When thing'-Siigwstoodiih  \n20\/ 02\/ 2002 when he was...procgeedin_g' io1:.._hisiilbic5;Q1ie from his\ngarage towards his houseiiafter work on the\nextreme left side of .the_ V' following the\ntraffic rules and  'vtvh\u00e9niffgeicame near the spot of the\naccident ne.ar--VSam_bra' at that time the goods\ntruck bearing '--Regi.i  came from Kakati side i.e.,\n\nfrom opposite idi_rection_ diiiveniiby its driver in a rash and negligent\n\n4'rnanner\u00ab1\u00a7:\u00a7rith~a high-speec1_in a zig zag manner by overtaking the\n\nfronitivehiclve '\u00e91I1.(T\"\u20aclaSh\u20acd against the appellant, who was on his\n\nbicy'c1_e','i._Voni\"aecountiiof which he fell down and sustained multiple\n\nifractureni\ufb01njuriesfiand immediately he has been shifted to K.L.E.\n\n Belgaum, wherein he was an inpatient and has\n\n unde.rgone treatment for one month and undergone one surgery\n\nT and-\"implant has been inserted. On ,account of the injuries\n\n\n\nsustained in the road traffic accident he has filed a claim___petition\n\nunder Section 166 of Motor Vehicles Act, seeking conipensation\n\nagainst the respondent. The said claim petition  <\/pre>\n
consideration before the Tribunal, the,,,,T_ribu1f1al””iriftu’rn”.bygits\u00bb_<\/p>\n
impugned judgment and award after   i’o:’r’al”i’?1and<\/p>\n
documentary evidence and otherrelevant-material i’or1.._r_\u00a2Vcord has’<\/p>\n
allowed the same in part awarding \/- under
\ndifferent heads. The said  Tribunal is
\ninadequate and needs enha,n.ce.m.enit_i,iA& present appeal
\nis filed being   and award<\/p>\n
passed by the   ‘<\/p>\n
3. The V, principal :_ij,’suVbm”iss’ion canvassed by the learned<\/p>\n
counsel for app’ell_ant..Tat the’: outset is that, the Tribunal has<\/p>\n
:.’:commit’ted grave errormin awarding compensation only under<\/p>\n
me.:1_ic’al,_u’e:\u00a7pe,nses__ and other incidental expenses, pain and<\/p>\n
T V’-\u00ab’\u00bbsu.fferii1gs, lQ.Ssii’of’iamenities and loss of income due to disability-<\/p>\n
–  not awarisling any compensation under loss of future medical<\/p>\n
 ex’pie_11.ses’;_i without taking into consideration the duration of<\/p>\n
ii  .t_reatment, pain and agony suffered by appellant and discomforts,<\/p>\n
\/<\/p>\n
unhappiness throughout his life. Therefore, he submits that the<\/p>\n
compensation awarded in the impugned judgment andzaward<\/p>\n
passed by the Tribunal is to be enhanced by awardeiinug<\/p>\n
reasonable compensation.\n<\/p>\n
4. As against this, the learnedl*-counseililappearing for”<\/p>\n
respondents, interalia, contended  the ‘and award
\npassed by the Tribunal is neitjrist  and  does not call
\nfor interference. The Tribunal  the relevant
\nparticulars on the  aiv’iielaso’nable compensation.
\nHowever, the  for appellant fairly
\nsubmitted  enhancement in the award
\nhaving regard’ “to  sustained, duration of<\/p>\n
treatment, unhappinessand discomforts in accordance with law.<\/p>\n
 Aftcarefuil consideration of the submission made by<\/p>\n
i it Lvlvearned counsel’ appearing for both the parties, the only point that<\/p>\n
.. farises for our ieonsideration in the instant appeal is<\/p>\n
“Whether the compensation awarded by
\nTribunal is just and reasonable?”\n<\/p>\n

6. After perusal of the impugned judgment and award<\/p>\n
passed by the Tribunal, what emerges is that the Tribu-na’1._vhas<\/p>\n
committed a grave error in not awarding reasonable \u00a7compe’n.sa’tion<\/p>\n
towards pain and suffering, medical eXpen’sesu,:’conveyance;. <\/p>\n
nourishing food and attendant’s char.ges,—lossiof ~i.n”cor1’rie’ei.._c1u.:;;\u00b0ing .<\/p>\n
laid~up period, loss of unhappiness, discornforts;”loss_VVof_}future*<\/p>\n
income and future medical expenses’;V\u00ab.il.: not dispute that on
\naccount of the injuries   trafficuaccident as
\nstated supra, the _l_Z)octor__  of permanent
\nfunctional disability lforihparticulari  .+ihdii1~e% to the whole body
\nand the same   :ais.’:jus’tv.anld\u20acreasonable and it is not in
\ndispute.  treatment for more than
\none month ~u_n’de’rgone one surgery. The implant<\/p>\n
has been inserted.  hrnightihave spent some amount for medical<\/p>\n
:_’:’eS'{penses,i’conveyance, nourishing food and attendar1t’s charges on<\/p>\n
account or the.iini3’u_ry..sustained, he might have been advised by the<\/p>\n
l  \u00ab,Doctor take rest and medical follow~up treatment for a<\/p>\n
period of three months. We assess the income of appellant at the<\/p>\n
   LR:-.3,OO0\/– p.m., having regard to his age and occupation<\/p>\n
 and taking all these relevant factors into consideration, we<\/p>\n

Rs.97,200\/– {Rs.3,000 X 12 X 15 X 18\/ 100} as against Rs. 638,850\/–<\/p>\n
awarded by the Tribunal.\n<\/p>\n
8. The Tribunal has not awarded any compensation  <\/p>\n
future medical expenses. It is not in,”diis’pute’i..that appellant\u00bb 7.<\/p>\n
has undergone surgery and it requires one ‘more su_r.ge1:y~.an–di’o.ther<\/p>\n
incidental expenses. Taking this into ‘we deem
\nit fit to award Rs.10,000\/ to bepa1’*”tlie– future medicaal expenses,<\/p>\n
which will meet the ends ofjiusticei;  <\/p>\n
