             Prayer in the present petition is for quashing of FIR No. 51 dated
\n5.8.2008, registered under Sections 326<\/a>, 325<\/a>, 323<\/a>, 324<\/a>, 148<\/a>, 149<\/a> IPC at Police
\nStation Attari, District Amritsar, on the statement of respondent no. 3 Sharanjit
\nSingh and further quashing of cross-version registered on the complaint of
\npetitioner no.7 Basant Singh under Sections 323<\/a>, 324<\/a>, 34<\/a> IPC and all subsequent
\nproceedings arising therefrom, on the basis of compromise.\n<\/p>\n
             Learned counsel for the petitioners submitted that the dispute
\nbetween the parties has been compromised with the intervention of the well-
\nwishers and keeping in view that peace and harmony is maintained in the village.
\nCompromise deed has also been placed on record as Annexure P-3. The petitioners
\nhave also placed on record the affidavit of Sharanjit Singh the complainant in the
\nFIR to the effect that both the parties have settled their dispute and have no grudge
\nagainst each other. He further submitted that since the matter has been
\ncompromised, the FIR as well as the cross-version deserve to be quashed. Reliance
\nhas been placed upon a five Judge Bench judgment of this Court in Kulwinder
\nSingh versus State of Punjab 2007 (3) Law Herald (P&H) 2225.\n<\/p>\n
             Petitioner no.7 and respondents no. 3 to 6 are present in person. They
\nhave admitted that both the parties have compromised the matter and have no
\nobjection in case the FIR as well as the cross-version got recorded by each other is
\nquashed.\n<\/p>\n
             Dealing with issue of quashing of FIR on the basis of compromise, a
\nBench consisting of five Hon’ble Judges of this Court in Kulwinder Singh’s case
\n             Criminal Misc. No. M-21253 of 2009                      (2)<\/p>\n
(supra) while approving minority view in Dharambir v. State of Haryana<\/a>, 2005
\n(2) Law Herald (P&H) (FB) 723, opined as under:-\n<\/p>\n
            “27.    To conclude, it can safely be said that there can never be any
\n                    hard and fast category which can be prescribed to enable the
\n                    Court to exercise its power under Section 482<\/a>, of the Cr.P.C<\/a>.
\n                    The only principle that can be laid down is the one which has
\n                    been incorporated in the Section itself, i.e., “to prevent abuse
\n                    of the process of any Court” or “to secure the ends of
\n                    justice”.\n<\/p><\/blockquote>\n
            28.     In Mrs. Shakuntala Sawhney Versus Mrs. Kaushalya
\n                    Sawhney and others, (1980) 1 S.C.C. 63, Hon’ble Krishna
\n                    Iyer, J. aptly summoned up the essence of compromise in the
\n                    following words:-\n<\/p><\/blockquote>\n
                    “The finest hour of justice arrives propitiously when parties,
\n                    despite falling apart, bury the hatchet and weave a sense of
\n                    fellowship of reunion.”\n<\/p><\/blockquote>\n
                    The power to do complete justice is the very essence of every
\n                    judicial justice dispensation system. It cannot be diluted by
\n                    distorted perceptions and is not a slave to anything, except to
\n                    the caution and circumspection, the standards of which the
\n                    Court sets before it, in exercise of such plenary and
\n                    unfettered power inherently vested in it while donning the
\n                    cloak of compassion to achieve the ends of justice.\n<\/p><\/blockquote>\n
            29.     No embargo, be in the shape of Section 320(9)<\/a> of the
\n                    Cr.P.C., or any other such curtailment, can whittle down the
\n                    power under Section 482<\/a> of the Cr.P.C.\n<\/p><\/blockquote>\n
            30.     The compromise, in a modern society, is the sine qua non of
\n                    harmony and orderly behaviour. It is the soul of justice and if
\n                    the power under Section 482<\/a> of the Cr.P.C is used to enhance
\n                    such a compromise which, in turn, enhances the social amity
\n                    and reduces friction, then it truly is “finest hour of justice”.
\n                    Disputes which have their genesis in a matrimonial discord,
\n                    landlord- tenant matters, commercial transactions and other
\n                    such matters can safely be dealt with by the Court by
\n                    exercising its powers under Section 482<\/a> of the Cr.P.C in the
\n                    event of a compromise, but this is not to say that the power is
\n                    limited to such cases. There can never be any such rigid rule

                      to prescribe the exercise of such power, especially in the
\n                      absence of any premonitions to forecast and predict
\n                      eventualities which the cause of justice may throw up during
\n                      the course of a litigation.\n<\/p><\/blockquote>\n
             31.      The only inevitable conclusion from the above discussion is
\n                      that there is no statutory bar under the Cr.P.C<\/a> which can
\n                      affect the inherent power of this Court under Section 482<\/a>.
\n                      Further, the same cannot be limited to matrimonial cases
\n                      alone and the Court has the wide power to quash the
\n                      proceedings      even       in   non-compoundable     offences
\n                      notwithstanding the bar under Section 320<\/a> of the Cr.P.C., in
\n                      order to prevent the abuse of law and to secure the ends of
\n                      justice.\n<\/p><\/blockquote>\n
             32.      The power under Section 482<\/a> of the Cr.P.C is to be exercised
\n                      Ex-Debitia Justitia to prevent an abuse of process of Court.
\n                      There can neither be an exhaustive list nor the defined para-
\n                      meters to enable a High Court to invoke or exercise its
\n                      inherent powers. It will always depend upon the facts and
\n                      circumstances of each case. The power under Section 482<\/a> of
\n                      the Cr.P.C has no limits. However, the High Court will
\n                      exercise it sparingly and with utmost care and caution. The
\n                      exercise of power has to be with circumspection and
\n                      restraint. The Court is vital and an extra-ordinary effective
\n                      instrument to maintain and control social order. The Courts
\n                      play role of paramount importance in achieving peace,
\n                      harmony and ever-lasting congeniality in society. Resolution
\n                      of a dispute by way of a compromise between two warring
\n                      groups, therefore, should attract the immediate and prompt
\n                      attention of a Court which should endeavour to give full
\n                      effect to the same unless such compromise is abhorrent to
\n                      lawful composition of the society or would promote
\n                      savagery.”<\/p><\/blockquote>\n
             Compromise in modern society is the sine qua non of harmony and
\norderly behaviour. As observed by Krishna Iyer J., the finest hour of justice arrives
\npropitiously when parties despite falling apart, bury the hatchet and weave a sense
\nof fellowship of reunion. Inherent power of the Court under Section 482<\/a> Cr.P.C is
\nnot limited to matrimonial cases alone. The Court has wide powers to quash the
\n              Criminal Misc. No. M-21253 of 2009                      (4)<\/p>\n
proceedings even in non-compoundable offences in order to prevent abuse of
\nprocess of law and to secure ends of justice, notwithstanding bar under Section
\n320<\/a> Cr.P.C. Exercise of power in a given situation will depend on facts of each
\ncase. The duty of the Court is not only to decide a lis between the parties after a
\nprotracted litigation but it is a vital and extra-ordinary instrument to maintain and
\ncontrol social order. Resolution of dispute by way of compromise between two
\nwarring groups should be encouraged unless such compromise is abhorrent to
\nlawful composition of society or would promote savagery, as held in Kulwinder
\nSingh’s case (supra).\n<\/p>\n
             Keeping in view the enunciation of law as referred to above and
\napplying the same to the facts and circumstances of the present case, once the
\nmatter has been compromised between the parties, no useful purpose will be
\nserved by proceeding with the prosecution. Accordingly, FIR No. 51 dated
\n5.8.2008, registered under Sections 326<\/a>, 325<\/a>, 323<\/a>, 324<\/a>, 148<\/a>, 149<\/a> IPC at Police
\nStation Attari, District Amritsar, on the statement of respondent no. 3 Sharanjit
\nSingh and cross-version registered on the complaint of petitioner no.7 Basant
\nSingh under Sections 323<\/a>, 324<\/a>, 34<\/a> IPC and all subsequent proceedings arising
\ntherefrom are quashed.\n<\/p>\n
             The petition is disposed of accordingly.\n<\/p>\n
