DENESAN, J.\n\n\n\n                = = = = = = = = = = = = = = =\n\n                  W.P.(C) No. 30753 OF 2006 J\n\n                = = = = = = = = = = = = = = =\n\n\n\n              Dated this the 27th November, 2006\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner is a Sub Inspector of Police in the<\/p>\n<p>General Executive Wing of the Police Department.  While<\/p>\n<p>working   as   Sub   Inspector   in   the     Kochi   City   Police<\/p>\n<p>Control   Room,   he   was   served   with   Ext.   P1   memo   of<\/p>\n<p>charges   with   the   statement   of   allegations   stating   that<\/p>\n<p>he   gave   incorrect   information   about   the   receipt   of<\/p>\n<p>orders   which   directed   him   to   remit   Rs.2190.40   in   the<\/p>\n<p>treasury   and   thereby   misled   the   higher   authorities.\n<\/p>\n<p id=\"p_1\">The   disciplinary   authority   ordered   non-oral   enquiry<\/p>\n<p>into   the   charges   and   appointed   an   enquiry   officer   to<\/p>\n<p>look into the materials and drew up the enquiry report.\n<\/p>\n<p id=\"p_2\">On   the   basis   of   the   enquiry   report   holding   that   the<\/p>\n<p>petitioner was guilty of the charges, the 3rd respondent<\/p>\n<p>passed   Ext.   P2   order   imposing   on   the   petitioner   the<\/p>\n<p>penalty of withholding one increment without cumulative<\/p>\n<p>effect.     The   statutory   appeal   filed   by   the   petitioner<\/p>\n<p>before   the   2nd  respondent   was   dismissed   as   per   Ext.   P4<\/p>\n<p>order.     The   petitioner   preferred   a   review   petition<\/p>\n<p>before   the   Government.     As   per   Ext.   P6   the   review<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.30753 \/2006                 -2-<\/span><\/p>\n<p>petition   was   rejected.          Thereafter,   the   petitioner<\/p>\n<p>filed a mercy petition but that also was rejected vide<\/p>\n<p>Ext.   P7   passed   on   11-7-2006.     Feeling   aggrieved,   this<\/p>\n<p>writ   petition  has  been  filed  challenging  Exts.  P2,  P4,<\/p>\n<p>P6 and P7.\n<\/p>\n<p id=\"p_3\">     2.   It   is   contended   that   the   impugned   orders   are<\/p>\n<p>unsustainable   mainly   on   the   ground   that   the   petitioner<\/p>\n<p>was   not   afforded   reasonable   opportunity   to   defend   the<\/p>\n<p>charges.        According   to   him,   he   had   submitted   an<\/p>\n<p>application   for   permission   to   take   extracts   from   the<\/p>\n<p>relevant   records;     but   before   allowing   that   request<\/p>\n<p>Ext.   P2   order   was   passed   finding   him   guilty   of   the<\/p>\n<p>charges.\n<\/p>\n<p id=\"p_4\">     3. On going through the impugned orders it is seen<\/p>\n<p>that   the   above   contention   of   the   petitioner   is   devoid<\/p>\n<p>of   merit.    The  petitioner  was  specifically  informed  as<\/p>\n<p>per Ext. P1 that he should submit his written statement<\/p>\n<p>of   defence   within   15   days   from   the   date   of   receipt   of<\/p>\n<p>the   charge   memo.     But   the   petitioner   did   not   file   his<\/p>\n<p>written   statement   of   defence.     He   did   not   make   any<\/p>\n<p>request   for   extension   of   the   time   granted   for   filing<\/p>\n<p>the written statement of defence.  Therefore, after the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC No.30753 \/2006                -3-<\/span><\/p>\n<p>expiry of the period stipulated in the charge memo for<\/p>\n<p>receipt   of   the   written   statement   of   defence,   the<\/p>\n<p>enquiring   authority,   after   going   through   the   materials<\/p>\n<p>on   record,   filed   his   report.            The   disciplinary<\/p>\n<p>authority   considered   the   report   and   passed   Ext.   P2<\/p>\n<p>order finding the petitioner guilty of the charges.\n<\/p>\n<p id=\"p_5\">       4.   The   fact   that   the   petitioner   failed   to   submit<\/p>\n<p>his   written   statement   of   defence   in   reply   to   the   memo<\/p>\n<p>of charge is not in dispute.  The excuse put forward by<\/p>\n<p>him   that   he   was   waiting   for   a   reply   from   the<\/p>\n<p>disciplinary   authority   in   response   to   his   request   for<\/p>\n<p>perusal of records is not convincing.   No material has<\/p>\n<p>been placed by the petitioner to show that he made any<\/p>\n<p>such   request   before   the   disciplinary   authority.     Even<\/p>\n<p>assuming   that   he   had   made   any   such   request,   he   was<\/p>\n<p>expected   to   apply   for   extension   of   time   to   file   his<\/p>\n<p>written   statement   of   defence   pending   consideration   of<\/p>\n<p>his   request.     In   the   above   circumstances,   neither   the<\/p>\n<p>enquiring   authority   nor   the   disciplinary   authority   can<\/p>\n<p>be found fault with for passing an order in the nature<\/p>\n<p>of Ext. P2 based on the materials available on record.\n<\/p>\n<p id=\"p_6\">     5. The allegations made against the petitioner are<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">WPC No.30753 \/2006                 -4-<\/span><\/p>\n<p>such   that   the   truth   or   correctness   of   the   same   can   be<\/p>\n<p>ascertained   by  proper  examination  of  the  records.    The<\/p>\n<p>explanation   submitted  by  the  petitioner  in  the  form  of<\/p>\n<p>an appeal memorandum before the 2nd respondent was found<\/p>\n<p>not   satisfactory.     The   1st  respondent-Government   has<\/p>\n<p>considered   in   detail   the   contentions   of   the   petitioner<\/p>\n<p>and has passed a speaking order.   The minor penalty of<\/p>\n<p>withholding   one   increment   is   neither   excessive   nor<\/p>\n<p>disproportionate   to   the   charges   proved   against   the<\/p>\n<p>petitioner.\n<\/p>\n<p id=\"p_7\">        6.   I   find   no   grounds   to   interfere   with   the<\/p>\n<p>impugned   orders.     The   writ   petition   is,   therefore,<\/p>\n<p>dismissed.\n<\/p>\n<p id=\"p_8\">                                                    K.K.
