Ananda Sen\n            For the Respondents: Mr. R.R.Mishra, G.P.II\n\n\n5.   15 .4.09            This writ application has been filed for quashing the\n\n            entire criminal prosecution including the order dated 14.7.2008\n\n            passed in Complaint case bearing C\/1 case no.11 of 2006 whereby\n\n            cognizance of the offence under <a href=\"\/doc\/1914151\/\" id=\"a_1\">section 33<\/a> of the Indian Forest Act\n\n            and also under <a href=\"\/doc\/1642441\/\" id=\"a_1\">section 2<\/a> of the Forest Conservation Act has been\n\n            taken against the petitioner.\n\n                  The case of the prosecution is that one Rajendra Sharma, a\n\n            Forest Guard while was patrolling along with another Forest Guard\n\n            Anthrons Soreng in Gurdari Forest, he saw accused Md. Kasim\n\n            Ansari along with other labourers extracting Bauxite by digging\n\n            earth of the forest area but they on being chased, succeeded in\n\n            taking to their heels. When they returned at the site, they found 5\n\n            tonnes of Bauxite lying there and it was suspected that at the\n\n            instance of some persons of M\/s Hindalco Industries Limited, Md.\n\n            Kasim Ansari has committed that offence and, accordingly, offence\n\n            report dated 21.6.2006 was sent before the Chief Judicial\n\n            Magistrate, Gumla . On submission of the said offence report\n\n            before the Divisional Forest Officer, (West Lohardaga), Ranchi\n\n            Forest Division, the matter was enquired into by Forester, Netarhat\n\n            and in course of enquiry from the villagers, it came to now that\n\n            said Md. Kasim Ansari at the instance of the petitioner(Manager\n\n            Gurdari Mines) gets Bauxite extracted from the forest area and\n                            2\n\n\naccordingly, prosecution report was submitted on 14.7.2008 and on\n\nthat day cognizance of the offence as stated above was taken\n\nagainst the petitioner.\n\n       Being aggrieved with that order, this writ application has\n\nbeen filed for quashing the entire criminal proceeding including the\n\norder taking cognizance.\n\n       Learned counsel appearing for the petitioner submits that as\n\nper the offence report dated 21.6.2006 one Md. Kasim Ansari was\n\nseen taking out Bauxite along with other labourers from the forest\n\narea and without there being any reason, it was suspected that he\n\ncommitted that mischief at the instance of some persons of M\/s.\n\nHindulco Industries Limited and when the matter was enquired into\n\nby Forester, he from the villagers came to know that it was the\n\npetitioner at whose instance said Md. Kasim Ansari used to get\n\nBauxite extracted from the forest area but the name of the villagers\n\nhad not been mentioned, still cognizance of the offence was taken\n\nagainst the petitioner which is quite bad as prosecution report as\n\nwell as offence report is quite vague, so far indulgence of the\n\npetitioner in the alleged offence is concerned.          On the said\n\nprosecution report, the prosecution cannot secure conviction even\n\nif the entire allegation made in the prosecution report remains\n\nuncontroverted and hence, the entire criminal prosecution is fit to\n\nbe set aside.\n\n       A counter affidavit has been filed wherein it has been stated\n\nthat Forester had submitted prosecution report when he, in course\n\nof investigation, did find the involvement of the petitioner in illegal\n\nmining.   Under this situation, it was submitted on behalf of the\n\nState that when the prosecution report does disclose about the\n\ncommission of the cognizable offence, it cannot be quashed on its\n\nthreshold and hence, the impugned order needs no interference.\n                             3\n\n\n      Having heard learned counsel appearing for the parties and\n\non perusal of the record it does appear that the prosecution report\n\nseems to have been submitted after holding enquiry on the\n\nallegation made in the offence report but surprisingly, name of the\n\nvillagers, who allegedly disclosed about the involvement of the\n\npetitioner, has not been mentioned either in the body of the\n\nprosecution report or in the witness column, rather in the witness\n\ncolumn name of only three persons,          the informant, a Forest\n\nGuard, another Forest Guard, who had accompanied the informant\n\nto forest at the time of alleged offence and the Forester are there,\n\nwho seems to have derived their knowledge about the involvement\n\nof the petitioner in the alleged offence by the villagers whose\n\nnames have not been disclosed.\n\n      In that view of the matter, whatever material has been\n\ncollected by the prosecution to prosecute the petitioner that does\n\nnot appear to be legal. Consequently, the entire prosecution case is\n\nliable to be quashed in view of the ratio laid down by the Hon'ble\n\nSupreme Court in a case of <a href=\"\/doc\/1033301\/\" id=\"a_2\">R.P.Kapur vs. State of Punjab<\/a> (AIR\n\n1960 SC 866) holding therein that High Court in exercise of its\n\ninherent power can quash the proceedings in cases of following\n\ncategories:\n\n              (i)     where it manifestly appears that there is a\n                      legal bar against the institution or continuance\n                      e.g. want of sanction;\n              (ii)    where the allegations in the first information\n                      report or complaint taken at its face value and\n                      accepted in their entirely do not constitute the\n                      offence alleged;\n              (iii)   where the allegations constitute an offence,\n                      but there is no legal evidence adduced or the\n                      evidence adduced clearly or manifestly fails to\n                      prove the charge.\n\n      For the reason discussed above, this case certainly falls\n\nwithin the third category as the materials upon which the\n\nprosecution is embarking to prosecute the petitioner is not legal.\n                                   4\n\n\n      Under this situation, it would be highly improper to allow the\n\n      petitioner to suffer rigor of the trial as there would be virtually no\n\n      chances of securing conviction of the petitioner even if the entire\n\n      material collected remains uncontroverted.\n\n             Accordingly, the entire prosecution of Complaint case\n\n      bearing C\/1 case no.11 of 2006 including the order dated\n\n      14.7.2006<\/pre>\n<p id=\"p_1\"> passed by the Sub-divisional Judicial Magistrate, Gumla<\/p>\n<p>      is hereby quashed so far petitioner is concerned.<\/p>\n<p id=\"p_1\">             In the result, this application is allowed.<\/p>\n<p id=\"p_2\">                                                           (R.R.Prasad, J.)<br \/>\nND\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Prasanna Kumar Mahapatra @ &#8230; vs State Of Jharkhand &amp; Ors. on 15 April, 2009 In the High Court of Jharkhand at Ranchi W.P.(Cr.)
