DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/08\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tPursuant<br \/>\nto the notice issued by this Court on 29.2.2008, Police Inspector,<br \/>\nSOG Crime Branch, Ahmedabad City has filed the affidavit-in-reply and<br \/>\nin paragraph 4 it is stated as under:\n<\/p>\n<p id=\"p_1\"> 4.\tI<br \/>\nsay and submit that this is an admitted fact in the application<br \/>\nitself that the applicant&#8217;s husband and son had been convicted by the<br \/>\nJudicial Court for the life time imprisonment for the offence<br \/>\npunishable under Section 302.  The son of the prsent applicant namely<br \/>\nRajeshbhai @ Lalo Jayantilal Waghela had got parole and he jumped the<br \/>\nparole.  The Criminal conspiracy has been hatched in the jail for<br \/>\nkilling one Kanaksinh Thakor who is complainant in I.C.R.No.705\/2006.<br \/>\n In this complaint, one Deepsinh who is also accused, who is in jail<br \/>\nat present.  Rajesh Jayantilal Thakor and Deepsinh Thakor made a<br \/>\nplain to kill the complainant Kanaksinh Thakor.  Pursuant to this,<br \/>\nRajesh had collected the arms illegality but before he did anything,<br \/>\nhe had been caught by the police, and hence, complaint is lodged<br \/>\nbefore the Detection of Crime Branch Police Station, Ahmedabad, being<br \/>\nII C.R. No.3028\/2007 <a href=\"\/doc\/502965\/\" id=\"a_1\">sections 25(1)(b)<\/a>, <a href=\"\/doc\/1570966\/\" id=\"a_1\">29<\/a> of the Arms Act, under<br \/>\nsection 135 of the Bombay Police Act and under <a href=\"\/doc\/112749\/\" id=\"a_2\">section 114<\/a> of Indian<br \/>\nPenal Code. Then after, under <a href=\"\/doc\/1897847\/\" id=\"a_3\">section 120-B<\/a> and <a href=\"\/doc\/1510312\/\" id=\"a_4\">118<\/a> of Indian Penal<br \/>\nCode had been added by the police investigating agency.  Pursuant to<br \/>\nthat, report is also made to the concerned Judicial magistrate.<br \/>\nDuring investigation, total 10 accused persons have been arrested in<br \/>\nthis case.  As per the statement of the Rakesh Thakor, one arm had<br \/>\nbeen received by Amar Bhagvatprasad Yadav.  Pursuant to that Amar<br \/>\nBhagavatprasad Yadav had been arrested by the police and statement<br \/>\nhas been given by Amarbhai that the said arm had been received from<br \/>\nthe Bharat Jayantibhai Thakor who is second son of the present<br \/>\napplicant.  This statement has been given by the Amarbhai on<br \/>\n5.2.2008. Then after, police had visited the residence of the present<br \/>\napplicant on 7.2.2008, but the house was locked and nobody was<br \/>\npresent.  Again on 8.2.2008, police personnel had went to the house<br \/>\nof the present applicant, at that time, the present applicant was<br \/>\npresent and hence, police personnel had asked her about her son<br \/>\nBharat Thakor.  But no reply has been given by the present applicant.<br \/>\n Hence, again on 9.2.2008, Police Investigating Agency had went to<br \/>\nthe house of the present applicant and recorded the statement of the<br \/>\npresent applicant, in which, applicant had stated that she did not<br \/>\nknow whereabouts of her son.  In this case, charge sheet had also<br \/>\nfiled on 19.2.2008.\n<\/p>\n<p id=\"p_2\">\tWhen<br \/>\nthe son of the petitioner has jumped the parole while undergoing<br \/>\nimprisonment for life pursuant to the offences under <a href=\"\/doc\/1560742\/\" id=\"a_5\">Section 302<\/a> of<br \/>\nI.P.C. and again committed crime while on parole being investigated<br \/>\nby the police and in performance of official duty, the residence of<br \/>\nthe petitioner is visited, which cannot be said to be harassment.\n<\/p>\n<p id=\"p_3\">\tNo<br \/>\ncase is made out.  This petition is rejected.   Notice is discharged.\n<\/p>\n<p id=\"p_4\">[ANANT<br \/>\nS.
