Government Pleader\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tThe petitioner is carrying on the business of Jewellary, under the<br \/>\nprovision of the Tamil Nadu Luxury Tax Act 1981.  The petitioner filed return<br \/>\nfor the turnover, as the goods were included to be taxable under the Act.\n<\/p>\n<p id=\"p_1\">\t2.The petitioner challenged the Constitutional validity of the Tamil Nadu<br \/>\nLuxury Tax Act, 1981, as goods could not be a luxury for the imposition of tax.<br \/>\nThe Hon&#8217;ble Supreme Court, in the case of <a href=\"\/doc\/443222\/\" id=\"a_2\">M\/s.Godfrey Philips India Ltd., vs,<br \/>\nState of U.P<\/a>. [(2005)2 SCC 515], has been pleased to lay down, that no luxury<br \/>\ntax can be imposed on the goods.\n<\/p>\n<p id=\"p_2\">\t3.This court, in the case of Tvl.M.S.P.Sethuraman &amp; Co., represented by<br \/>\nits <a href=\"\/doc\/782458\/\" id=\"a_3\">Partner vs. The State of Tamil Nadu<\/a>, rep. by Secretary to Government,<br \/>\nDepartment of Commercial Taxes &amp; Religious Endowments,Fort St. George, Chennai-<br \/>\n600 009 in W.P.(MD)No.1789 of 2007 and connected cases, decided on 01.12.2009,<br \/>\nwas pleased to lay down as under:-\n<\/p>\n<p id=\"p_3\">\t&#8220;6.A perusal of the order would go to show that the scope of the order of<br \/>\nthe Hon&#8217;ble Supreme Court striking down the <a href=\"\/doc\/1210757\/\" id=\"a_4\">Amendment Act<\/a> has not been fully<br \/>\nunderstood.  When once the <a href=\"\/doc\/1210757\/\" id=\"a_5\">Amendment Act<\/a> is struck down by the Supreme Court, it<br \/>\nshould be property understood to mean that the amendment was never, in force in<br \/>\nthe Statute Book.  But, under the wrong impression, these impugned orders have<br \/>\nbeen passed as though the amendment was in force was for a particular period<br \/>\nviz., between 1.7.2002 and 28.12.2004. For these reasons, I am of the considered<br \/>\nopinion that the impugned orders are  liable to be set aside.&#8221;\n<\/p>\n<p id=\"p_4\">\t4.The case of the petitioner is squarely covered by the judgment of this<br \/>\ncourt referred to above.\n<\/p>\n<p id=\"p_5\">\t5.Consequently, the writ petition is allowed. The assessment order,<br \/>\nimposing luxury tax for the period in dispute is ordered to be quashed.
