Judgment.\n<\/p>\n
            In this Criminal Revision, the petitioner has laid a<\/p>\n
challenge to the order dated 5.10.2001 passed by Shri Sukhdarshan<\/p>\n
Singh Khaira, the then Additional Sessions Judge, Moga whereby<\/p>\n
he granted permission to the prosecution for the withdrawal of<\/p>\n
prosecution of all the cases. Resultantly, all the accused in all the
\n             Criminal Revision No.1872 of 2001.\n<\/p>\n

cases were acquitted of the charges framed against them.<\/p>\n
           Briefly stated, the prosecution story in case State Versus<\/p>\n
Jagjit Singh is that the said case was registered on the statement of<\/p>\n
Nachhattar Singh son of Gurcharan Singh, resident of Rajeane,<\/p>\n
made before HC Surinder Singh on 16.12.1991 that he has four<\/p>\n
brothers and his father had one brother. His uncle Darbara Singh<\/p>\n
who was issueless used to reside with them in their house. He<\/p>\n
owned 9-1\/2 Killas of land and he died about 4 to 6 months prior to<\/p>\n
his making statement. Before his death, he executed a Will in<\/p>\n
favour of all the five brothers. On the day of Bhog ceremony of his<\/p>\n
uncle Darbara Singh, his widow Ranjit Kaur was brought to his<\/p>\n
house and since then she never came back. In the above-said land,<\/p>\n
wheat crop was sown. Gurmail Singh accused executed a sale deed<\/p>\n
in his favour to the extent of \u00bd share out of the share of Ranjit<\/p>\n
Kaur, widow of Darbara Singh and Gurmail Singh was asking<\/p>\n
them to deliver possession of the land in dispute.<\/p>\n
           On 15.12.1991, Nachhattar Singh along with his brother<\/p>\n
Jarnail Singh and his father Gulzara Singh (now deceased) went to<\/p>\n
their fields to irrigate the wheat crop, where his mother Gurdial<\/p>\n
Kaur, Harjit Kaur and his niece Sharanjit Kaur had gone to deliver<\/p>\n
their meals and started washing their clothes on the motor.\n<\/p>\n

Meantime, at about 1.00 PM, Sadhu Singh, Sarpanch, armed with .<\/p>\n
12 bore gun, Jagtar Singh, Gurmail Singh, Natha Singh and Harnek<\/p>\n
Singh armed with Gandasas, Avtar Singh with .315 bore rifle, Dev<\/p>\n
Singh with Takua, Charan Singh with Gandasa, Gurcharan Singh<\/p>\n
with Kasia, Jagjit Singh with .12 bore gun, Gopal Singh with<\/p>\n
Takua, came to their fields, in pursuance of their common<\/p>\n
intention. On reaching there, Jagtar Singh raised a Lalkara that<\/p>\n
they should not be spared and be taught a lesson for not delivering<\/p>\n
the possession of the land to them. In the meantime, Harnek Singh<\/p>\n
attacked the complainant and caused injuries on his head. He also<\/p>\n
gave a blow from the reverse side of the Gandasa on his head.<\/p>\n
Natha Singh gave two Gandasa blows causing injuries on the front<\/p>\n
side of his neck and left shoulder. Jagtar Singh also gave Gandasa<\/p>\n
blow to his brother Jarnail Singh which hit him on his right eye.<\/p>\n
He also gave another Gandasa blow which hit him on his cheek.<\/p>\n
Gurmail Singh accused gave Gandasa blows causing him injuries.<\/p>\n
Gurcharan Singh gave Kasia blow. Other accused also gave him<\/p>\n
injuries. Gurcharan Singh gave Takua blow which hit Paramjit<\/p>\n
Kaur on her hand. Gopal Singh caused injuries on the person of<\/p>\n
Gurdial Kaur. Sadhu Singh and Avtar Singh also fired in the air<\/p>\n
with their respective weapons. Jagjit Singh gave Butt blows to
\n             Criminal Revision No.1872 of 2001.\n<\/p>\n

Swaranjit Kaur. Manjit Kaur also received injuries caused with the<\/p>\n
Butt by Jagjit Singh. On raising of alarm by the complainant party,<\/p>\n
the accused ran away from the spot with their respective weapons.<\/p>\n
           The investigation was taken by the police. After<\/p>\n
completion of same, challan was presented against the accused.<\/p>\n
           Since a criminal complaint arising from the same<\/p>\n
occurrence was also filed, therefore, the State case and the<\/p>\n
Criminal Complaint were amalgamated and further proceedings<\/p>\n
were ordered to be held in the State challan.\n<\/p>\n
           The accused were charge-sheeted accordingly to which<\/p>\n
they pleaded not guilty and claimed trial.\n<\/p>\n
           Sessions Case State Versus Jarnail Singh etc. being off<\/p>\n
shoot of the main challan was also entrusted to the said Court.<\/p>\n
Charges under Sections 148<\/a>, 447<\/a> and 506<\/a> IPC were framed against<\/p>\n
the accused to which they pleaded not guilty and claimed trial.<\/p>\n
           The said cases were pending for prosecution evidence<\/p>\n
for more than nine years. The learned Addl. P.P moved<\/p>\n
applications under Section 321<\/a> Cr.P.C for withdrawal of the<\/p>\n
prosecution in both the cases, in public interest.<\/p>\n
           As noticed above, the applications were allowed vide<\/p>\n
the impugned order and the accused were acquitted.\n<\/p>\n
             Criminal Revision No.1872 of 2001.\n<\/p>\n

            Feeling aggrieved with the said order, Jarnail Singh,<\/p>\n
complainant in the complaint case has filed the instant Criminal<\/p>\n
Revision, challenging the correctness of said order.<\/p>\n
            The learned counsel for the petitioner has submitted that<\/p>\n
the Public Prosecutor has no authority to withdraw the complaint<\/p>\n
filed by the complainant. At the most, the Public Prosecutor can<\/p>\n
withdraw the State case. The learned trial Court has committed<\/p>\n
illegality by allowing the Public Prosecutor to withdraw the<\/p>\n
complaint filed by the complainant\/revisionist.<\/p>\n
            The State counsel could not controvert the above-said<\/p>\n
argument.\n<\/p>\n
            I have considered the submissions made by both sides<\/p>\n
and have gone through the record of the case.\n<\/p>\n
            So far the facts of the case are concerned, the same are<\/p>\n
not in dispute. The revisionist has filed a complaint which was<\/p>\n
being persued alongwith the State case. The State moved an<\/p>\n
application under Section 321<\/a> Cr.P.C for withdrawal of complaint<\/p>\n
case. The complaint as well as State case have to be tried together,<\/p>\n
in view of Section 210<\/a> Cr.P.C. At the most, the State could<\/p>\n
withdraw the case on the basis of FIR but has no authority to<\/p>\n
withdraw the complaint case. The learned trial Court has
\n              Criminal Revision No.1872 of 2001.\n<\/p>\n

committed illegality by dismissing the complaint also, at the<\/p>\n
instance of the Public Prosecutor.\n<\/p>\n
           Otherwise also, the Court has to see whether the request<\/p>\n
of the State under Section 321<\/a> Cr.P.C is genuine and in<\/p>\n
consonance      with     justice,    in    view   authorities   in   cases<\/p>\n
V.S.Achuthanandan Versus R. Balakrishna Pillai and others,<\/p>\n
(1994) 4 Supreme Court Cases 299 and Abdul Karim etc.etc. v.<\/p>\n
State of Karnataka and others etc.etc., AIR 2001 Supreme Court<\/p>\n
116. Since the revisionist has not challenged the withdrawal under<\/p>\n
Section 321<\/a> Cr.P.C by the State counsel in respect of State case, so<\/p>\n
this question is left open.\n<\/p>\n
           Consequently, this Criminal Revision stands accepted.<\/p>\n
The order dated 5.10.2001 passed by Shri Sudarshan Singh Khaira,<\/p>\n
the then Additional Sessions Judge, Moga vide which the<\/p>\n
complaint case has also been dismissed as withdrawn stands set<\/p>\n
aside and the complaint titled Jarnail Singh Versus Gurmail<\/p>\n
Singh and others, is ordered to be restored at its original number.<\/p>\n
The learned Additional Sessions Judge, Moga is directed to decide<\/p>\n
the said complaint case in accordance with law.<\/p>\n
           The complainant\/revisionist is directed to appear before<\/p>\n
the learned Additional Sessions Judge, Moga on 3.11.2008.\n<\/p>\n
