Writ Petition No. 41195 of 2006\n                                  Kamruddin\n                                    Vs.\n                            Jabardin and others.\nHon'ble Sanjay Misra,J.\n<\/pre>\n<p id=\"p_1\">      Heard Sri Sumit Daga, learned counsel for the petitioner, learned<br \/>\nStanding Counsel for the State respondents and Sri Mohd. Yusuf, learned<br \/>\ncounsel for the respondents no. 3 to 6. The cause list has been revised. None<br \/>\nappears on behalf of the other respondents.\n<\/p>\n<p id=\"p_1\">      Counter and rejoinder affidavits have been exchanged between the<br \/>\npetitioner and the respondents no.3 to 7 and the same are available on<br \/>\nrecord.\n<\/p>\n<p id=\"p_2\">      The petitioner is aggrieved by the order dated 3.7.2006 (Annexure-15 to<br \/>\nthe writ petition) passed by the Additional Commissioner, Saharanpur Division<br \/>\nSaharanpur in Revision No. 68 of 2005-06, whereby the revision filed by the<br \/>\nrespondents no. 3 to 6 has been allowed and the order dated 27.1.2006<br \/>\npassed by the Assistant Collector, Muzaffar Nagar has been set aside.\n<\/p>\n<p id=\"p_3\">      Sri Daga, learned counsel for the petitioner submits that in proceeding<br \/>\nunder Section 176 of the U.P.Z.A.&amp; L.R. Act, kurras have been finally<br \/>\nprepared and approved. However, on an application made by the respondents<br \/>\nno.3 to 6 along with an application for condonation of delay, the Assistant<br \/>\nCollector passed the order dated 27.1.2006 rejecting the same and<br \/>\nmaintaining the earlier order dated 29.2.2000. According to learned counsel<br \/>\nfor the petitioner, the respondents no. 3 to 6 preferred a Revision No. 68 of<br \/>\n2005-06 under Section 333 of the U.P.Z.A. &amp; L.R. Act and the Revisional<br \/>\nCourt has set aside the order dated 27.1.2006 without issuance of notice to<br \/>\nthe petitioner and directed the Assistant Collector to decide the proceeding<br \/>\nunder Section 178 of the U.P.Z.A. &amp; L.R. Act on its merits. He states that<br \/>\nwhen the application for condonation of delay and the application for recall of<br \/>\nthe final order passed in the proceeding for division of Bhumidhari have been<br \/>\nrejected by the Assistant Collector the Revisional Court ought to have issued<br \/>\nnotice to the petitioner and granted him an opportunity of hearing and<br \/>\nsecondly the Revisioal Court could have set aside the order of the Assistant<br \/>\nCollector but it should have required the Assistant Collector to reconsider the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                         -2-<\/span><\/p>\n<p>reason for condoning the delay for recall of the earlier exparte order.\n<\/p>\n<p id=\"p_4\">      Sri Mohd. Yusuf, learned counsel for the respondents no. 3 to 6 has<br \/>\nsubmitted that the respondents no. 3 to 6 were the co-sharer of the land in<br \/>\nquestion by virtue of sale-deed and in the proceeding under Section 176 of<br \/>\nthe U.P.Z.A. &amp; L.R. Act, they were not made party and the petitioner obtained<br \/>\nan exparte order for division of Bhumidhari and therefore, the Assistant<br \/>\nCollector has rightly allowed the condonation of delay application and recall<br \/>\napplication given by the respondents no. 3 to 6 and had required the<br \/>\nproceeding under Sections 176 and 178 of the U.P.Z.A. &amp; L.R. Act to be re-<br \/>\ndecided on its merits.\n<\/p>\n<p id=\"p_5\">      Having considered the submissions of learned counsel for the parties<br \/>\nand perused the record, insofar as the order dated 27.1.2006 passed by the<br \/>\nAssistant Collector is concerned, the same is not under challenged in this writ<br \/>\npetition and therefore, no opinion can be expressed thereupon.\n<\/p>\n<p id=\"p_6\">      Insofar as the impugned order dated 3.7.2006 passed by the Revisional<br \/>\nCourt is concerned, there is no denial by the respondents that the same was<br \/>\npassed without notice to the petitioner and without giving him opportunity to<br \/>\nput forward his case in support of the order dated 27.1.2006 passed by the<br \/>\nAssistant Collector.\n<\/p>\n<p id=\"p_7\">      Since there is no denial of the aforesaid submission nor the impugned<br \/>\norder passed by the Additional Commissioner speaks of any notice of hearing<br \/>\nto the petitioner the impugned order appears to have been passed behind the<br \/>\nback of the petitioner, hence it cannot be sustained.\n<\/p>\n<p id=\"p_8\">      For the aforesaid reasons, the impugned order dated 3.7.2006<br \/>\n(Annexure-15 to the writ petition) passed by the Additional Commissioner,<br \/>\nSaharanpur Division Saharanpur in Revision No. 68 of 2005-06 is set aside<br \/>\nand the court below is required to decide the revision after giving opportunity<br \/>\nto the parties and in accordance with law.\n<\/p>\n<p id=\"p_9\">      The writ petition stands allowed as above.\n<\/p>\n<p id=\"p_10\">      No order is passed as to costs.\n<\/p>\n<p id=\"p_11\">Dated:9.8.2010<br \/>\nLbm\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Kamruddin vs Jabardin &amp; Others on 9 August, 2010 Court No. 28 Civil Misc.
