The<br \/>\nundisputed  facts  are\tthat  the  appellant  as  a  general<br \/>\ncandidate and  the third  respondent,  Dr.  Nitya  Anand  to<br \/>\nbackward  class\t quota\twere  selected\tfor  appointment  as<br \/>\nlecturer in  the Haryana  Medical Education  Service as\t per<br \/>\nH.M.E.S. Rules,\t 1965 (for  short, `the\t Rules&#8217;). The Public<br \/>\nService Commission  recommended the  names of  the appellant<br \/>\nand Dr.\t Nitya Anand  along with  three other candidates for<br \/>\nappointment as\tlecturers. It  would appear that Dr. Diwakar<br \/>\nJain and  Dr. Sidharth\tDass had  not  joined  the  service.<br \/>\nThough\tDr.  Om\t Prakash  Kalra\t initially  had\t joined\t the<br \/>\nservice,  he   too  left   the\tservice.   Consequently\t the<br \/>\nappellant, as general candidate and Dr. Nitya Anand remained<br \/>\nin service.\n<\/p>\n<p>     The question  is whether  the appellant  is  senior  to<br \/>\nNitya Anand.  The contention  of the appellant is that since<br \/>\nthe order  of merit given by the Selection Committee and the<br \/>\nletter of appointment do indicate that the appellant is high<br \/>\nup in the order of merit to Dr. Nitya Anand, he is senior to<br \/>\nthe later.  While maintaining  inter se\t seniority by  wrong<br \/>\ninterpretation Dr.  Nitya Anand\t has been made senior to the<br \/>\nappellant which\t is contrary  to the IInd proviso to Rule 13<br \/>\nof the\tRules. This  contention was not accepted by the High<br \/>\nCourt in  the impugned\tJudgment dated\tMay 3, 1993 in Civil<br \/>\nW.P. No.  4946\/93 by  the Punjab  &amp; Haryana  High  Court  at<br \/>\nChandigarh. Shri  Manoj Kumar, learned counsel appearing for<br \/>\nthe appellant  relying upon  the instruction  issued by\t the<br \/>\nChief Secretary, dated April 27,1972 and the Judgment of the<br \/>\nDivision Bench\tof that Court in Bhupinder Singh Vs. Haryana<br \/>\nWarehousing Corporation\t in Civil W.P. No.2006\/92 dated June<br \/>\n2, 1992\t contended that\t when the  Selection  Committee\t had<br \/>\nmentioned inter\t se seniority  in the  order of\t merit,\t the<br \/>\nState has no power to interfere with the inter se seniority.<br \/>\nThe same seniority shall be continued to be maintained while<br \/>\nfixing inter se seniority after the appointment given to the<br \/>\nrespective candidates.\tThe High  Court, therefore  was\t not<br \/>\nright in  upholding  the  action  of  the  respondents.\t The<br \/>\nlearned\t counsel  for  the  respondents\t have  resisted\t the<br \/>\ncontention.\n<\/p>\n<p>     We\t have\tgiven  our   anxious  consideration  to\t the<br \/>\nrespective contentions.\t The question  is whether  Dr. Nitya<br \/>\nAnand is  senior to  the appellant.  In\t 100  point  roaster<br \/>\nmaintained by  the State  Government,  the  Government\thave<br \/>\nearmarked some\tplaces to  the reserved\t candidates. In\t the<br \/>\ninstructions issued  by the  Chief Secretary  on  April\t 27,<br \/>\n1972, it was specifically stated that the vacancies reserved<br \/>\nfor Scheduled Castes and Backward Classes shall be filled up<br \/>\nto those specified points enumerated in the roaster. To give<br \/>\neffect to  the Public  Policy of  reservation  envisaged  in<br \/>\nArticle 16(4) read with Articles 14 and 16(1) and consistent<br \/>\nwith Art.  335, the  State prescribed  certain percentage of<br \/>\nposts or vacancies and they are required to be filled as per<br \/>\nthe roaster.  Admittedly, initially  2% posts  were reserved<br \/>\nfor the\t backward classes which was later increased to 10% .<br \/>\nVacancies 1  to 9  were filled up by the general candidates.<br \/>\nIn consequence\tof the\treservation to the backward classes,<br \/>\nvacancy\t No.10\t was  reserved\tfor  the  backward  classes.<br \/>\nAdmittedly, Dr.\t Nitya Anand  belongs to the backward class.<br \/>\nThe question,  therefore, is  whether the  placement of\t Dr.<br \/>\nNitya  Anand  in  the  10th  place  and\t relegation  of\t the<br \/>\nappellant to lower in the order of ranking in the roaster is<br \/>\nvalid in law. It is true that Rule 13 of the Rules envisages<br \/>\nthat the  seniority inter se of members of the service shall<br \/>\nbe determined  by the  length of  continuous service  on any<br \/>\npost in the service provided further that in the case of two<br \/>\nor more\t members appointed  by direct recruitment, the order<br \/>\nof merit determined by the Commission shall not be disturbed<br \/>\nin fixing  the seniority. In other words, where the inter se<br \/>\nmerit has  been determined  by the public Service Commission<br \/>\nor  the\t Selection  Committee,\tas  the\t case  may  be,\t and<br \/>\nrecommended  to\t  the  Government   for\t appointment,  while<br \/>\naccepting the  recommendations so  made, the  Government  do<br \/>\nrequire to  maintain the  order of  merit determined  by the<br \/>\nPublic Service\tCommission\/Committee. But  the\tquestion  is<br \/>\nwhether the  merit list\t prepared gets\tdisturbed, then\t the<br \/>\nroaster\t has  been  maintained\tand  the  placement  of\t the<br \/>\ncandidates in the order specified in the roaster when filled<br \/>\nup and\tis it  illegal, arbitrary or unconstitutional. It is<br \/>\nseen that  when the  roaster is maintained to give effect to<br \/>\nthe  constitutional   policy  of   reservation\t to   render<br \/>\nsocioeconomic justice  to the concerned sections, respective<br \/>\nplaces assigned to the candidates belonging to them, general<br \/>\ncandidates,  backward\tclasses\t or   Scheduled\t Castes\t  or<br \/>\nScheduled Tribes,  as the  case may  be, the  change in\t the<br \/>\norder of merit inevitably get affected. If original order of<br \/>\nmerit prepared by the Public Service Commission or Selection<br \/>\nCommittee, if  remains unaffected, roaster becomes redundant<br \/>\nand always  remains unimplemented.  The reserved  candidates<br \/>\nalways remain  at the  bottom  of  the\tselect\tlist  unless<br \/>\nselected as  general candidates\t in the\t order of  merit. To<br \/>\nrelieve such  injustice and  hardship, roaster is maintained<br \/>\nand vacancies are filled up in the order maintained therein.<br \/>\nThe placement  of candidates  shall  be\t to  the  respective<br \/>\npoints fixed in the roaster. Take for instance vacancy No. 1<br \/>\nand 6,\tas pointed  out in the Chief Secretary&#8217;s letter have<br \/>\nadmittedly  been  reserved  for\t Scheduled  Castes.  Suppose<br \/>\nrecruitment  was  made\tto  fill  up  ten  vacancies,  three<br \/>\ncandidates from\t Scheduled Castes  were selected.  The first<br \/>\none as\tgeneral and  second and\t third were  selected on the<br \/>\nbasis of  reserved quota.  The question is whether the first<br \/>\ncandidate will be put in the quota allotted to the Scheduled<br \/>\nCastes in  the roaster.\t Having been  selected as  a general<br \/>\ncandidate, though he is more meritorious than the second and<br \/>\nthird candidates,  he will  not get  the  placement  in\t the<br \/>\nroaster, reserved  for Scheduled  Castes i.e.  No. 1  and  6<br \/>\npoints. Consequently  candidates Nos.  2 and  3 will get the<br \/>\nplacement at No.1 and 6 and the first candidate will get the<br \/>\nplacement in  the order\t of merit  along with\tthe  general<br \/>\ncandidates according to the order of merit maintained by the<br \/>\nSelection Committee  or the  Public Service  Commission.  He<br \/>\ncannot complain\t that having  been selected in the merit, he<br \/>\nmust be\t placed in  the\t placement  reserved  for  Scheduled<br \/>\nCastes at  point No.  1\t in  the  roaster.  Equally,  though<br \/>\ngeneral candidate  is more meritorious in the order of merit<br \/>\nprepared by  the Public\t Service Commission or the Selection<br \/>\nCommittee, when\t the appointments are made and the vacancies<br \/>\nare filled  up according  to the  roaster,  necessarily\t and<br \/>\ninevitably the\tReserved candidates  though less meritorious<br \/>\nin the\torder of  merit maintained  by\tthe  Public  Service<br \/>\nCommission would  occupy the  respective places\t assigned in<br \/>\nthe roaster.  Thereby they  steal a  march over\t some of the<br \/>\ngeneral\t candidates  and  get  seniority  over\tthe  general<br \/>\ncandidates. This scheme is, therefore, constitutional, valid<br \/>\nand is not arbitrary.\n<\/p>\n<p>     The Chief\tSecretary in  his letter  obviously  was  in<br \/>\nerror in  directing to\tmaintain the  roaster the same inter<br \/>\nseniority maintained  by the  Public Service  Commission  or<br \/>\nSelection Committee. If that is given effect to, the roaster<br \/>\npoints\twould  remain  unfilled\t and  rotation\ttherein\t get<br \/>\ndisturbed. It is obvious that the interpretation of the Rule<br \/>\nby the\tChief Secretary\t was found  favour with the Division<br \/>\nBench which  was strongly  relied upon by the appellant. The<br \/>\norder of  merit indicated  in the  second proviso  would  be<br \/>\napplicable only\t inter\tse  to\tthe  general  candidates  or<br \/>\nreserved candidates  but gets  changed\twhen  vacancies\t are<br \/>\nfilled\tup   as\t per   roaster\tand  appointments  are\tmade<br \/>\nthereunder. The\t High Court, therefore, was right in holding<br \/>\nthat the  2nd proviso  to Rule\t13 is  in applicable  to the<br \/>\nfacts  and   was  also\t right\tin  its\t finding  that\twhen<br \/>\nappointments are  made to fill up the vacancies in the order<br \/>\nof roaster,  the order\tof merit  prepared by  the Selection<br \/>\nCommittee get changed.
