Whether the judgment should be reported in the Digest?\n<\/p>\n<p id=\"p_6\">                               -.-\n<\/p>\n<p id=\"p_7\">K. KANNAN J.(ORAL)<\/p>\n<p id=\"p_8\">1.       The order in challenge is a direction for reinstatement of<\/p>\n<p>the workman with continuity of service and back wages. The<\/p>\n<p>contention of the workman was that he had been terminated from<\/p>\n<p>service without complying with the provisions of <a href=\"\/doc\/1056316\/\" id=\"a_1\">Section 25-F<\/a> of<\/p>\n<p>the Industrial Disputes Act, although he had completed 240 days<\/p>\n<p>of service. The management resisted the claim of the workman<\/p>\n<p>on the ground that even at the time when appointment order was<\/p>\n<p>issued, it stipulated that the workman shall obtain proficiency in<\/p>\n<p>typing 40 words per minute within a period of six months and if<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> C.W.P. No.3087 of 1989                         -2-<\/span><\/p>\n<p>he did not qualify for such a proficiency, his services were liable<\/p>\n<p>for termination without any further notice. The contention of the<\/p>\n<p>management was that the workman had been granted at least four<\/p>\n<p>opportunities to qualify himself in the manner contemplated in the<\/p>\n<p>appointment letter and since he did not obtain such a<\/p>\n<p>qualification, his services were terminated.<\/p>\n<p id=\"p_9\">2.       The Labour Court reasoned that the condition in the<\/p>\n<p>appointment order was introduced for the first time, which<\/p>\n<p>condition had not been indicated in the notification calling for<\/p>\n<p>applicants for the post.   According to the Labour Court, this<\/p>\n<p>condition in the appointment order had been forced on the<\/p>\n<p>workman and the management could not have imposed such a<\/p>\n<p>condition.     The Labour Court, therefore, found that the<\/p>\n<p>termination effected without compliance of the statutory<\/p>\n<p>requirement under <a href=\"\/doc\/1056316\/\" id=\"a_1\">Section 25-F<\/a> of the Industrial Disputes Act<\/p>\n<p>was illegal.\n<\/p>\n<p id=\"p_10\">3.       The only contention raised by the counsel for the<\/p>\n<p>management is that when there was a specific stipulation as to the<\/p>\n<p>qualification of the workman for continuance of duty and if that<\/p>\n<p>qualification the workman did not have, the termination shall be<\/p>\n<p>understood as being occasioned under a situation contemplated<\/p>\n<p>under <a href=\"\/doc\/1418464\/\" id=\"a_2\">Section 2(oo)(bb)<\/a> of the Industrial Disputes Act. The sub<\/p>\n<p>clause (bb) contemplates &#8220;termination of service of the workman<\/p>\n<p>as a result of non-renewal of the contract between the employer<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> C.W.P. No.3087 of 1989                             -3-<\/span><\/p>\n<p>and the employee concerned on its expiry or of such contract<\/p>\n<p>being terminated under a stipulation in that behalf contained<\/p>\n<p>thereunder.&#8221; The stipulation contained in the appointment order<\/p>\n<p>contained, inter alia, following:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;(a) You will have to pass type test at the speed of 40<\/p>\n<p>               W.P.M. Within six months from the date of<\/p>\n<p>               joining, failing which your services will be<\/p>\n<p>               terminated without giving any notice.&#8221;<\/p>\n<\/blockquote>\n<p id=\"p_11\">4.       Admittedly, the stipulation provided for a termination of<\/p>\n<p>service and although it contemplated termination of service<\/p>\n<p>without notice, the management had in this case admittedly issued<\/p>\n<p>notices to the workman urging him to acquire the proficiency and<\/p>\n<p>only when it was not so done, the termination ensued.<\/p>\n<p id=\"p_12\">5.       The    reasoning    of     the   Labour    Court   that   the<\/p>\n<p>advertisement calling for the post did not contain such a<\/p>\n<p>stipulation is meaningless, for the contract of employment takes<\/p>\n<p>place not at the time when an advertisement is issued.             An<\/p>\n<p>advertisement is merely an invitation to offer employment. It is<\/p>\n<p>the appointment order, which when accepted constitutes the<\/p>\n<p>contract. A condition in such appointment order is binding and<\/p>\n<p>the workman shall not be entitled to fall back of what stipulations<\/p>\n<p>the advertisement did not contain.        The order of termination<\/p>\n<p>cannot be impeached by the workman in the manner he did and<\/p>\n<p>the challenge to the termination order ought to have been rejected.<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> C.W.P. No.3087 of 1989                    -4-<\/span><\/p>\n<p id=\"p_13\">6.       The award of the Labour Court is, under the<\/p>\n<p>circumstances, set aside and the order of termination passed<\/p>\n<p>already by the management is sustained.\n<\/p>\n<p id=\"p_14\">7.       The writ petition is allowed in the above terms.
