Garg, Counsel for petitioner\nShri Anees Bhurat, PP for the State\n                      ####\n\n\nBy the Court:<\/pre>\n<p id=\"p_1\">        Heard    learned           counsel      for     petitioner      as<\/p>\n<p>well as learned Public Prosecutor and perused<\/p>\n<p>the   material        made     available           to me during the<\/p>\n<p>arguments of the case.\n<\/p>\n<p id=\"p_1\">        Learned       counsel        for      petitioner         submitted<\/p>\n<p>that, after investigation of the case, a charge-<\/p>\n<p>sheet    was     filed        in    the       matter       only    against<\/p>\n<p>accused Chidiya @ Baldeo Singh for the offence<\/p>\n<p>under Sections 302 and 323, <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>; however, after<\/p>\n<p>recording       the         statements        of     two    prosecution<\/p>\n<p>witnesses, namely, Ishwari Devi and Jato Bai,<\/p>\n<p>the trial court, on an application filed by the<\/p>\n<p>prosecution       under        <a href=\"\/doc\/1138947\/\" id=\"a_1\">Section         319<\/a>,     <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.,      took<\/p>\n<p>cognizance against              the accused-petitioner vide<\/p>\n<p>order    dated        9th    February,         2009,       and    accused-<\/p>\n<p>petitioner       was         summoned         through      non-bailable<\/p>\n<p>warrant;        the         petitioner         has      already       been<br \/>\n                                     \/\/ 2 \/\/<\/p>\n<p>arrested and he moved an application for bail<\/p>\n<p>but   the     same      has    been       rejected         by     the   trial<\/p>\n<p>court vide order dated 2nd July, 2009. Since the<\/p>\n<p>statements of prosecution witnesses are contrary<\/p>\n<p>to their statements under <a href=\"\/doc\/447673\/\" id=\"a_3\">Section 161<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>.,<\/p>\n<p>therefore, this is a fit case for grant of bail<\/p>\n<p>to the accused-petitioner. The above facts have<\/p>\n<p>not    been       disputed          by        the     learned           Public<\/p>\n<p>Prosecutor.\n<\/p>\n<p id=\"p_2\">       After          considering             the     submissions           of<\/p>\n<p>learned counsel for the parties, examining the<\/p>\n<p>record and the facts and circumstances of the<\/p>\n<p>case, but without expressing any opinion on its<\/p>\n<p>merits and demerits, I think it fit and proper<\/p>\n<p>to    allow    this         application         under       <a href=\"\/doc\/1290514\/\" id=\"a_5\">Section       439<\/a>,<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_3\">       Hence,          it     is     directed             that     accused-<\/p>\n<p>petitioner Jagseer Singh S\/o Madu Ram, R\/o 61 F,<\/p>\n<p>Tehsil      Sri       Karanpur,       District            Sri    Ganganagar<\/p>\n<p>(presently lodged at Sub Jail Sri Karanpur) be<\/p>\n<p>released on bail under <a href=\"\/doc\/1290514\/\" id=\"a_7\">Section 439<\/a> Cr.P.C., in<\/p>\n<p>F.I.R. No.178\/2008 registered at Police Station<\/p>\n<p>Sri    Karanpur,         District         Sri       Ganganagar,         under<\/p>\n<p><a href=\"\/doc\/1983271\/\" id=\"a_8\">Sections      302<\/a>       and        <a href=\"\/doc\/770961\/\" id=\"a_9\">323<\/a>\/<a href=\"\/doc\/387648\/\" id=\"a_10\">34<\/a>,          <a href=\"\/doc\/1569253\/\" id=\"a_11\">IPC<\/a>,    provided        he<\/p>\n<p>furnishes         a    personal          bond        in     the     sum     of<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only)<\/p>\n<p>together with one surety of the like amount to<\/p>\n<p>the    satisfaction           of    the       trial       court    for     his<br \/>\n                                   \/\/ 3 \/\/<\/p>\n<p>appearance on all subsequent dates of hearing<\/p>\n<p>and as and when called upon to do so.<\/p>\n<p id=\"p_4\">         The bail application stands disposed of.<\/p>\n<p>         The order dated 2nd July, 2009, passed by<\/p>\n<p>Shri Yogesh Chandra Swami, RHJS, the Additional<\/p>\n<p>Sessions Judge, Sri Karanpur (Sri Ganganagar) in<\/p>\n<p>Miscellaneous Criminal Case No.92\/2009, mentions<\/p>\n<p>that after investigation a charge-sheet has been<\/p>\n<p>filed against           accused-petitioner             Jagseer Singh<\/p>\n<p>along-with       other        accused-persons.           The    learned<\/p>\n<p>counsel     for        petitioner           referred     a     copy    of<\/p>\n<p>charge-sheet which clearly establishes that the<\/p>\n<p>charge-sheet was submitted only against accused<\/p>\n<p>Chidiya @ Baldeo Singh and not against accused-<\/p>\n<p>petitioner       Jagseer       Singh;        he   also    referred      a<\/p>\n<p>certified copy of the order dated 9th February,<\/p>\n<p>2009     passed        by   the    same       Presiding        Officer,<\/p>\n<p>whereby     he     took       cognizance          against      accused-<\/p>\n<p>petitioner        on    the     application         filed       by    the<\/p>\n<p>prosecution under <a href=\"\/doc\/435819\/\" id=\"a_12\">Section 319<\/a> of the Cr.P.C. In<\/p>\n<p>these     circumstances,            it       is   clear      that     the<\/p>\n<p>Presiding Officer has not referred correct facts<\/p>\n<p>in the order, rather he mentioned false facts<\/p>\n<p>therein, which may mislead the higher court as<\/p>\n<p>the contents of the order are presumed to be<\/p>\n<p>correct; it further shows that the application<\/p>\n<p>has been decided without application of mind and<\/p>\n<p>in   a    cursory       and    negligent          manner.      However,<br \/>\n                              \/\/ 4 \/\/<\/p>\n<p>before       passing   any     order   for   departmental<\/p>\n<p>enquiry against the Presiding Officer, I think<\/p>\n<p>it fit and proper to call for his explanation in<\/p>\n<p>the matter.
