No. 1826 OF 2006 C\n                ````````````````````````````````````````````````````\n              Dated this the 16th day of November, 2007\n\n                                  O R D E R\n<\/pre>\n<p id=\"p_1\">            The revision petitioners, who are father and son, claim<\/p>\n<p>to be the owners in respect of 1.60 acres of land in Kallettumkara<\/p>\n<p>village.  The said land is stated to be a paddy field.                   The 1st<\/p>\n<p>respondent,    namely       Irinjalakuda         Diocese        Education Trust<\/p>\n<p>represented by the Bishop of Irinjalakuda, is alleged to have<\/p>\n<p>purchased 40 acres of land in Kallettumkara and Kodakara<\/p>\n<p>villages for the purpose of starting an engineering college. The<\/p>\n<p>grievance of the revision petitioners is that the 1st respondent had<\/p>\n<p>filled up paddy fields and converted the same to building sites<\/p>\n<p>without getting permission from the competent authority under the<\/p>\n<p>Kerala Land Utilisation Order and as a result of such filling and<\/p>\n<p>conversion, a natural water course flowing through the paddy filed<\/p>\n<p>was encroached upon and blocked affecting the paddy cultivation<\/p>\n<p>of the petitioners and others.                Accordingly, the 1st revision<\/p>\n<p>petitioner moved the Revenue Divisional Officer, Thrissur. The<\/p>\n<p>revision petitioners claim to have moved the RDO under <a href=\"\/doc\/983382\/\" id=\"a_1\">section<\/p>\n<p>133<\/a> Cr.P.C. alleging the obstruction of a public water course.<\/p>\n<p>Crl.R.P.No.1826\/06<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  : 2 :<\/span><\/p>\n<p>While the matter was pending before the RDO, the 1st revision<\/p>\n<p>petitioner filed OP.10458\/02 before this court for appropriate<\/p>\n<p>directions to the RDO for disposal of the petition filed by the 1st<\/p>\n<p>revision petitioner. The said O.P. was disposed of by this court on<\/p>\n<p>1.6.04 directing the RDO, Thrissur to look into the grievance<\/p>\n<p>raised by the 1st revision petitioner herein in the petition filed by<\/p>\n<p>him and to take proper decision in accordance with law, after<\/p>\n<p>affording an opportunity of being heard to the 1st revision<\/p>\n<p>petitioner, the 1st respondent Irinjalakuda Diacese Education Trust<\/p>\n<p>and any other person interested. Thereafter, the RDO passed an<\/p>\n<p>order dated 14.12.04 as D1-4430\/202 holding that the water<\/p>\n<p>course had been unlawfully obliterated rendering paddy cultivation<\/p>\n<p>impossible due to non-availability of water for irrigation and that<\/p>\n<p>the said water course is to be restored to its original condition and<\/p>\n<p>directing the Secretary of the Kodakara Grama Panchayat to take<\/p>\n<p>urgent steps to restore the water course to its original condition<\/p>\n<p>within one month of the said order and to report the action taken in<\/p>\n<p>that behalf to the RDO. Aggrieved by the said decision, the 1st<\/p>\n<p>respondent education trust filed a revision before the Sessions<\/p>\n<p>Court, Thrissur as Crl.R.P.10\/05 against the revision petitioners,<\/p>\n<p>Crl.R.P.No.1826\/06<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 : 3 :<\/span><\/p>\n<p>District Collector and the Kodakara Grama Panchayat. The said<\/p>\n<p>revision was filed on 19.1.05. Since the revision was filed beyond<\/p>\n<p>the period of limitation prescribed for the same an application was<\/p>\n<p>filed as Crl.M.P. 119\/05 for condoning the delay of 5 days. The<\/p>\n<p>said application appears to have been filed by Advocate<\/p>\n<p>Sri.K.M.Thomas Raj who is none other than the counsel who was<\/p>\n<p>appearing for the 1st respondent\/Educational Trust.             The<\/p>\n<p>proceedings paper produced as Annexure-A5 shows that on<\/p>\n<p>15.2.05 Crl.M.P.119\/05 was allowed and the revision was admitted<\/p>\n<p>and notice was issued by the Principal Sessions Court, Thrissur.<\/p>\n<p>The revision was thereafter made over to the I Additional Sessions<\/p>\n<p>Court. It was on 28.3.05 that the revision petitioners herein who<\/p>\n<p>were respondents 1 and 2 in the above revision entered<\/p>\n<p>appearance through counsel.\n<\/p>\n<p id=\"p_1\">      2.     The learned counsel appearing for the revision<\/p>\n<p>petitioners submitted that the Sessions Court was acting illegally in<\/p>\n<p>entertaining the revision filed out of time by condoning the delay<\/p>\n<p>without issuing notice on the delay petition to the respondents<\/p>\n<p>therein. He also contended that the order impugned in the above<\/p>\n<p>revision was not a final order passed by the RDO in terms of<\/p>\n<p>Crl.R.P.No.1826\/06<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                   : 4 :<\/span><\/p>\n<p><a href=\"\/doc\/1834702\/\" id=\"a_1\">Section 138<\/a> Cr.P.C. The above grounds have been specifically<\/p>\n<p>raised in this revision. The learned counsel appearing for the 1st<\/p>\n<p>respondent also was not able to support the order passed on<\/p>\n<p>Crl.M.P.119\/05 without issuing notice to the respondents therein.<\/p>\n<p>When a proceedings filed before a court is beyond the period of<\/p>\n<p>limitation fixed by law and condonation of the delay is sought, the<\/p>\n<p>principles of natural justice demand that the persons who would be<\/p>\n<p>aggrieved by condoning the delay are heard. This is because a<\/p>\n<p>valuable right has accrued to the opposite party on account of the<\/p>\n<p>lapse of time and such right cannot be interfered with lightly. In a<\/p>\n<p>case where limitation has been prescribed for certain category of<\/p>\n<p>offences under the <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>. eventhough the court possesses the<\/p>\n<p>right to condone the delay if it is of the view that it is expedient in<\/p>\n<p>the interest of justice to do so, the court cannot condone the delay<\/p>\n<p>without issuing notice to the persons affected thereby. This is<\/p>\n<p>because of the principle of audi alteram partem which is attracted.<\/p>\n<p>It means that no person shall be contemned unheard. [See in this<\/p>\n<p>connection, State of Maharashtra Vs. Sharadchandra Vinayak<\/p>\n<p>Dongre and others [AIR 1995 SC 231]. The Sessions Judge by<\/p>\n<p>condoning the delay and allowing Crl.M.P.119\/05 behind the back<\/p>\n<p>Crl.R.P.No.1826\/06<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                  : 5 :<\/span><\/p>\n<p>of the revision petitioners was committing a manifest error of<\/p>\n<p>jurisdiction. The matter has, therefore, to go back to the Sessions<\/p>\n<p>Court.\n<\/p>\n<p id=\"p_2\">      3.     The propriety of the counsel appearing for the revision<\/p>\n<p>petitioners before the Sessions Court filing a petition to condone<\/p>\n<p>the delay may also have to be gone into by that court. Yet another<\/p>\n<p>aspect which may have to be considered is the maintainability of<\/p>\n<p>the revision before that court. If the order dated 14.12.04 of the<\/p>\n<p>RDO was not a final order under <a href=\"\/doc\/1834702\/\" id=\"a_3\">section 138<\/a> Cr.P.C., then it wold<\/p>\n<p>not be revisable under <a href=\"\/doc\/1457888\/\" id=\"a_4\">section 397<\/a> Cr.P.C. It was without going<\/p>\n<p>into all these preliminary aspects that the learned Sessions Judge<\/p>\n<p>disposed of the revision and set aside the order passed by the<\/p>\n<p>RDO as if the revision itself was competently filed in accordance<\/p>\n<p>with law. The only alternative available to this court is, therefore,<\/p>\n<p>to set aside the revisional order dated 6.1.06 passed by the I<\/p>\n<p>Additional Sessions Court, Thrissur in Crl.R.P.10\/05 and direct<\/p>\n<p>that court to consider the aforementioned aspects and pass fresh<\/p>\n<p>orders in accordance with law. It goes without saying that both<\/p>\n<p>sides shall be entitled to address the Sessions Court regarding the<\/p>\n<p>maintainability of the revision, regarding the propriety of the delay<\/p>\n<p>Crl.R.P.No.1826\/06<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                                 : 6 :<\/span><\/p>\n<p>petition filed by the counsel for the revision petitioner therein and<\/p>\n<p>such other relevant matters which may be raised by the parties.<\/p>\n<p>The order dated 6.1.06 passed by the I Additional Sessions Court,<\/p>\n<p>Thrissur in Crl.R.P.10\/05 is accordingly set aside and the matter is<\/p>\n<p>remanded to that court for fresh disposal in accordance with law<\/p>\n<p>and in the light of the observations hereinabove contained. The<\/p>\n<p>parties shall appear before the I Additional Sessions Court,<\/p>\n<p>Thrissur on 10.12.2007 without any further notice. It is needless<\/p>\n<p>to say that that court shall give top priority to this case and make<\/p>\n<p>every endevour to dispose of the same expeditiously and at any<\/p>\n<p>rate, within two months of the date of appearance of the parties.<\/p>\n<p id=\"p_3\">      This revision is disposed of as above.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                             (V.
