No.856 of 2010\n           ----------------------------------------------\n                  Dated 3rd September, 2010.\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">           This petition is for special leave.\n<\/p>\n<p id=\"p_1\">           2.  The petitioner was prosecuted for offence under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the Negotiable Instruments Act, on a complaint<\/p>\n<p>filed by respondent herein. On an analysis of the evidence on<\/p>\n<p>record which consists of oral evidence of PW1, Exts.P1 to P5,<\/p>\n<p>DW1, Exts.D1 to D4, it was found by the trial court that the<\/p>\n<p>prosecution could not prove execution of cheque for discharge of<\/p>\n<p>a debt of Rs.75,000\/-, as claimed. The case of accused was that<\/p>\n<p>Ext.P1 cheque was issued only by obtaining signature of the<\/p>\n<p>accused in the blank form in a transaction of Rs.20,000\/- in<\/p>\n<p>between the complainant and husband of the accused. The court,<\/p>\n<p>after analysing the evidence, entered a finding that the<\/p>\n<p>probability of misusing Ext.P1 by obtaining the same in blank<\/p>\n<p>form cannot be ruled out.\n<\/p>\n<p id=\"p_2\">           3. Learned defence counsel submitted that execution<\/p>\n<p>of the cheque was admitted in the reply notice. (A copy of reply<\/p>\n<p>notice was also handed over to this court). Hence, the finding<\/p>\n<p>that execution is not proved cannot be sustained, it is submitted.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.L.P. No.856\/10                    2<\/span><\/p>\n<p>On going through the reply notice, it is clear that the execution<\/p>\n<p>was not only admitted, but the whole transaction was disputed<\/p>\n<p>also. It is stated in the said notice as follows :-<\/p>\n<blockquote id=\"blockquote_1\"><p>           &#8220;it is known to your client that there is no money transaction<\/p>\n<p>           between my client and your client as alleged in your notice<\/p>\n<p>           and as such there is no question of discharge of liability<\/p>\n<p>           arising out of the cheque, &#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                  That the husband of my client borrowed an amount of<\/p>\n<p>           Rs.20,000\/- (Twenty thousand rupees) from your client and at<\/p>\n<p>           the time of the said transaction your client insisted my<\/p>\n<p>           client&#8217;s husband to give a signed blank cheque of my client<\/p>\n<p>           as a security for repayment.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                  That my client&#8217;s husband at that time itself showed his<\/p>\n<p>           inability to issue such a blank signed cheque of my client in<\/p>\n<p>           favour of your client since my client was not holding a cheque<\/p>\n<p>           book due to the poor balance in her account.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">\n<p id=\"p_4\">              4. According to learned defence counsel, as per the<\/p>\n<p>reply notice, accused insisted for returning the cheque, and the<\/p>\n<p>execution was admitted by him. On a reading of the extract from<\/p>\n<p>the reply notice referred above, it is clear that the execution of<\/p>\n<p>the    cheque      and    the    transaction   between    accused    and<\/p>\n<p>complainant       were     flatly  denied     by accused.       In  such<\/p>\n<p>circumstances, as rightly held by the trial court, mere signing of<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.L.P. No.856\/10                  3<\/span><\/p>\n<p>an instrument cannot be equated with execution of the same.<\/p>\n<p>The petitioner was not able to substantiate that the findings of<\/p>\n<p>the trial court on execution are unsustainable.
