MUKHERJEE. J.\n<\/p>\n<p id=\"p_1\">     Om Parkash @ Neelu, his two sons Satpal @ Sattu and Bir<br \/>\nBhan, and  Gulzar Singh\t were arraigned\t before the Sessions<br \/>\nJudge, Bhatinda\t for the  murder of  Janta Singh.  The trial<br \/>\nended in an acquittal of Sat Pal and conviction of the other<br \/>\nthree under  section 302  read with <a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> I.P.C. with a<br \/>\nsentence of  imprisonment for  life and a fine of Rs.1,000\/-<br \/>\neach. While  the three\tconvicts filed appeals against their<br \/>\nconvictions, the State of Punjab filed an appeal against the<br \/>\nacquittal of  Sat Pal,\tand Bant  Singh, the  brother of the<br \/>\ndeceased, filed a revision petition seeking compensation. In<br \/>\ndisposing of  the appeals  and the  revision petition  by  a<br \/>\ncommon judgment\t the High  Court affirmed the conviction and<br \/>\nsentence recorded by the trial Court, reversed the acquittal<br \/>\nof Sat\tPal by convicting and sentencing him to imprisonment<br \/>\nfor life  and a\t fine of  Rs. 1,000\/-  under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Section  302<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a><br \/>\nI.P.C. and  directed that the fine if realised shall be paid<br \/>\nto the\theirs of  Janta Singh.\tHence these  appeals at\t the<br \/>\ninstance of the four convicts.\n<\/p>\n<p id=\"p_2\">     The prosecution  case is that on December 5, 1981 at or<br \/>\nabout 11.45 A.M. Janta Singh (the deceased) was going to his<br \/>\nouter house followed by his brothers Bant Singh and Mukhtiar<br \/>\nSingh to  guard their  cattle. When  they had almost reached<br \/>\nBahamanwali Gali (lane) in their village the four appellants<br \/>\nsuddenly  emerged   from  that\tqali  armed  with  different<br \/>\nweapons. Om  Parkash had  a dang,  Sat Pal a kulhari and Bir<br \/>\nBhan and  Gulzar Singh had a gandasa each. Om Parkash raised<br \/>\na lalkara  exhorting his  companions that Janta Singh should<br \/>\nnot be allowed to escape. Immediately thereupon Bir Bhan and<br \/>\nGulzar Singh  gave successive  gandasa blows  on the head of<br \/>\nJanta Singh  as a result of which he fell down. While he was<br \/>\nlying on  the ground  both Sat Pal and Om Parkash gave blows<br \/>\non his\tneck with  their respective weapons. On alarms being<br \/>\nraised by  Bant Singh and Mukhtiar Singh they fled away from<br \/>\nthe spot  along with  their respective\tweapons. Janta Singh<br \/>\nhad in\tthe meantime  died at  the spot. The motive ascribed<br \/>\nfor the\t murderous assault  was that a few days prior to the<br \/>\nincident Om  Parkash had been arrested for having been found<br \/>\nin  possession\tof  opium  and\tintoxicating  drugs  and  he<br \/>\nsuspected that\tit was Janta Singh who had given information<br \/>\nto the police.\n<\/p>\n<p id=\"p_3\">     It is the further prosecution case that Bant Singh then<br \/>\nwent and informed Zoravar Singh and Jang Singh, the Sarpanch<br \/>\nand  Chowkidar\t of  the   village  respectively  about\t the<br \/>\nincident. On  receiving the  information, Jang Singh went to<br \/>\nguard the dead body of Janta Singh along with Mukhtiar Singh<br \/>\nwhile Bant  Singh  accompanied\tby  Zoravar  Singh  went  to<br \/>\nBudhlada Police\t Station to lodge an information. ASI Gurmit<br \/>\nSingh recorded\tthe statement of Bant Singh and registered a<br \/>\ncase. After  making arraignment\t to send a special report to<br \/>\nthe local  Judicial Magistrate, ASI Gurmit Singh went to the<br \/>\nspot accompanied  by Bant  Singh and  Zoravar Singh. He held<br \/>\ninquest upon  the dead\tbody of Janta Singh and forwarded it<br \/>\nfor post-mortem\t examination. He prepared a rough site plan,<br \/>\nseized some  blood stained  earth from\tnear  the  spot\t and<br \/>\nrecorded the statements of Zoravar Singh, Mukhtiar Singh and<br \/>\nJang Singh.  In course\tof  investigation  he  arrested\t the<br \/>\nappellants and\tpursuant to their statements discovered some<br \/>\nlathis,\t  kulharis    and   gandasas.\tOn   completion\t  of<br \/>\ninvestigation he  submitted a  charge-sheet against the four<br \/>\nappellants.\n<\/p>\n<p id=\"p_4\">     The  appellants  pleaded  not  guilty  to\tthe  charges<br \/>\nlevelled against  them and  tendered written  statements  in<br \/>\nsupport\t of   their  claim   that  they\t  had  been  falsely<br \/>\nimplicated.\n<\/p>\n<p id=\"p_5\">     Though the\t prosecution  examined\tas  many  as  eleven<br \/>\nwitnesses including  Zoravar Singh  (PW 7)  and\t ASI  Gurmit<br \/>\nSingh (PW  11)\tto  prove  its\tcase  its  success  depended<br \/>\nprimarily upon\tthe acceptance\tof the ocular version of the<br \/>\nincident as  given out\tby Bant\t Singh (P.W. 2) and Mukhtiar<br \/>\nSingh (P.W.  6) and of Dr. A.K. Garg (P.W. 1), who held post<br \/>\nmortem examination on the dead body of Janta Singh and found<br \/>\nthe following injures on his person:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     1.\t   Incised  wound 2&#8243;  x 0.3&#8243;  on the  head<br \/>\n     just  right   to  the   mid  line,\t 6&#8243;  above<br \/>\n     occipital protuberance, placed vertically.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     2. One  incised wound  1&#8243; x  1\/3&#8243; present\ton<br \/>\n     head, 2. 1\/2&#8243; to the left of injury No.1.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     3. Abrasion 1\/2&#8243; x 1\/2&#8243; on the medial side of<br \/>\n     right elbow.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     4. One abrasion 1&#8243; x 1\/2&#8243; behind left elbow.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     5. Abrasion  1\/2&#8243; x 1\/2&#8243; on the other side of<br \/>\n     left elbow.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>     6. Abrasion  1\/2&#8243; x 1\/2&#8243; on the poster medial<br \/>\n     side of left elbow.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>     7. One  bluish bruise  4&#8243; x  1&#8243; on\t the right<br \/>\n     side of  chest 3&#8243;\tfrom midline, against 2nd,<br \/>\n     3rd and 4th ribs.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>     8. One  bruise of\tbluish colour  6&#8243; x 3.1\/2&#8243;<br \/>\n     against left  clavicle 2nd\t &amp; 3rd ribs in the<br \/>\n     shape like.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>     9. One  bruise 4.1\/2&#8243; x 1\/4&#8243; was transfersely<br \/>\n     placed on\tthe neck  between  lower  jaw  and<br \/>\n     thyroid protuberance.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>     10.  One\tbruise\t4&#8243;  x  1\/4&#8243;  on\t the  neck<br \/>\n     obliquelly\t to  right  side  against  thyroid<br \/>\n     cartilage.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>     11. One  bruise 1\/2&#8242; x 1\/4&#8243; on the right side<br \/>\n     of the neck.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">     The trial\tCourt found that the evidence of P.Ws. 2 and<br \/>\n6 could\t be  safely  relied  upon  to  sustain\tthe  charges<br \/>\nlevelled against  the appellants  Om Parkash,  Bir Bhan\t and<br \/>\nGulzar Singh,  more so,\t as it was corroborated by the first<br \/>\ninformation report  which was  promptly lodge  by P.W. 2 and<br \/>\nthe injuries  found by P.W. 1 on the person of the deceased.<br \/>\nIn acquitting the other appellant, namely, Sat Pal the trial<br \/>\nCourt recorded the following finding:\n<\/p>\n<blockquote id=\"blockquote_11\"><p>     &#8220;After Janta  Singh had fallen on the ground,<br \/>\n     Sat Pal  accused gave  two kulhari blows, one<br \/>\n     on the neck and the other on the left side of<br \/>\n     the  chest\t  of  the  deceased.  The  medical<br \/>\n     evidence on the record shows that injuries on<br \/>\n     the neck  and on  the chest  are not  incised<br \/>\n     injuries. Faced  with this\t situation the two<br \/>\n     eye-witnesses  in\tthe  instant  the  changed<br \/>\n     their stance  and instant\tcase changed their<br \/>\n     stance and\t tried to  explain  said  injuries<br \/>\n     that the  first kulhari  blow, was given from<br \/>\n     upard-downward while  holding the\thandle\tof<br \/>\n     the kulhari  and the  second blow\twas  given<br \/>\n     from  flat\t  portion  of  the  blade  of  the<br \/>\n     kulhari.  This   aspect  of   the\t case\tis<br \/>\n     conspicuous by its absence from  the earliest<br \/>\n     version given by the two eye-witnesses before<br \/>\n     the police,  before the  post mortem had been<br \/>\n     conducted. In  these circumstances,  it  will<br \/>\n     not be safe to place imllicit reliance on the<br \/>\n     testimony of  Bant Singh Mukhtiar Singh P.Ws.<br \/>\n     as far as the infliction of the aforesaid two<br \/>\n     injuries attributed  to Sat  Pal accused,\tis<br \/>\n     concerned.&#8221;<\/p><\/blockquote>\n<p id=\"p_7\">     The High Court concurred with all the findings recorded<br \/>\nby the\ttrial Court  for convicting the three appellants and<br \/>\nin reversing  the acquittal  of Sat  Pal the  High Court had<br \/>\nthis to say:\n<\/p>\n<blockquote id=\"blockquote_12\"><p>     &#8220;So  far as  Sat Pal  is concerned, according<br \/>\n     to\t the  prosecution  when\t Janta\tSingh  had<br \/>\n     fallen on the ground Sat Pal gave two kulhari<br \/>\n     blows, one\t on the\t neck and the other on the<br \/>\n     left side\tof  the\t chest\tof  the\t deceased.<br \/>\n     According\tto   the  medical   evidence,  the<br \/>\n     injuries on the nect and in the chest are not<br \/>\n     incised   injuries\t   and\t the   prosecution<br \/>\n     witnesses have  explained this that the first<br \/>\n     kulhari blow  was give  from  upward-downward<br \/>\n     while holding  the hendle\tof the kulhari and<br \/>\n     the second\t blow was  given from flat portion<br \/>\n     of the  blade of  the kulhari.  although this<br \/>\n     aspect of\tthe case  is not  in the  earliest<br \/>\n     version,  but   the   minutest   photographic<br \/>\n     details cannot be expected to be given by the<br \/>\n     eye-witnesses.  The   learned   trial   court<br \/>\n     acquitted Sat  Pal respondent  on this ground<br \/>\n     that these\t injuries were\tnot explained\tat<br \/>\n     the  earliest   were  not\texplained  at  the<br \/>\n     earliest  version\t and  go  counter  to  the<br \/>\n     medical evidence.\tIn all\t11  injuries  were<br \/>\n     caused and\t out of them for were abrasions on<br \/>\n     the elbows. It may be that the said abrasions<br \/>\n     were caused  as a\tresult of fall and not due<br \/>\n     to direct\tblows. the  appellants and Sat Pal<br \/>\n     respondent\t  inflicted    blows   in    quick<br \/>\n     succession and  it was  not possible  for the<br \/>\n     eye-witnesses to  give an\texact account,\tas<br \/>\n     observed earlier.\tThus, we  are of  the view<br \/>\n     that  the\t acquittal  of\tSat  Pal  was  not<br \/>\n     justified by  the learned trial Court on this<br \/>\n     ground.&#8221;<\/p><\/blockquote>\n<p id=\"p_8\">     Mr. Sushil Kumar  the learned counsel appearing for the<br \/>\nappellants took\t us through  the evidence of the prosecution<br \/>\nwitnesses to  contend that  the High  Court was\t not  a\t all<br \/>\njustified in setting aside the order of acquittal or Sat Pal<br \/>\nas  the\t findings  recorded  by\t the  trial  Court  for\t his<br \/>\nacquittal could not be said to be perverse.\n<\/p>\n<p id=\"p_9\">     Having considered\tthe impugned  judgments in the light<br \/>\nof the\tevidence on record we are in complete agreement with<br \/>\nthe High Court that the trial Court was not at all justified<br \/>\nin recording  the acquittal  of Sat  Pal on the basis of the<br \/>\nfindings quoted\t earlier. In  the F.I.R.  that was lodged by<br \/>\nBant Singh within two hours of the incident he categorically<br \/>\nsated that while Janta Singh was lying on the ground Sat Pal<br \/>\ngave axe  blows on  his neck as also on the left side of his<br \/>\nchest. In  course of  the trial also Bant Singh stuck to his<br \/>\nabove version and gave further details regarding the mode of<br \/>\nuser of\t the axe.  It was not expected of Bant Singh nor was<br \/>\nit necessary  to give  minute details  in  the\tF.I.R..\t The<br \/>\nfinding of  the trial  Court as earlier quoted, for brushing<br \/>\naside the  evidence of\tP.W.  2\t as  against  Sat  Pal\tmust<br \/>\ntherefore be  held to  be perverse. For the self same reason<br \/>\nthe finding  of the  trial Court for discarding the evidence<br \/>\nof P.W.\t 6, in\tview of his omission to detail the manner of<br \/>\nuser of\t the axe  by Sat Pal in his statement recorded under<br \/>\n<a href=\"\/doc\/447673\/\" id=\"a_3\">Section 161<\/a>  Cr. P.C.  cannot be  sustained for it was not a<br \/>\nmaterial  omission   amounting\tto   contradiction.   Having<br \/>\ncarefully gone\tthrough the  evidence of Bant Singh (P.W. 2)<br \/>\nand Mukhtiar  Singh (P.W.  6) we  are satisfied\t that  their<br \/>\nevidence as  against Sat  Pal is  also cogent and consistent<br \/>\nand the\t High Court  was fully justified in relying upon the<br \/>\nsame. So  far as  the other  three appellants  are concerned<br \/>\nboth the  learned courts  below, who were entrusted with the<br \/>\nduty of\t investigating into  questions of  fact have,  on  a<br \/>\nproper discussion  and appraisal  of the  evidence, recorded<br \/>\ntheir findings against them and sitting in this jurisdiction<br \/>\nunder <a href=\"\/doc\/427855\/\" id=\"a_4\">Article  136<\/a> of  the Constitution\t of India  we do not<br \/>\nfind any reason to interfere with the same.\n<\/p>\n<p id=\"p_10\">     It was  sought to be argued on behalf of the appellants<br \/>\nthat the  learned Courts  below failed\tto notice  that\t the<br \/>\nprosecution signally failed to prove the motive ascribed for<br \/>\nthe alleged  murder, thereby  making its case suspect. Since<br \/>\nboth the  learned Courts below found the evidence of the eye<br \/>\nwitnesses regarding the actual murder acceptable, the motive<br \/>\nand   for   that   matter   proof   therefor,\tpaled\tinto<br \/>\ninsignificance..\n<\/p>\n<p id=\"p_11\">     On the  conclusions as  above we dismiss the appeal and<br \/>\ndirect the  appellants, who are on bail, to their respective<br \/>\nbail bonds to serve out the sentence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sat Pal &amp; Ors vs State Of Punjab on 20 October, 1995 Equivalent citations: 1995 SCC, Supl.
