Heard       learned       counsels       for   the<\/p>\n<p>                   petitioner, informant and the State.<\/p>\n<p id=\"p_1\">                             The   petitioner         is   apprehending     his<\/p>\n<p>                   arrest in a case registered under <a href=\"\/doc\/1599401\/\" id=\"a_1\">Sections<\/p>\n<p>                   341<\/a>, <a href=\"\/doc\/1243353\/\" id=\"a_1\">342<\/a>,<a href=\"\/doc\/1011035\/\" id=\"a_2\">323<\/a>,<a href=\"\/doc\/555306\/\" id=\"a_3\">504<\/a> of the I.P.C. and Section<\/p>\n<p>                   3(x)(iii)       of     S.C.        \/S.T.(Prevention       of<\/p>\n<p>                   Atrocities)Act.\n<\/p>\n<p id=\"p_2\">                             There is allegation of assault and<\/p>\n<p>                   abusing the informant&#8217;s side by calling his<\/p>\n<p>                   caste&#8217;s name.\n<\/p>\n<p id=\"p_3\">                             The petitioner has brought on record<\/p>\n<p>                   a   petition    of     compromise        which     has   been<\/p>\n<p>                   filed by the informant&#8217;s side which is being<\/p>\n<p>                   denied    by    the     learned         counsel    for   the<\/p>\n<p>                   informant.\n<\/p>\n<p id=\"p_4\">                             It    is     submitted        by   the    learned<\/p>\n<p>                   counsel for the petitioner that earlier also<\/p>\n<p>                   the informant&#8217;s side lodged a case in which<\/p>\n<p>                   the petitioner has been discharged.<\/p>\n<p id=\"p_5\">                             The   offence       in    which    non   bailable<\/p>\n<p>                   offence     alleged       is        under    S.C.\/S.       T.<\/p>\n<p>                   Prevention of Atrocities Act which is only<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 2<\/span><\/p>\n<p>        alleged against the petitioner for calling<\/p>\n<p>        by   his     caste&#8217;s        name     which   does    not   prima<\/p>\n<p>        facie        constitute            the       offence       under<\/p>\n<p>        S.C.\/S.T.(Prevention of Atrocities)Act.<\/p>\n<p id=\"p_6\">                     Considering the aforesaid facts, let<\/p>\n<p>        the petitioner above named, be released on<\/p>\n<p>        bail    in    the       event   of    arrest    or   surrender<\/p>\n<p>        before       the    learned        court     below   within      a<\/p>\n<p>        period       of     twelve         weeks     from    today    in<\/p>\n<p>        connection with Kishanganj P.S.Case No. 123<\/p>\n<p>        of     2010        on       furnishing       bail    bond     of<\/p>\n<p>        Rs.10,000\/-(Ten Thousand) with two sureties<\/p>\n<p>        of the like amount each to the satisfaction<\/p>\n<p>        of the learned C. J. M. Kishanganj,                    subject<\/p>\n<p>        to the conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_4\">Section<\/p>\n<p>        438(2)<\/a> of the Code of Criminal Procedure.<\/p>\n<pre id=\"pre_1\">U.
