SIRI JAGAN, J.\n                - - - - - - - - - - - - - - - - - - - - - - -\n                    W.P.(C)No.35109 of 2010\n                - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 20th day of December, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner is a Santhi in Pachayyam Devaswom,<\/p>\n<p>Chezhugannoor Sub Group, Neyyattinkara under the<\/p>\n<p>Travancore Devaswom Board.                He was under suspension<\/p>\n<p>from 30.12.2003 to 24.05.2005 and was reinstated. Again<\/p>\n<p>he was placed under suspension from 07.07.2005 and was<\/p>\n<p>reinstated on 24.12.2009. Subsequently, Ext.P9 memo of<\/p>\n<p>charges has been issued to the petitioner.                    Further by<\/p>\n<p>Ext.P10 order the period of suspension has been treated as<\/p>\n<p>period of leave without allowances and the subsistence<\/p>\n<p>allowance was ordered to be recovered from him.                      The<\/p>\n<p>petitioner seeks the following reliefs:<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;a. Call for the records leading to the passing of Exhibit P10<br \/>\n          and quash the same to the extent it directs the recovery<br \/>\n          of subsistence allowance paid to the petitioner during the<br \/>\n          period of his suspension from 30.12.2003 to 24.05.2005<br \/>\n          by issuing a writ of certiorari or any other appropriate<br \/>\n          writ, direction or order.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      b.  issue a writ of mandamus or any other appropriate writ,<br \/>\n          direction or order directing the respondents to complete<br \/>\n          the enquiry proceedings initiated against the petitioner<br \/>\n          on the basis of Exhibit P9 as expeditiously as possible.\n<\/p><\/blockquote>\n<p id=\"p_1\">W.P.(C)No.35109 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    -2-<\/span><\/p>\n<p>      c.    issue a writ of mandamus or any other appropriate writ,<br \/>\n            direction or order directing the respondents to disburse<br \/>\n            the subsistence allowance payable to the petitioner<br \/>\n            during the period of his suspension from 7.7.2005 till<br \/>\n            reinstatement with 12% interest therein and also to<br \/>\n            disburse the pay revision benefits to the petitioner as<br \/>\n            expeditiously as possible.&#8221;\n<\/p>\n<p id=\"p_2\">\n      On 8.12.2010, I passed the following interim order:<\/p>\n<p>      &#8220;Admit. The learned standing counsel takes notice on behalf of<br \/>\n      the respondents.\n<\/p>\n<p id=\"p_3\">            There would be an interim stay of recovery of any part of<br \/>\n      the subsistence allowance paid to the petitioner during the first<br \/>\n      period of suspension. There would also be a direction to the<br \/>\n      respondents to see that the subsistence allowance due to the<br \/>\n      petitioner for the period of suspension from 7.7.2005 till<br \/>\n      24.12.2009 is paid within one month from the date of receipt of<br \/>\n      a copy of this order. The learned standing counsel shall get<br \/>\n      instructions as to within what time, the pending disciplinary<br \/>\n      proceedings against the petitioner can be completed.<\/p>\n<p id=\"p_4\">            Post after a week.&#8221;\n<\/p>\n<p id=\"p_5\">\n      Today, the learned standing counsel for the Devaswom<\/p>\n<p>Board submits that, they would require two more months&#8217;<\/p>\n<p>time to complete the disciplinary proceedings. In the above<\/p>\n<p>circumstances confirming the interim, order I dispose of<\/p>\n<p>this writ petition with a further direction to the respondents<\/p>\n<p>to complete the disciplinary proceedings against the<\/p>\n<p>petitioner within a period of two months from the date of<\/p>\n<p>receipt of a copy of this judgment. Needless to say that the<\/p>\n<p>petitioner shall co-operate with the enquiry and be ready to<\/p>\n<p>W.P.(C)No.35109 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            -3-<\/span><\/p>\n<p>participate in the enquiry whenever the enquiry is posted.<\/p>\n<p>The challenge against recovery of the subsistence allowance<\/p>\n<p>is left open to be taken up by the petitioner after the<\/p>\n<p>disciplinary proceedings are over. Till then recovery shall<\/p>\n<p>not be made.\n<\/p>\n<p id=\"p_6\">                                             S.
