Public Prosecutor for the State.\n<\/p>\n<p id=\"p_4\">\tFollowing<br \/>\naspects are taken into consideration for ordering the release of the<br \/>\naccused-applicant on regular bail:-\n<\/p>\n<p id=\"p_5\">(a)\tThe<br \/>\ninvestigation is over and the charge sheet is filed;\n<\/p>\n<p id=\"p_6\">(b)\tNo<br \/>\novert act is attributed so far as the deceased is concerned.  It is<br \/>\nnot the case of the prosecution that the accused-applicant inflicted<br \/>\nany blows on the body of the deceased;\n<\/p>\n<p id=\"p_7\">(c)\tThe<br \/>\novert act attributed to the accused-applicant is that of inflicting a<br \/>\nblow on the head of brother of the deceased with an iron pipe.<br \/>\nHaving regard to the nature of injury sustained by the brother, he<br \/>\nwas not even hospitalised.\n<\/p>\n<p id=\"p_8\">\tHaving<br \/>\nregard to the facts and circumstances of the case, the nature of<br \/>\nallegations and the overt act attributed to the accused-applicant and<br \/>\nthe fact that the investigation is over and charge-sheet has been<br \/>\nfiled, I am inclined to exercise my discretion in favour of the<br \/>\naccused-applicant.\n<\/p>\n<p id=\"p_9\">The applicant is ordered to be released on bail in connection with<br \/>\noffence registered with Meghaninagar Police Station being Crime<br \/>\nRegister No.I-193 of 2010 on his executing a bond in the sum of<br \/>\nRs.10,000\/- (Rupees ten thousand only) with  one surety of  the  like<br \/>\n amount  to  the  satisfaction  of  the  lower  Court  and  subject<br \/>\nto the  conditions that he shall,<\/p>\n<p> [a]\tnot take undue advantage of or misuse liberty;\n<\/p>\n<p id=\"p_10\">[b]\tmaintain<br \/>\n law and order and should co-operate with the investigating officer;\n<\/p>\n<p id=\"p_11\">[c]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_12\">[d]\tsurrender<br \/>\nhis passport, if any, to the lower court<br \/>\nwithin a week;\n<\/p>\n<p id=\"p_13\">[e]\tnot<br \/>\nleave the local limits of the State of Gujarat without prior<br \/>\npermission of the Sessions Judge concerned;\n<\/p>\n<p id=\"p_14\">[f]\tshall<br \/>\n\tmark his presence before the concerned Police  Station  on  every<br \/>\n2nd and 4th Sunday of  every English Calendar<br \/>\nmonth between  9.00  a.m.    and  5.00 p.m.till the trial against him<br \/>\ncommences;\n<\/p>\n<p id=\"p_15\">[h]\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt.\n<\/p>\n<p id=\"p_16\">\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_17\">\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant<br \/>\nor take appropriate action in the matter.\n<\/p>\n<p id=\"p_18\">\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case. This  application is allowed.\n<\/p>\n<p id=\"p_19\">\tRule<br \/>\nis made absolute. D.S.
