Justice K.SURENDRA MOHAN\n\n Dated :27\/01\/2011\n\n O R D E R\n<\/pre>\n<p id=\"p_1\">            R.BASANT &amp; K.SURENDRA MOHAN, JJ.\n<\/p>\n<p id=\"p_1\">        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p id=\"p_2\">                  W.P.(Civil) No.2265 of 2011\n<\/p>\n<p id=\"p_3\">        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n         Dated this the 27th day of January, 2011<\/p>\n<p>                            Judgment<\/p>\n<p>Basant, J.\n<\/p>\n<p id=\"p_4\">      The petitioner has come to this court seeking issue of<\/p>\n<p>directions to respondents 1 to 3 under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<\/p>\n<p>Constitution to ensure that police protection be afforded to the<\/p>\n<p>petitioner for the peaceful enjoyment of his property and against<\/p>\n<p>causing any threat to the life and person of the petitioner.<\/p>\n<p id=\"p_5\">      2. The petitioner is the father of the 4th respondent.<\/p>\n<p>Respondent No.6 is the younger brother of the petitioner.<\/p>\n<p>Respondent No.5 is the father-in-law of the 4th respondent. The<\/p>\n<p>wife of the petitioner expired on 21.6.2010. The spouses have<\/p>\n<p>two children, i.e., the 4th respondent and another married son.<\/p>\n<p>Both the children are married and employed. According to the<\/p>\n<p>petitioner, his wife had executed a registered Will dated<\/p>\n<p>27.10.2009. On the strength of that Will, after the death of his<\/p>\n<p>wife, the petitioner is in exclusive possession of the properties<\/p>\n<p>which belonged to his wife. He has his own properties also. The<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 2265\/2011                     2<\/span><\/p>\n<p>petitioner is living in the property after the death of his wife. The<\/p>\n<p>4th respondent, the son of the petitioner, is claiming one-third<\/p>\n<p>share in his property. The petitioner was, in these circumstances<\/p>\n<p>obliged to file Ext.P1 suit. The suit is pending. An order of interim<\/p>\n<p>injunction is passed in that suit (Ext.P2) restraining respondents<\/p>\n<p>4 and 5 from trespassing into the property. According to the<\/p>\n<p>petitioner, subsequent to the passing of the order, the party<\/p>\n<p>respondents had taken law into their hands                 and had<\/p>\n<p>dispossessed the petitioner. The petitioner has already filed<\/p>\n<p>complaint before the court to take action against the party<\/p>\n<p>respondents for violating the order of injunction and also for<\/p>\n<p>issue of directions by the civil court to afford police protection to<\/p>\n<p>the petitioner. Admittedly those petitions are pending and have<\/p>\n<p>not been disposed of.\n<\/p>\n<p id=\"p_6\">      3. The petitioner now has a grievance that respondents 4 to<\/p>\n<p>6 are causing threat to his life and person. They are not<\/p>\n<p>permitting him to enjoy the fruits of Ext.P2 order. He has a<\/p>\n<p>further grievance that under the influence of respondents 4 to 6,<\/p>\n<p>police are compelling him to withdraw the civil proceedings<\/p>\n<p>initiated by him. The police want him not to claim rights under<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 2265\/2011                     3<\/span><\/p>\n<p>the Will executed by his wife. It is, in these circumstances, that<\/p>\n<p>the petitioner has come to this court seeking directions for police<\/p>\n<p>protection against wanton, culpable and violent acts of<\/p>\n<p>respondents 4 to 6 and also for directions to police officials not to<\/p>\n<p>intervene in the civil dispute between the parties.<\/p>\n<p id=\"p_7\">      4. Respondents 4 and 5 had entered appearance through<\/p>\n<p>counsel. According to respondents 4 and 5, the petitioner is not<\/p>\n<p>in possession of the property. According to them, the petitioner is<\/p>\n<p>attempting to steal a march over the party respondents by<\/p>\n<p>making attempt to secure an order for police protection. Petition<\/p>\n<p>seeking directions for police aid to enforce the order of injunction<\/p>\n<p>has already been filed and is pending. Action for alleged violation<\/p>\n<p>of the order of injunction is also pending before the court which<\/p>\n<p>passes Ext.P2 order.      At this juncture, it is not necessary or<\/p>\n<p>proper for the police to intervene in the dispute nor is it<\/p>\n<p>necessary for this court to issue any directions to the police. The<\/p>\n<p>petitioner may be directed to seek remedy from the civil court in<\/p>\n<p>the pending petitions for violation of the injunction order and for<\/p>\n<p>enforcement of the order of injunction with the aid of the police.<\/p>\n<p>No directions are necessary to be issued now, contends the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">WPC 2265\/2011                      4<\/span><\/p>\n<p>learned counsel for respondents 4 and 5.\n<\/p>\n<p id=\"p_8\">      5. We turned to the learned Government Pleader for his<\/p>\n<p>submissions. The learned Government Pleader submits that the<\/p>\n<p>police have no intention to interfere in the civil dispute between<\/p>\n<p>the parties. If the civil court issues any directions, the same shall<\/p>\n<p>be scrupulously implemented. At this juncture, the police have no<\/p>\n<p>intention to interfere in the civil dispute between the parties. The<\/p>\n<p>learned Government Pleader further submits that it is incorrect to<\/p>\n<p>say that the petitioner was vexed or harassed by the police to<\/p>\n<p>withdraw the civil litigation initiated by him against his son and<\/p>\n<p>others. In these circumstances, this petition may be dismissed,<\/p>\n<p>submits the learned Government Pleader.\n<\/p>\n<p id=\"p_9\">      6. We do take note of all the relevant circumstances. The<\/p>\n<p>civil court is seized     of the matter. Whether there has been<\/p>\n<p>trespass subsequent to the filing of the petition; whether police<\/p>\n<p>aid should be given to enforce the order of injunction etc. will<\/p>\n<p>have to be decided by the civil court in accordance with law. We<\/p>\n<p>are not in these circumstances persuaded to issue any specific<\/p>\n<p>directions in this writ petition.\n<\/p>\n<p id=\"p_10\">      7. Learned counsel for the petitioner submits that the civil<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">WPC 2265\/2011                   5<\/span><\/p>\n<p>court may be directed to dispose of the pending petitions for<\/p>\n<p>police aid and for action for violation of the order of injunction<\/p>\n<p>expeditiously. The petitioner can make that request to the court<\/p>\n<p>concerned. We have no reason to assume that the court will not<\/p>\n<p>accept the said request.
