ADDL.PUBLIC\nPROSECUTOR for\nAppellant(s) : 1, \nNone for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/01\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.0<br \/>\nThe present appeal, under <a href=\"\/doc\/487026\/\" id=\"a_1\">section 378<\/a> of the Code of Criminal<br \/>\nProcedure, 1973, is directed against the judgment and order of<br \/>\nacquittal dated 20.5..2009 passed by the learned JMFC,Bhuj,  in<br \/>\nCriminal  Case No. 647\/1999  whereby the accused has been acquitted<br \/>\nof the charges under sec. 7(1)(5) and 2(1)(a) (a) (m)of the<br \/>\n<a href=\"\/doc\/32969400\/\" id=\"a_1\">Prevention of Food Adulteration Act<\/a>,  leveled against him.\n<\/p>\n<p id=\"p_1\">2.0<br \/>\nThe brief facts of the prosecution case are as under:\n<\/p>\n<p id=\"p_2\">2.1<br \/>\nIt is the case of the prosecution that Food Inspector Shri R.V.<br \/>\nDodia, on 9.8.1996 visited the shop of respondents-accused, and has<br \/>\ntaken the sample of  Buffalo Milk   and purchased the same and<br \/>\npaid the price,  and after following the procedure the sample was<br \/>\nsent to the Public Analyst, Vadodara for analysis and as per the<br \/>\nreport of the Public Analyst, the sample was found to be adulterated.<br \/>\nOn these facts, the complaint was filed before the Court, which was<br \/>\nnumbered as Criminal Case No. 647\/1999 against the respondent. At the<br \/>\ntime of trial, evidence was led before the trial Court. The documents<br \/>\nwere produced  and oral evidence of the witnesses were also recorded<br \/>\nby the trial Court and after considering the oral as well as<br \/>\ndocumentary evidence, the learned Magistrate has passed the order of<br \/>\nacquittal which is impugned in this appeal.\n<\/p>\n<p id=\"p_3\">3.0<br \/>\nIt was contended by learned APP  for the appellant that  the judgment<br \/>\nand order of the learned Magistrate is not proper, legal and it is<br \/>\nerroneous. He has also argued that the learned Magistrate has not<br \/>\nconsidered the evidence of the witnesses. He has argued that Food<br \/>\nInspector has followed the rules prescribed by law and he has also<br \/>\nfollowed the procedure of taking the sample and the contents of Form<br \/>\nNo. 6 etc are just and proper. The sample was seized and sealed<br \/>\nproperly. Yet, the learned Magistrate has not considered the evidence<br \/>\nof prosecution. Therefore, the order impugned in this appeal passed<br \/>\nby the learned Magistrate requires to be quashed and set aside.\n<\/p>\n<p id=\"p_4\">4.<br \/>\n\tIt is a settled legal position that in acquittal appeal, the<br \/>\nAppellate Court is not required to re-write the judgment or to give<br \/>\nfresh reasonings when the Appellate Court is in agreement with the<br \/>\nreasons assigned by the trial court acquitting the accused.  In the<br \/>\ninstant case, this Court is in full agreement with the reasons given<br \/>\nand findings recorded by the trial Court while acquitting the<br \/>\nrespondents- accused and adopting the said reasons and for the<br \/>\nreasons aforesaid, in my view, the impugned judgment is just, legal<br \/>\nand proper and requires no interference by this Court at this stage.<br \/>\nHence, this appeal requires to be dismissed.\n<\/p>\n<p id=\"p_5\">5.<br \/>\nEven in a recent decision of the Apex Court in the case of <a href=\"\/doc\/585040\/\" id=\"a_2\">State<br \/>\nof Goa V. Sanjay Thakran &amp; Anr. Reported<\/a> in (2007)3 SCC 75,<br \/>\nthe Court has reiterated the powers of the High Court in such cases.<br \/>\nIn para 16 of the said decision the Court has observed as under:\n<\/p>\n<p id=\"p_6\"> 16.<br \/>\nFrom the aforesaid decisions, it is apparent that while exercising<br \/>\nthe powers in appeal against the order of acquittal the Court of<br \/>\nappeal would not ordinarily interfere with the order of acquittal<br \/>\nunless the approach of the lower Court is vitiated by some manifest<br \/>\nillegality and the conclusion arrived at would not be arrived at by<br \/>\nany reasonable person and, therefore, the decision is to be<br \/>\ncharacterized as perverse. Merely because two views are possible, the<br \/>\nCourt of appeal would not take the<br \/>\nview which would upset the judgment delivered by the Court below.<br \/>\nHowever, the appellate court has a power to review the evidence if it<br \/>\nis of the view that the conclusion arrived at by the Court below is<br \/>\nperverse and the Court has committed a manifest error of law and<br \/>\nignored the material evidence on record. A duty is cast upon the<br \/>\nappellate court, in such circumstances, to re-appreciate the evidence<br \/>\nto arrive to a just decision on the basis of material placed on<br \/>\nrecord to find out whether any of the accused is connected with the<br \/>\ncommission of the crime he is charged with.\n<\/p>\n<p id=\"p_7\">6.<br \/>\nSimilar principle has been laid down by the Apex Court in the cases<br \/>\nof State<br \/>\nof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\nSCW 5553 and<br \/>\nin Girja<br \/>\nPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\nThus, the powers which this Court may exercise against an order of<br \/>\nacquittal are well settled.\n<\/p>\n<p id=\"p_8\">7.<br \/>\nIt is also a settled legal position that in acquittal appeal, the<br \/>\nappellate court is not required to re-write the judgment or to give<br \/>\nfresh reasonings, when the reasons assigned by the Court below are<br \/>\nfound to be just and proper. Such principle is laid down by the Apex<br \/>\nCourt in the case of State<br \/>\nof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417,<br \/>\nwherein,<br \/>\nit is held as under:\n<\/p>\n<p id=\"p_9\"> &amp;<br \/>\nThis court<br \/>\nhas observed in Girija<br \/>\nNandini Devi V. Bigendra Nandini Chaudhary (1967)1 SCR 93: (AIR 1967<br \/>\nSC 1124) that<br \/>\nit is not the duty of the appellate court when it agrees with the<br \/>\nview of the trial court on the evidence to repeat the narration of<br \/>\nthe evidence or to reiterate the reasons given by the trial court<br \/>\nexpression of general agreement with the reasons given by the Court<br \/>\nthe decision of which is under appeal,<br \/>\nwill ordinarily suffice.\n<\/p>\n<p id=\"p_10\">8.\tThus,<br \/>\nin case the appellate court agrees with the reasons and the opinion<br \/>\ngiven by the lower court, then the discussion of evidence is not<br \/>\nnecessary.\n<\/p>\n<p id=\"p_11\">9.\tI<br \/>\nhave gone through the judgment and order passed by the trial court. I<br \/>\nhave also perused the oral as well as documentary evidence led by the<br \/>\ntrial court and also considered the submissions made by learned<br \/>\nAdvocate for the appellant. The trial court while considering the<br \/>\noral as well as documentary evidence has clearly observed that the<br \/>\nprosecution has not followed the mandatory provisions during the<br \/>\nsealing and seizing the sample. The prosecution has failed to prove<br \/>\nits case beyond reasonable doubt. The Panch witness has turned<br \/>\nhostile. Even it shows that prosecution has failed to  follow the<br \/>\nprovision of Rule 22 of the Act , and sample taken by the complainant<br \/>\nwas  not taken as per the Rule 14 and prosecution has also not<br \/>\nfollowed the provision of <a href=\"\/doc\/56546430\/\" id=\"a_3\">Section 13(2)<\/a>. Nothing is produced or<br \/>\npointed out to rebut the conclusion of the Trial Court. Thus, from<br \/>\nthe evidence itself it is established that the prosecution has not<br \/>\nproved its case beyond reasonable doubt.\n<\/p>\n<p id=\"p_12\">10.\tLearned<br \/>\nAPP  for the appellant is not in a position to show any evidence to<br \/>\ntake a contrary view of the matter or that the approach of the trial<br \/>\ncourt is vitiated by some manifest illegality or that the decision is<br \/>\nperverse or that the trial court has ignored the material evidence on<br \/>\nrecord.\n<\/p>\n<p id=\"p_13\">11.<br \/>\nIn the above view of the matter, I am of the considered opinion that<br \/>\nthe trial court was completely justified in acquitting the respondent<br \/>\nof the charges leveled against him.\n<\/p>\n<p id=\"p_14\">12.<br \/>\nI find that the findings recorded by the trial court are absolutely<br \/>\njust and proper and in recording the said findings, no illegality or<br \/>\ninfirmity has been committed by it.\n<\/p>\n<p id=\"p_15\">13.\tI<br \/>\nam, therefore, in complete agreement with the findings, ultimate<br \/>\nconclusion and the resultant order of acquittal recorded by the court<br \/>\nbelow and hence find no reasons to interfere with the same. Hence the<br \/>\nappeal is hereby dismissed. R &amp; P to be sent back to the trial<br \/>\nCourt, forthwith.
