Vadodara on 02.01.1991 in Civil Misc. Application No.202 of<br \/>\n1976. The said application was preferred for obtaining probate in<br \/>\nrespect of will of Khamanben dated 02nd    July,1974. By<br \/>\nthe impugned judgment and order, learned Civil Judge (S.D.) Vadodara<br \/>\ndismissed the said application. Hence, this appeal.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\nquestion that arises for preliminary determination of this Court is,<br \/>\nwhether this appeal would be maintainable before this Court.  In this<br \/>\nregard, it would be appropriate to record that the judgment and order<br \/>\nunder challenge is rendered by learned Civil Judge (S.D.)<br \/>\nVadodara(now nomenclatured as  Senior Civil Judge ).\n<\/p>\n<p id=\"p_2\">2.1\tBy<br \/>\nvirtue of coming into force of the Gujarat Civil Courts Act,2005 with<br \/>\neffect from 9th May,2005, appeals from the decree and<br \/>\norders passed by a Court of Senior Civil Judge in original suits and<br \/>\nproceedings of civil nature, shall lie to the Court of District Judge<br \/>\nof the district when the amount or value of the subject matter of the<br \/>\noriginal suit or proceedings is less than five lakhs of rupees or<br \/>\nsuch  other sum as the High Court may, from time to time, specify<br \/>\n[Section 15(2)(a)].\n<\/p>\n<p id=\"p_3\">3.\tAs<br \/>\nsuch, by virtue of the new Act coming into force, the matter shall<br \/>\nhave to be transferred to District Vadodara for disposal in<br \/>\naccordance with law. \tHowever, since the appeal arises out of a Civil<br \/>\nMisc. Application for probate  which is under <a href=\"\/doc\/1450343\/\" id=\"a_1\">Indian Succession Act<\/a><br \/>\nand <a href=\"\/doc\/682376\/\" id=\"a_1\">Section 299<\/a> of the Indian Succession Act provides for the forum<br \/>\nof appeal, it would be appropriate to examine the issue from that<br \/>\nangle. The said issue is covered by the decision rendered by this<br \/>\nCourt in First Appeal No. 983 of 2005 dated 25.07.2005 and Civil<br \/>\nReference No. 3 of 2007 dated 23.10.2007.\n<\/p>\n<p id=\"p_4\">4.\tIn<br \/>\nlight of provisions contained in Section-30(3) of the Gujarat Civil<br \/>\nCourts Act,2005, all suits, appeals and proceedings connected<br \/>\ntherewith pending before any Court would stand transferred to such<br \/>\nother Court having jurisdiction as per Section-15 of the said Act.<br \/>\nThis appeal, therefore, will have to be transferred to the Court of<br \/>\nDistrict Judge Vadodara for disposal in accordance with law.\n<\/p>\n<p id=\"p_5\">5.\tRegistry<br \/>\nis directed to transfer the appeal at the earliest to the District<br \/>\nCourt, Vadodara along with R &amp; P of the Trial Court, if lying<br \/>\nbefore this Court for disposal in accordance with law. For the<br \/>\npurpose of this Court, the appeal stands disposed of.
