Mr.Pala.Ramasamy\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tHeard the learned counsel for the petitioner and  the learned counsel for<br \/>\nthe respondent.\n<\/p>\n<p id=\"p_1\">\t2.Admittedly, the proceedings under Section 13 of the Securitisation and<br \/>\nReconstruction of Financial Assets and <a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Interest Act<\/a>,<br \/>\n2002, (hereinafter referred to as &#8216;the Act&#8217;) has been initiated against the<br \/>\npetitioner and has already moved the Debts Recovery Tribunal and as submitted by<br \/>\nthe learned counsel for the petitioner, the tribunal after hearing the parties<br \/>\nhas also reserved orders. In the meantime, the petitioner anticipated that the<br \/>\nrespondent is likely to take physical possession of the property without waiting<br \/>\nfor the order of the Tribunal.  Such prayer cannot be actually granted at this<br \/>\nstage. When once the tribunal under the Act is seized of the matter, it is not<br \/>\nfor this Court to give any direction. Needless to state that when the matter is<br \/>\npending before the Debts Recovery Tribunal, the respondent cannot certainly take<br \/>\nsuch forceful possession except by following the procedure which is contemplated<br \/>\nunder <a href=\"\/doc\/198257891\/\" id=\"a_2\">Section 14<\/a> of the Act, which is as follows:\n<\/p>\n<p id=\"p_2\">\t14. Chief Metropolitan Magistrate or District Magistrate to assist secured<br \/>\ncreditor in taking possession of secured asset.-(1) Where the possession of any<br \/>\nsecured asset is required to be taken by the secured creditor or if any of the<br \/>\nsecured asset is required to be sold or transferred by the secured creditor<br \/>\nunder the provisions of this Act, the secured creditor may, for the purpose of<br \/>\ntaking possession or control of any such secured asset, request, in writing, the<br \/>\nChief Metropolitan Magistrate or the District Magistrate within whose<br \/>\njurisdiction any such secured asset or other documents relating thereto may be<br \/>\nsituated or found, to take possession thereof, and the Chief Metropolitan<br \/>\nMagistrate or, as the case may be, the District Magistrate shall, on such<br \/>\nrequest being made to him-\n<\/p>\n<p id=\"p_3\">\t\t(a) take possession of such asset and documents relating thereto;<br \/>\nand\n<\/p>\n<p id=\"p_4\">\t\t(b) forward such asset and documents to the secured creditor.<br \/>\n\t(2) For the purpose of securing compliance with the provisions of sub-<br \/>\nsection (1), the Chief Metropolitan Magistrate or the District Magistrate may<br \/>\ntake or cause to be taken such steps and use, or cause to be used, such force,<br \/>\nas may, in his opinion, be necessary.\n<\/p>\n<p id=\"p_5\">\t(3) No act of the Chief Metropolitan Magistrate or the District Magistrate<br \/>\ndone in pursuance of this section shall be called in question in any Court or<br \/>\nbefore any authority<\/p>\n<p id=\"p_6\">\t3.In such view of the matter, except making the above said observation,<br \/>\nthere is no further relief granted. The writ petition stands closed accordingly.<br \/>\nNo costs.
