BASANT, J.\n\n\n             ````````````````````````````````````````````````````\n\n                       B.A. No. 592 OF 2008\n\n             ````````````````````````````````````````````````````\n\n            Dated this the 1st day of February, 2008\n\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">             Application for anticipatory bail.   Petitioner was the<\/p>\n<p>Secretary   of   a   Co-operative   Society.     He   faces   allegations,<\/p>\n<p>inter   alia,   under   <a href=\"\/doc\/1591527\/\" id=\"a_1\">sections   403<\/a>   and   <a href=\"\/doc\/1131784\/\" id=\"a_1\">408<\/a>   IPC.     The   alleged<\/p>\n<p>indiscretion   was   committed   during   the   period   2000   &#8211;   2004.<\/p>\n<p>Now,   a   private   complaint   has   been   filed   by   the   present<\/p>\n<p>Secretary.     Crime   has   been   registered.     Investigation   is   in<\/p>\n<p>progress. The petitioner apprehends imminent arrest.<\/p>\n<p id=\"p_1\">      2.     The  learned counsel for the petitioner submits that<\/p>\n<p>vexatious   allegations   are   being   raised   against   the   petitioner<\/p>\n<p>on account of political animosity.  It is prayed that anticipatory<\/p>\n<p>bail may be granted to the petitioner.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">      3.     The   learned   Public   Prosecutor   disputes   the   said<\/p>\n<p>contention but submits that the State has no objection against<\/p>\n<p>the   grant   of   anticipatory   bail   to   the   petitioner   subject   to<\/p>\n<p>BA.592\/08<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       : 2 :<\/span><\/p>\n<p>appropriate terms and conditions.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">      4.      I   am   satisfied   that   the   petitioner   can   be   granted<\/p>\n<p>anticipatory   bail.     In   the   absence   of   opposition,   it   is   not<\/p>\n<p>necessary for me to advert to the facts in any greater detail.<\/p>\n<p id=\"p_6\">      5.      In   the   result,   this   petition   is   allowed.     Following<\/p>\n<p>directions   are   issued   under   <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section   438<\/a>   Cr.P.C   in   favour   of<\/p>\n<p>the petitioner.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">      i)      Petitioner   shall   surrender   before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 8.2.2008.  He shall<\/p>\n<p>be   released   on   regular   bail   on   condition   that   he   executes   a<\/p>\n<p>bond   for   Rs.50,000\/-(Rupees   fifty   thousand   only)     with   two<\/p>\n<p>solvent sureties each for the like sum to the satisfaction of the<\/p>\n<p>learned Magistrate.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">      ii)     The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation before the investigating officer   between 10 a.m<\/p>\n<p>and 3 p.m on  11.2.2008 and   12.2.2008.   During this period,<\/p>\n<p>the   investigating   officer   shall   be   at   liberty   to   interrogate   the<\/p>\n<p>petitioner   in   custody   and   take   all   necessary   steps   for   the<\/p>\n<p>BA.592\/08<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                     : 3 :<\/span><\/p>\n<p>proper conduct of the investigation in this crime.   Thereafter,<\/p>\n<p>he   shall   so   appear   on   all   Mondays   and   Fridays   between   10<\/p>\n<p>a.m and 12 noon for a period of two months and subsequently<\/p>\n<p>as and when directed by the investigating officer  in writing to<\/p>\n<p>do so.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">       (iii)    If the petitioner does not appear before the learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   directions   issued   above<\/p>\n<p>shall thereafter stand revoked and the police shall be at liberty<\/p>\n<p>to arrest  the petitioner and deal with him in accordance  with<\/p>\n<p>law, as if these directions were not issued at all.<\/p>\n<p id=\"p_13\">       (iv)     If  he were arrested  prior  to    8.2.2008,  he shall  be<\/p>\n<p>released   from   custody   on   his   executing   a   bond   for<\/p>\n<p>Rs.50,000\/- (Rupees fifty thousand only) without any sureties,<\/p>\n<p>undertaking   to   appear   before   the   learned   Magistrate   on<\/p>\n<p>8.2.2008.\n<\/p>\n<p id=\"p_14\">\n<p id=\"p_15\">                                                   (R.BASANT, JUDGE)<\/p>\n<p>aks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Arumughaswamy vs State Of Kerala on 1 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 592 of 2008() 1.
