From the grounds of detention, it<br \/>\nappears that only one offence being Prohibition CR No.5034 of 2009<br \/>\nunder the provisions of Section 66-1B, 65AE, 116B and 81 under the<br \/>\nBombay Prohibition Act was registered with DCB Police Station,<br \/>\nwherein a quantity of total 237 bottles of foreign  liquor was found<br \/>\nfrom the possession of the detenue. On the basis of registration of<br \/>\nthis case, the detaining authority held that the present detenue was<br \/>\ncarrying on activities of selling liquor which is harmful to the<br \/>\nhealth of the public. It is held by the detaining authority that as<br \/>\nthe detenue is indulged in illegal activities, it is required to<br \/>\nrestrain the detenu from carrying out further illegal activities,<br \/>\ni.e. selling of liquor. The detaining authority has placed reliance<br \/>\non the above registered offence and statements of unnamed witnesses.<br \/>\nIn the opinion of this Court, the activities of the detenue can, by<br \/>\nno stretch of imagination, be said to be disturbing the  public<br \/>\norder.  It is seen from the grounds that a general statement that<br \/>\nhas been made by the detaining authority that consuming liquor is<br \/>\ninjurious to health.  In fact, a perusal of the order passed by the<br \/>\ndetaining authority shows that the grounds which  are mentioned in<br \/>\nthe order are in reference to the situation of  law and order<br \/>\nand not  public order .  Therefore, on this ground, the<br \/>\nsubjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p id=\"p_3\">4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In the case of <a href=\"\/doc\/687998\/\" id=\"a_1\">Ashokbhai Jivraj @ Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered<br \/>\nthe decision of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/1733535\/\" id=\"a_2\">Ram Manohar<br \/>\nLohia v. State of Bihar<\/a> (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of  law and<br \/>\norder  and not  public order .\n<\/p>\n<p id=\"p_4\">5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p id=\"p_5\">6.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 11.12.2009<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
