Central Bank of India, IIBI (now<br \/>\nassigned claim to IFCI) and Textile Labour Association. The claims<br \/>\nmade by the said 3 claimants are to the below mentioned extent.\n<\/p>\n<p id=\"p_8\">Sr.No.\n<\/p>\n<p id=\"p_9\">Name<br \/>\n\t\t\t\tof the Creditor.\n<\/p>\n<p id=\"p_10\">Amount<br \/>\n\t\t\t\tin Rs.\n<\/p>\n<p id=\"p_11\">1.<\/p>\n<p>Central<br \/>\n\t\t\t\tBank of India.\n<\/p>\n<p id=\"p_12\">16,02,04,845.74<\/p>\n<p id=\"p_13\">2.<\/p>\n<p>IIBI.\n<\/p>\n<p id=\"p_14\">6,46,23,683.00<\/p>\n<p id=\"p_15\">3.<\/p>\n<p>Textile<br \/>\n\t\t\t\tLabour Association.\n<\/p>\n<p id=\"p_16\">4,88,84,586.06<\/p>\n<p>\tIn<br \/>\nterms of ratio, it would come to approximately 58.53%, 23.61% and<br \/>\n17.86% respectively.\n<\/p>\n<p id=\"p_17\">2.1\tIn<br \/>\nanother report, the OL has also stated that, as of now, the Office of<br \/>\nthe OL has, in his hand, a sum of Rs.1,36,78,231=00. It is, however,<br \/>\nclaimed that out of the aforesaid amount, a sum of Rs.73,20,000=00 is<br \/>\nthe amount which is deposited by the Ahmedabad Municipal Corporation<br \/>\nby way of Earnest Money and that therefore, as per the submission of<br \/>\nlearned advocate for the OL, for the present, the said amount cannot<br \/>\nbe taken into account for the purpose of disbursement.\n<\/p>\n<p id=\"p_18\">2.2\tIn<br \/>\nthe result, the net amount available with the OL appears to be about<br \/>\nRs.63,00,000=00.\n<\/p>\n<p id=\"p_19\">3.\tAs<br \/>\nagainst the aforesaid position as regards the claim and amount<br \/>\navailable for disbursement, it transpires from the record that<br \/>\npursuant to the orders dated 24.1.2003 and 22.3.2010 passed by this<br \/>\nCourt, a sum of Rs.80,00,000=00 (Rs.50,00,000=00 plus<br \/>\nRs.30,00,000=00) has been disbursed in favour of the Central Bank of<br \/>\nIndia and a sum of Rs.55,00,000=00 (Rs.30,00,000=00 plus<br \/>\nRs.25,00,000=00) has been disbursed in favour of IIBI (IFCI Ltd.). It<br \/>\nis not in dispute that the aforesaid amounts have been disbursed on<br \/>\nad-hoc basis and according to the OL, the final ratio is yet to be<br \/>\ndetermined by the Chartered Accountant&#8217;s report. Thus, pending the<br \/>\nsaid report, the aforesaid amounts have been disbursed on ad-hoc<br \/>\nbasis. So far as workers represented by Textile Labour Association<br \/>\nare concerned, under the order dated 24.1.2003, a sum of<br \/>\nRs.30,00,000=00 has been disbursed.\n<\/p>\n<p id=\"p_20\">4.\tNow,<br \/>\nby virtue of present application, the workers claim disbursement for<br \/>\nfurther amount of Rs.30,00,000=00 on ad-hoc basis.\n<\/p>\n<p id=\"p_21\">5.\tIt<br \/>\nis clarified by the Office of OL that the amounts which have become<br \/>\navailable for disbursement until now have been released from sale of<br \/>\ncertain minor immovables and other movable properties and the land is<br \/>\nyet to be sold. The effect of the said submission is that substantial<br \/>\namount is yet to be realized, which may become available from sale of<br \/>\nthe land.\n<\/p>\n<p id=\"p_22\">6.\tMr.\n<\/p>\n<p id=\"p_23\">Gandhi, learned advocate for the IFCI, has submitted that as per the<br \/>\ntentative ratio which emerges from the extent of claims made by the 3<br \/>\nparties, it appears that the claim of financial institutions\/secured<br \/>\ncreditors and the workers is in proportion of about 4 : 1 and that<br \/>\ntherefore, the amount which was earlier paid to the workmen i.e.<br \/>\nRs.30,00,000=00 was sufficient and present disbursement would, as<br \/>\nsuch, be in excess of the entitlement of the workers, at this stage.<br \/>\nHowever, considering the fact that the amounts have been received by<br \/>\nthe OL since long and the workers claim have remained pending for<br \/>\nsubstantial long time mainly or solely on the ground that final ratio<br \/>\nfor disbursement is yet not settled and sale proceeds from the lands<br \/>\nare yet to be received whereas, on the other hand, certain sums are<br \/>\navailable for disbursement with the OL, below mentioned directions<br \/>\nhave been issued with a view to reducing the hardships of the<br \/>\nworkmen, atleast to some extent, who have total claim of about<br \/>\nRs.4.88 Cores and until now 30 lacs are disbursed and as per the<br \/>\nratio, they with 17.86% are close to IIBI (with 23.61%) who are paid<br \/>\n55 lacs by now.\n<\/p>\n<p id=\"p_24\">7.\tHaving<br \/>\nregard to the aforesaid factual background, particularly the amounts<br \/>\nalready disbursed in favour of the Central Bank of India and IIBI and<br \/>\ntaking into account that a sum of about Rs.60,00,000=00 is available<br \/>\nwith the OL for disbursement, it appears appropriate to allow<br \/>\ndisbursement upto Rs.25,00,000=00 in favour of workers on ad-hoc<br \/>\nbasis, subject to usual conditions on which the earlier disbursement<br \/>\nof Rs.30,00,000=00 was made viz. verification of claims, forms, date<br \/>\nof proof and above all, verification of identity. The union shall<br \/>\nidentify each of the workmen. Upon compliance of all usual and<br \/>\nroutine requirements to the satisfaction of OL, including the<br \/>\naforesaid aspects, a total sum of Rs.25,00,000=00 proportionate to<br \/>\nthe claim of each of the workmen may be disbursed by the Office of<br \/>\nOL. The aforesaid exercise, including the obligation on the part of<br \/>\nthe workmen to supply complete details to the satisfaction of the<br \/>\nOffice of OL, may be completed within period of 8 weeks from the date<br \/>\nof receipt of present order. In case of need, the OL is permitted to<br \/>\ngo for premature encashment of fixed deposits.\n<\/p>\n<p id=\"p_25\">7.1\tIt<br \/>\nis further clarified that in one of the reports filed by OL in<br \/>\nresponse to present application, certain directions, including<br \/>\npermission to appoint the Chartered Accountant for verification of<br \/>\nclaims received pursuant to the advertisement  and fixing upset price<br \/>\nfor sale of land, etc. is prayed for. However, the OL is permitted to<br \/>\nnominate the Chartered Accountant as per the earlier guidelines and<br \/>\nall other prayers made by the OL in its report is, for the present,<br \/>\ndeferred with liberty to the OL to take appropriate report for the<br \/>\nsame.\n<\/p>\n<p id=\"p_26\">8.\tIn<br \/>\nview of the fact that the ratio on the basis of Chartered<br \/>\nAccountant&#8217;s Report is yet to be worked out and that is an undisputed<br \/>\nposition, the relief prayed for in para (B) of present application<br \/>\nstands deferred since the same cannot be granted at this stage. So<br \/>\nfar as the relief prayed for in para (D) is concerned, the applicant<br \/>\nhas sought permission to delete the same. Permission, as sought for,<br \/>\nis granted.
