KRISHNAN, J.\n                  ...........................................\n                   M.A.C.A.NO.1886 OF 2008\n                  .............................................\n           Dated this the 29th day of October, 2010.\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Vadakara in OP(MV)No.719\/2004. It is the<\/p>\n<p>case of the claimant that while he was walking along the road,<\/p>\n<p>an auto rickshaw driven by the first respondent came and<\/p>\n<p>hit on him resulting in injuries to him.<\/p>\n<p id=\"p_1\">      2. The insurance company would contend that he was<\/p>\n<p>not a pedestrian but a gratuitous passenger in a goods<\/p>\n<p>auto rickshaw and therefore the insurance company shall<\/p>\n<p>not be made liable. It is also contended by the insurance<\/p>\n<p>company that the compensation awarded under different<\/p>\n<p>heads are    exorbitant and it            requires interference.   The<\/p>\n<p>Tribunal has awarded a               sum of Rs.89,852\/= with 6%<\/p>\n<p>interest.\n<\/p>\n<p id=\"p_2\">     3. Heard the learned counsel for both sides. Let me<\/p>\n<p>first consider about the case of the insurance company that<\/p>\n<p>the claimant was a gratuitous passenger in an auto rickshaw.<\/p>\n<p>It has to be stated that the police has charge sheeted the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                             : 2 :<\/span><br \/>\nM.A.C.A.NO.1886 OF 2008<\/p>\n<p>driver of the auto rickshaw for hitting the claimant as a<\/p>\n<p>pedestrian. On receipt of the charge memo, the accused<\/p>\n<p>appeared and pleaded guilty. The insurance company would<\/p>\n<p>contend that the certification in the wound certificate would<\/p>\n<p>reveal that he was not a pedestrian.   It has to be stated that<\/p>\n<p>the police   after   due investigation had     described   the<\/p>\n<p>accident    as one hitting on a pedestrian.        The    first<\/p>\n<p>respondent    who had    entered   appearance and     filed  a<\/p>\n<p>written statement    also would contend that the accident<\/p>\n<p>took place when the claimant abruptly       crossed the road.<\/p>\n<p>The sum and substance of the materials would indicate that<\/p>\n<p>the accident caused is to a pedestrian and therefore the<\/p>\n<p>contention of the insurance company cannot be accepted.<\/p>\n<p id=\"p_3\">      4. Now turning to the quantum. A perusal of the wound<\/p>\n<p>certificate would reveal that the claimant had sustained<\/p>\n<p>fracture of both    bones of   right forearm,    radial   head<\/p>\n<p>dislocation and nerve palsy. He was treated in the Medical<\/p>\n<p>College Hospital from 22.12.2003 to 4.1.2004 and again from<\/p>\n<p>1.3.2004 to 6.3.2004 in District Co-operative Hospital and<\/p>\n<p>again from 28.3.2006 to 30.3.2006. He had hospitalisation<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                              : 3 :<\/span><br \/>\nM.A.C.A.NO.1886 OF 2008<\/p>\n<p>of about 202 days. The claimant has produced the      bills for<\/p>\n<p>Rs.33,571\/=. Medical Board assessed the disability at 4%.<\/p>\n<p>The income is only taken at Rs.2,000\/= which appears to be<\/p>\n<p>very reasonable.    But    applying the multiplier in   <a href=\"\/doc\/837924\/\" id=\"a_1\">Sarla<\/p>\n<p>Verma v. Delhi Transport Corporation<\/a> (2009 ACJ 1298),<\/p>\n<p>the multiplier should be 17 and not 18 and therefore there<\/p>\n<p>will be a reduction of Rs.960\/= which I round as Rs.1,000\/=<\/p>\n<p>on that head. For pain and sufferings also the compensation<\/p>\n<p>awarded is little excessive and I reduce it by Rs.3,000\/= and<\/p>\n<p>since   disability certificate as such has been admitted, I<\/p>\n<p>reduce the loss of amenities compensation also by Rs.1,000\/=<\/p>\n<p>thereby reducing it to Rs.5,000\/=.\n<\/p>\n<p id=\"p_4\">      5. The learned counsel for the appellant would contend<\/p>\n<p>that the amount awarded is extremely reasonable. But as<\/p>\n<p>stated by me      earlier, under the provisions of the <a href=\"\/doc\/785258\/\" id=\"a_1\">Motor<\/p>\n<p>Vehicles Act<\/a> what is intended to be      given is   a just and<\/p>\n<p>reasonable compensation.       The court cannot be lavish or<\/p>\n<p>miserly but reasonable. When overlapping occurs that has<\/p>\n<p>to be duly balanced and reduce it under one head or other.<\/p>\n<p>It is applying these principles, I have reduced Rs.5,000\/=<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                              : 4 :<\/span><br \/>\nM.A.C.A.NO.1886 OF 2008<\/p>\n<p>from the total compensation awarded.\n<\/p>\n<p id=\"p_5\">     6. In the result, the MACA is disposed of by passing a<\/p>\n<p>revised award as follows:\n<\/p>\n<p id=\"p_6\">     The compensation amount is fixed at Rs.84,852\/= with<\/p>\n<p>6% interest from the date of petition till realisation and<\/p>\n<p>retained the other portion of the operative portion of the<\/p>\n<p>award of the Tribunal. The insurance company is directed<\/p>\n<p>to deposit the said amount within a period of 60 days from<\/p>\n<p>the date of receipt of a copy of this judgment. If any amount<\/p>\n<p>is already deposited, balance alone need be deposited.<\/p>\n<p id=\"p_7\">                                   M.N.
