{"id":252231,"date":"2008-11-03T00:00:00","date_gmt":"2008-11-02T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/dau-singh-vs-the-state-of-raj-ors-on-3-november-2008"},"modified":"2016-08-16T14:21:55","modified_gmt":"2016-08-16T08:51:55","slug":"dau-singh-vs-the-state-of-raj-ors-on-3-november-2008","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/dau-singh-vs-the-state-of-raj-ors-on-3-november-2008","title":{"rendered":"Dau Singh vs The State Of Raj. &amp; Ors on 3 November, 2008"},"content":{"rendered":"<div class=\"docsource_main\">Rajasthan High Court &#8211; Jodhpur<\/div>\n<div class=\"doc_title\">Dau Singh vs The State Of Raj. &amp; Ors on 3 November, 2008<\/div>\n<pre id=\"pre_1\">                                   1\n\n IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT\n                             JODHPUR\n\n                             ORDER\n\n                          Dau Singh\n                              Vs.\n                      State of Raj. &amp; Ors.\n\n        S.B.CIVIL WRIT PETITION NO.3285\/2008\n\n\n               Date of Order        ::    03\/11\/2008\n\n\n                             PRESENT\n\n\n            HON'BLE MR.JUSTICE H.R.PANWAR\n\n\nMr.Sanjay Mathur, for the petitioner.\nMr.Manoj Bohra for Mr.Rajesh Joshi, for the respondents.\n\n\nBY THE COURT:<\/pre>\n<p id=\"p_1\">            By the instant writ petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of<\/p>\n<p>the   Constitution   of   India,    the   petitioner-workman       has<\/p>\n<p>challenged the order Annexure-5 dated 12th July, 2007 to the<\/p>\n<p>extent declining to make a reference on the ground that the<\/p>\n<p>respondent-Institution has already been declared as relief<\/p>\n<p>undertaking and in view of the provision of Section 12(5) of<\/p>\n<p>the   Industrial   Dispute   Act,      1947   (for   short   &#8220;<a href=\"\/doc\/500379\/\" id=\"a_1\">ID   Act<\/a>&#8221;<\/p>\n<p>hereinafter), no reference can be made in respect of<\/p>\n<p>establishment which has been decarled as relief undertaking.<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   2<\/span><\/p>\n<p id=\"p_1\">            I have heard learned counsel for the parties.<\/p>\n<p>            Learned counsel for the petitioner submits that by<\/p>\n<p>order Anneuxre-2, the respondent-employer exempted for the<\/p>\n<p>requisite educational qualification for the appointment and by<\/p>\n<p>exempting requisite education qualification, the petitioner has<\/p>\n<p>been   appointed      w.e.f.   15.8.94,   however,   the    financial<\/p>\n<p>sanction was w.e.f. 1st April, 1995.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">            Learned counsel appearing for the respondent<\/p>\n<p>submits that the controversy involved in the instant writ<\/p>\n<p>petition stands concluded by this Court in a bunch of writ<\/p>\n<p>petition being S.B.Civil Writ Petition No.486\/2006; Manager,<\/p>\n<p>Spinning Unit Gangapur now known as Spinning and Ginning<\/p>\n<p>Mills Federation Vs. State of Rajasthan &amp; Ors. and 11 others,<\/p>\n<p>decided on 16th October, 2006 wherein this Court held that in<\/p>\n<p>respect   of   establishment\/industry        declared      as   relief<\/p>\n<p>undertaking, the provision of <a href=\"\/doc\/500379\/\" id=\"a_2\">ID Act<\/a> shall not be applicable,<\/p>\n<p>however, that shall be confined to the period for which the<\/p>\n<p>respondent Industry\/establishment has been declared as<\/p>\n<p>relief undertaking.\n<\/p>\n<p id=\"p_4\">            Learned counsel for the petitioner submits that by<\/p>\n<p>order Annexure-4 dated 17th May 2007, the respondent<\/p>\n<p>industry has been declared relief undertaking and that order<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    3<\/span><\/p>\n<p>came to be extended for further one year by order dated 22nd<\/p>\n<p>September, 2008 and according to learned counsel for the<\/p>\n<p>respondents,     the   respondent-State        was     justified   in    not<\/p>\n<p>making the reference for adjudication of industrial dispute.<\/p>\n<p id=\"p_5\">               From the perusal of the order Annexure-4 dated<\/p>\n<p>17th May, 2007, it is clear that the respondent-Rajasthan<\/p>\n<p>State Cooperation Spinning and Ginning Mills Federation<\/p>\n<p>(Spinfed), Jaipur has been declared relief undertaking and the<\/p>\n<p>period   for    such   declaration      has    been    extended         from<\/p>\n<p>12.10.2008 to 11.10.2009 vide order dated 22nd September,<\/p>\n<p>2008 and this Court elaborately considered the question of<\/p>\n<p>legislative    competence    and       the    period   for   which       the<\/p>\n<p>respondent-employer has been declared relief undertaking.<\/p>\n<p>This Court has held as under:-\n<\/p>\n<p id=\"p_6\">\n<blockquote id=\"blockquote_1\"><p>          &#8220;The State Government by issuing notification<br \/>\n          under <a href=\"\/doc\/452505\/\" id=\"a_3\">Section 3<\/a> does not permanently debar the<br \/>\n          legal proceedings under the provisions of the<br \/>\n          <a href=\"\/doc\/500379\/\" id=\"a_4\">Industrial Disputes Act<\/a>, 1947. Suspension of such<br \/>\n          legal proceedings is only co-terminus with the<br \/>\n          time till the concerned industry remains a relief<br \/>\n          undertaking. This does not therefore take away a<br \/>\n          remedy available to a workman permanently.<br \/>\n          Movement the industry seize to be a relief<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                  4<\/span><\/p>\n<p>         undertaking,   proceedings       before   the     learned<br \/>\n         labour court or the industrial tribunal, as the case<br \/>\n         may    be,   under     the   provisions   of    <a href=\"\/doc\/500379\/\" id=\"a_5\">Industrial<br \/>\n         Disputes Act<\/a> would stand revived. In a situation<br \/>\n         like this, endeavor of the courts should be to<br \/>\n         apply the principle of harmonious interpretation to<br \/>\n         make    both   the     enactments    workable.      Since<br \/>\n         legislative compliance for enacting both the Acts<br \/>\n         in pith and substance emanate from demarcated<br \/>\n         area of legislative power referable to separate<br \/>\n         entries though i the same concurrent list, there<br \/>\n         does not arise any question of conflict between<br \/>\n         the two, let alone any repugnancy. As held by<br \/>\n         their Lordships of the Hon&#8217;ble Supreme Court in<br \/>\n         ITC Ltd. (supra) a duty is cast on the courts to<br \/>\n         harmoniously construe two enactments and the<br \/>\n         provisions contained therein and therefore, it<br \/>\n         cannot be accepted that the proceedings before<br \/>\n         the labour court could be continued even when<br \/>\n         the industry concerned has been declared as a<br \/>\n         relief undertaking.&#8221;<\/p><\/blockquote>\n<p id=\"p_7\">\n<p id=\"p_8\">           Keeping in view the decision of this Court in the<\/p>\n<p>bunch of writ petitions referred hereinabove, in my view, the<\/p>\n<p>respondents were justified in passing the order Annexure-5<\/p>\n<p>Dated 12th July,2007.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                    5<\/span><\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                In this view of the matter, I do not find any merit<\/p>\n<p>     in the writ petition and the same is dismissed.
