(ORAL)\n<\/pre>\n<p id=\"p_1\">            Prayer in the present petition is for quashing of FIR No.97<\/p>\n<p>dated 30.9.2008 under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Sections 279<\/a>, <a href=\"\/doc\/1402213\/\" id=\"a_1\">337<\/a>, <a href=\"\/doc\/1721129\/\" id=\"a_2\">338<\/a> and <a href=\"\/doc\/222396\/\" id=\"a_3\">427<\/a> IPC registered at<\/p>\n<p>Police Station Bhadson, District Patiala (Annexure P-1) and all<\/p>\n<p>consequential proceedings       arising therefrom on the basis of the<\/p>\n<p>compromise entered into between the parties dated 1.12.2008 (Annexure<\/p>\n<p>P-4).\n<\/p>\n<p id=\"p_1\">            Counsel for the petitioner contends that the dispute in the<\/p>\n<p>present petition arose due to an accident which had occurred on 22.09.2008<\/p>\n<p>and now with the passage of time and with the intervention of the<\/p>\n<p>respectables, compromise has been entered into between the parties. There<\/p>\n<p>does not exist any further dispute between the parties due to existence of the<\/p>\n<p>compromise dated 1.12.2008 (Annexure P-4). The complainant also does<\/p>\n<p>not have any<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Crl.Misc.No.M-12221 of 2009                                     -2-<\/span><\/p>\n<p>objection to the quashing of the FIR and all consequential proceedings<\/p>\n<p>arising therefrom.\n<\/p>\n<p id=\"p_2\">             Counsel for the complainant-respondent No.2 on the basis of<\/p>\n<p>the written statement filed by respondent No.2-complainant Parminder<\/p>\n<p>Singh son of Amarjit Singh, states that a compromise has been entered into<\/p>\n<p>between the parties and, therefore, the complainant does not want to press<\/p>\n<p>the allegations against the petitioner and has no objection to the quashing of<\/p>\n<p>the FIR and all consequential proceedings arising therefrom.<\/p>\n<p id=\"p_3\">             Respondent No.2-complainant-Parminder Singh son of Amarjit<\/p>\n<p>Singh is present in Court and has been identified by his counsel. He states<\/p>\n<p>that the compromise deed dated 1.12.2008 (Annexure P-4) has indeed been<\/p>\n<p>entered into between the parties. He states that as the matter having been<\/p>\n<p>compromised, he does not want to press the allegations against the<\/p>\n<p>petitioner   and has no objection to the quashing of the FIR and all<\/p>\n<p>consequential proceedings arising therefrom.\n<\/p>\n<p id=\"p_4\">             In view of the above, the interest of justice would be duly<\/p>\n<p>served with the quashing of the FIR and all consequential proceedings<\/p>\n<p>arising therefrom as there is no dispute as on today.   Since the compromise<\/p>\n<p>has been entered into between the parties and the matter has been amicably<\/p>\n<p>resolved leaving both the parties satisfied, there is every likelihood that the<\/p>\n<p>complainant would not come up before the trial Court to support the<\/p>\n<p>prosecution case, the chances of conviction of the petitioner are very bleak,<\/p>\n<p>therefore, the interest of justice would require that the FIR and all<\/p>\n<p>consequential proceedings arising therefrom be quashed.<\/p>\n<p id=\"p_5\">             A Larger Bench of this Court in the case of Kulwinder Singh<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Crl.Misc.No.M-12221 of 2009                                        -3-<\/span><\/p>\n<p>&amp; Ors. Vs. State of Punjab &amp; Anr. 2007(3) RCR (Criminal) 1052, while<\/p>\n<p>discussing the scope of quashing of prosecution on the basis of compromise,<\/p>\n<p>in exercise of powers under <a href=\"\/doc\/1679850\/\" id=\"a_4\">Section 482<\/a> Cr.P.C., even in non-compoundable<\/p>\n<p>offence(s), has held as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                   &#8220;28.    The compromise, in a modern society, is the sine<br \/>\n                   qua non of harmony and orderly behaviour. It is the soul<br \/>\n                   of justice and   if the power under <a href=\"\/doc\/1679850\/\" id=\"a_5\">Section 482<\/a> of the<br \/>\n                   Cr.P.C. is used to enhance such a compromise which, in<br \/>\n                   turn, enhances the social amity and reduces friction, then<br \/>\n                   it truly is &#8220;finest hour of justice&#8221;. Disputes which have<br \/>\n                   their genesis in a matrimonial discord, landlord-tenant<br \/>\n                   matters, commercial transactions and other such matters<br \/>\n                   can safely be dealt with by the Court by exercising its<br \/>\n                   powers under <a href=\"\/doc\/1679850\/\" id=\"a_6\">Section 482<\/a> of the Cr.P.C. in the event of<br \/>\n                   a compromise, but this is not to say that the power is<br \/>\n                   limited to such cases. There can never be any such rigid<br \/>\n                   rule to prescribe the exercise of such power, especially in<br \/>\n                   the absence of any premonitions to forecast and predict<br \/>\n                   eventualities which the cause of justice may throw up<br \/>\n                   during the course of a litigation.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                   29.     The only inevitable conclusion from the above<br \/>\n                   discussion is that there is no statutory     bar under     the<br \/>\n                   <a href=\"\/doc\/445276\/\" id=\"a_7\">Cr.P.C<\/a>. which can affect the inherent power of this Court<br \/>\n                   under <a href=\"\/doc\/1679850\/\" id=\"a_8\">Section 482<\/a>. Further, the same cannot be limited to<br \/>\n                   matrimonial cases alone and the Court has the wide<br \/>\n                   power    to    quash   the   proceedings     even     in   non-<br \/>\n                   compoundable offences notwithstanding the bar under<br \/>\n                   <a href=\"\/doc\/91933\/\" id=\"a_9\">Section 320<\/a> of the Cr.P.C., in order to prevent the abuse<br \/>\n                   of law and to secure the ends of justice.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">            Therefore, in view of the discussion above, since the parties<\/p>\n<p>have amicably settled the matter, which is otherwise in the interest of justice<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> Crl.Misc.No.M-12221 of 2009                                 -4-<\/span><\/p>\n<p>and appears to have been effected to promote peace and harmony amongst<\/p>\n<p>the parties, the instant petition is allowed.
