PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p id=\"p_1\">     Substitution allowed.\n<\/p>\n<p id=\"p_2\">     This appeal  by special  leave is\tfrom the judgment of<br \/>\nthe Patna High Court.  Ranchi Bench, made on may 2,  1996 in<br \/>\nLPA No. 14\/1996.\n<\/p>\n<p id=\"p_3\">     The admitted  facts  are  that  Maulana  Azad  college,<br \/>\nRanchi\testablished  in\t 1970  is  a  minority\tinstitution;<br \/>\nPursuant to  an agreement  dated December  15,\t1972, it was<br \/>\nagreed that  on new  posts shall  be created  in the college<br \/>\nwithout obtaining  prior permission  of the Vice-Chancellor.<br \/>\nTwo posts  were created\t by the Government Body on September<br \/>\n7, 1975.   One,\t Anup Narain  Singh and one Pandey Janardhan<br \/>\nPrasad were  appointed on  April 8,  1976.  Pandey Janardhan<br \/>\nPrasad ceased  to work\tfrom February 10,  1979. Thereafter,<br \/>\nthe first respondent, Syed Asad Raza came to be appointed on<br \/>\nJuly 1,\t 1979.\t The question  is whether the prior sanction<br \/>\nfrom Vice  Chancellor for  the post  to which syed Asad Raza<br \/>\ncame to\t be appointed is a pre-condition?  <a href=\"\/doc\/1900199\/\" id=\"a_1\">Section 35<\/a> of the<br \/>\nBihar state  <a href=\"\/doc\/890608\/\" id=\"a_1\">University Act<\/a>,  1976 has stepped in and states<br \/>\nthat:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8217;35 (1)  No  post\tfor  appointment<br \/>\n     shall be  created without the prior<br \/>\n     sanction of  the state  Government.<br \/>\n     Notwithstanding anything  contained<br \/>\n     in this  Act, no  University or any<br \/>\n     college  affiliated   to\tsuch   a<br \/>\n     University, except such College,\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     (a) as  is established,  maintained<br \/>\n     or\t  governed    by    the\t   state<br \/>\n     Government; or\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     (b)  as   is   established\t  by   a<br \/>\n     religious or linguistic minority;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     (i) After\tthe commencement of this<br \/>\n     Act. no  teaching\tor  non-teaching<br \/>\n     post      involving       financial<br \/>\n     liabilities   shall    be\t created<br \/>\n     without the  prior approval  of the<br \/>\n     state Government.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     (ii) Shall\t either increase the pay<br \/>\n     or allowance  attached to any post,<br \/>\n     or sanction any new allowance;<br \/>\n     Provided that  the state Government<br \/>\n     may, by  an order,\t revise that pay<br \/>\n     2scale attached  to  such\tpost  or<br \/>\n     sanction any new allowance.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>     2.\t    Notwithstanding\tanything<br \/>\n     contained in  this Act., no college<br \/>\n     other than\t one mentioned in clause\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>     (a) and  (b) of sub-section   (1) ,<br \/>\n     shall, after  the\tcommencement  of<br \/>\n     this Act, appoint any person on any<br \/>\n     post without  the prior approval of<br \/>\n     the state\tGovernment.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>     Provided that  the approval  of the<br \/>\n     state  Government\t shall\tnot   be<br \/>\n     necessary\t for\tfilling\t  up   a<br \/>\n     sanctioned post  of a teacher for a<br \/>\n     period not\t exceeding six months by<br \/>\n     a\t candidates    possessing    the<br \/>\n     prescribed qualification.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">     The reading  of the  above clearly\t indicate that after<br \/>\ncoming into force of the Bihar state <a href=\"\/doc\/890608\/\" id=\"a_2\">Universities Act<\/a>,\t1976<br \/>\nw.e.f. May  16, 1976,  t is enjoined that for appointed of a<br \/>\nteacher prior approval of the state Government is necessary.<br \/>\nHowever, exception have been engrafted in respect of (a) the<br \/>\ninstitution run by the state Government and (b)\t institution<br \/>\nestablished by a religious or linguistic minority.  Even the<br \/>\nnon-obstante clause in sub-section (2) also makes exceptions<br \/>\nto the\tclauses (a) and (b) of sub-section (1) of <a href=\"\/doc\/890608\/\" id=\"a_3\">Section 35<\/a><br \/>\nof the\tAct. Thus, it could be seen that for the creation of<br \/>\na post\tin minority institution for the appointment thereof,<br \/>\nprior approval\tof the\tUniversity  Vice-Chancellor  or\t the<br \/>\nstate Government  , is\tnot a  pre-condition.  The question,<br \/>\ntherefore, is:\twhether such  an appointee, first respondent<br \/>\nis to  the payment  of the  granted-in-aid.  By operation of<br \/>\nclause (1)  of <a href=\"\/doc\/1983234\/\" id=\"a_4\">Article\t30<\/a>, all minorities, whether based on<br \/>\nreligion or  language,\tshall have the right to establish an<br \/>\neducational institution\t of their  own choice.\tUnder clause<br \/>\n(2) of\t<a href=\"\/doc\/1983234\/\" id=\"a_5\">Article 30<\/a>,  the state shall not, in granting aid to<br \/>\neducational   institution,    discriminate    against\t any<br \/>\neducational institution\t on the\t ground that it is under the<br \/>\nmanagement of  a minority,  whether  based  on\treligion  or<br \/>\nlanguage.\n<\/p>\n<p id=\"p_5\">     Thus, It  could be\t seen that  on establishment  of  an<br \/>\neducational  institution  by  the  minority,  the  competent<br \/>\nauthority is  bound to sanction grant-in-aid subject to such<br \/>\nregulation as  may be  available under law to regulations as<br \/>\nmay be\tavailable under\t law to\t regulate the recruitment of<br \/>\nservice administration,\t use of\t fund etc. The contention of<br \/>\nShri B.B.  Singh, learned counsel for the appellant, is that<br \/>\npursuant to  the agreement  dated December  15, 1972   it is<br \/>\nnecessary  to\tobtain\tthe  prior  approval  of  the  Vice-<br \/>\nChancellor.   This agreement  was relevant  before the Bihar<br \/>\nstate <a href=\"\/doc\/890608\/\" id=\"a_6\">Universities  Act<\/a>, 1976 came into force. <a href=\"\/doc\/890608\/\" id=\"a_7\">After the Act<\/a><br \/>\nhas come into force, the agreement no longer subsists. Thus,<br \/>\nthe statute  operates in  the field so long as no regulation<br \/>\nhave been  made. By statutory  operation,  the respondent is<br \/>\nentitled to the payment of the grant-in-aid.\n<\/p>\n<p id=\"p_6\">     The appeal is, accordingly, dismissed.
