Whether reporters of local papers may be allowed<br \/>\n                          to see the judgment ?\n<\/p>\n<p id=\"p_1\">                   2. Whether the judgment should be reported in the<br \/>\n                          digest?\n<\/p>\n<p id=\"p_3\">K. Kannan, J (oral).\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                   1.     The revision is against an order passed by the<\/p>\n<p>Motor Accident Claims Tribunal, Karnal dismissing the petition for non-<\/p>\n<p>appearance of the petitioner on the day when the case had been posed. It<\/p>\n<p>appears that the petitioner filed a petition for restoration and it was objected<\/p>\n<p>to by the respondent that the restoration application was not maintainable<\/p>\n<p>and that the remedy was only before the High Court. On the basis of said<\/p>\n<p>objection it appears that the petitioner had withdrawn the petition and he<\/p>\n<p>has filed the revision against the order of dismissal of the petition for non-<\/p>\n<p>prosecution. The order for dismissing the petition for non-prosecution has<\/p>\n<p>been passed as early as on 28.8.2007 and the revision is filed in the year<\/p>\n<p>2009.\n<\/p>\n<p id=\"p_6\">                   2.     Although the      revision is clearly barred           by<\/p>\n<p>limitation and also the contention that the petition which is dismissed<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> CR No. 1122 of 2009                              2<\/span><\/p>\n<p>for   non-prosecution could not be restored are both untenable, I still<\/p>\n<p>consider it necessary to give an opportunity to the party to prosecute the<\/p>\n<p>case on merits. The withdrawal of the petition itself has come only by the<\/p>\n<p>untenable objections taken by the counsel for the Insurance Company.<\/p>\n<p>The parties are invariably guided by advice of the counsel and shall not be<\/p>\n<p>allowed to suffer by wrong advise and by filing a revision under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a><\/p>\n<p>in a matter where the appropriate remedy would have been only to file a<\/p>\n<p>petition, for restoration of the claim petition which was dismissed not on<\/p>\n<p>merits but for non-appearance of the parties.<\/p>\n<p id=\"p_7\">                  3.    Under the circumstances, I set aside the order of<\/p>\n<p>dismissal made by the Motor Accident Claims Tribunal, Karnal on<\/p>\n<p>28.8.2007 and dispense with notice to the respondent in the revision<\/p>\n<p>petition only on account of the untenability of the stand     taken by the<\/p>\n<p>Insurance Company and to ensure quicker conclusion of the proceedings.<\/p>\n<p>The Civil revision is disposed of directing the Motor Accident Claims<\/p>\n<p>Tribunal to restore the petition which was dismissed for default on<\/p>\n<p>28.8.2007 and dispose of the case on merits in accordance with law.<\/p>\n<p id=\"p_8\">                  4.    Parties shall appear before the Motor Accident<\/p>\n<p>Claims Tribunal on 31.3.2009.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                                  (K.
