RAMKUMAR, J.\n                   .........................................\n                          B.A. No.7367 of 2010\n                   ..........................................\n                            Dated: 12.11.2010\n                                    ORDER\n<\/pre>\n<p id=\"p_1\">      Petitioner, who is the 2nd accused in Crime No.955\/2010<br \/>\nof      Pandalam    Police    Station   for    offences    punishable under<br \/>\n<a href=\"\/doc\/1096965\/\" id=\"a_1\">Sections 143<\/a>,<a href=\"\/doc\/1258372\/\" id=\"a_1\">147<\/a> and <a href=\"\/doc\/1011035\/\" id=\"a_2\">323<\/a> I.P.C. read with 3(i)(x) of Scheduled Castes<br \/>\nand <a href=\"\/doc\/25085007\/\" id=\"a_3\">Scheduled Tribes (Prevention of Atrocities) Act<\/a>, 1989, seeks<br \/>\nanticipatory bail.\n<\/p>\n<p id=\"p_1\">      2.     The learned Public Prosecutor opposed the application.<\/p>\n<p id=\"p_2\">      3.     Anticipatory bail cannot be granted in a case of this nature.<\/p>\n<p>But at the same time, I am inclined to permit the petitioner to surrender<\/p>\n<p>before the Investigating Officer for the purpose of interrogation and then<\/p>\n<p>to have his application for bail considered by the Magistrate         having<\/p>\n<p>jurisdiction.  Accordingly, the petitioner shall surrender before the<\/p>\n<p>investigating officer on     23.11.2010 or on 24.11.2010             for the<\/p>\n<p>purpose of interrogation and recovery of incriminating material, if any.<\/p>\n<p>The petitioner shall thereafter be produced before the Magistrate who on<\/p>\n<p>being satisfied that the petitioner has been interrogated by the police<\/p>\n<p>shall consider and dispose of his application for regular bail preferably<\/p>\n<p>on the same date on which it is filed.\n<\/p>\n<p id=\"p_3\">      This petition is disposed of as above.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                              V.RAMKUMAR, JUDGE<\/p>\n<p>sj<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court James Mathai vs State Of Kerala on 12 November, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7367 of 2010() 1.
