Justice R.BASANT\n\n Dated :05\/02\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                                 ----------------------\n\n                              Crl.M.C.No.273 of 2007\n\n                           ----------------------------------------\n\n                   Dated this the 5th day of February  2007\n\n\n\n\n                                      O R D E R\n<\/pre>\n<p id=\"p_1\">          The   petitioner   is   the   fifth   accused   in   a   prosecution   under<\/p>\n<p>Section   420 read with 34 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>.   Cognizance has been taken on<\/p>\n<p>the basis of a final report submitted by the police.  The case has<\/p>\n<p>been   pending   from   2004.     The   petitioner   has   not   appeared<\/p>\n<p>before the learned Magistrate and consequently he finds himself<\/p>\n<p>in  the   unenviable  predicament  of  a   warrant   of  arrest   issued   by<\/p>\n<p>the learned  Magistrate chasing  him.    The  petitioner  now wants<\/p>\n<p>to surrender before the learned Magistrate.  The learned counsel<\/p>\n<p>for the petitioner submits that the petitioner apprehends that his<\/p>\n<p>application   for   bail   may   not   be   considered   on   merits,   in<\/p>\n<p>accordance   with   law   and   expeditiously   by   the   learned<\/p>\n<p>Magistrate.     He,   therefore,   prays   that   the   directions   under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C. may be issued to the learned Magistrate to<\/p>\n<p>release   the   petitioner   on   bail   when   he   appears   and   applies   for<\/p>\n<p>bail.\n<\/p>\n<p id=\"p_1\">          2.    It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate,   the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.237\/07                       2<\/span><\/p>\n<p>circumstances   under   which   he   could   not   earlier   appear   before<\/p>\n<p>the learned Magistrate.\n<\/p>\n<p id=\"p_2\">       3.    I find absolutely no reason to assume that the learned<\/p>\n<p>Magistrate wound not consider the application for bail to be filed<\/p>\n<p>by   the   petitioner   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously.     Every   court   must   do   the   same.     No   special   or<\/p>\n<p>specific   directions   appear   to   be   necessary.     Sufficient   general<\/p>\n<p>directions   have   been   issued   in  Alice   George   vs.   Deputy<\/p>\n<p>Superintendent of Police [2003(1)KLT 339].\n<\/p>\n<p id=\"p_3\">       4.
