ncircumstances of the present case, cannot be given any<br \/>\nweightage. Rather the case of the prosecution as<br \/>\nprojected by these two witnesses is that Chhinder Kaur<br \/>\nwas being maltreated on account of the fact that she<br \/>\nwas unable to bear a child. It rather strengthens the<br \/>\ndefence of the respondent. The prosecution has not<br \/>\nbeen able to prove even the basic ingredients of<br \/>\n<a href=\"\/doc\/653797\/\" id=\"a_12\">Section 304-B<\/a> IPC.\n<\/p>\n<p id=\"p_12\">12. There is no compelling and substantial<br \/>\nreason for this Court to come to a conclusion different<br \/>\nfrom the trial Court in this case and we are of the<br \/>\nview that the impugned judgment of learned Sessions<br \/>\nJudge recording acquittal of the appellant is<br \/>\nindicative of the cogent reasons based on proper<br \/>\nappreciation of the entire evidence.\n<\/p>\n<p id=\"p_13\">13.
