The prayer in the present petition filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> Cr.P.C is for quashing of kalendra under <a href=\"\/doc\/534484\/\" id=\"a_1\">Section 182<\/a> of the Indian Penal Code titled State v. Surinder Singh S\/o Phuman Singh, pending in the Court of Chief Judicial Magistrate, Hoshiarpur.\n<\/p>\n<p id=\"p_2\">2. Briefly the facts are that the petitioner lodged an FIR No. 115 dated 9.7.1999 against respondents No. 2 &amp; 3 under <a href=\"\/doc\/838469\/\" id=\"a_2\">Sections 452<\/a>\/<a href=\"\/doc\/1947545\/\" id=\"a_3\">448<\/a>\/<a href=\"\/doc\/180217\/\" id=\"a_4\">506<\/a>\/<a href=\"\/doc\/1243353\/\" id=\"a_5\">342<\/a>\/<a href=\"\/doc\/839778\/\" id=\"a_6\">380<\/a>\/<a href=\"\/doc\/222396\/\" id=\"a_7\">427<\/a>\/<a href=\"\/doc\/763672\/\" id=\"a_8\">148<\/a>\/<a href=\"\/doc\/999134\/\" id=\"a_9\">149<\/a> IPC at P.S City Hoshiarpur. After investigation, the police submitted a cancellation report on 4.4.2000, which was ultimately accepted by the learned Magistrate vide order dated 4.1.2002. However, the petitioner being a complainant was given liberty to file a protest complaint in case, still aggrieved. It is admitted that the petitioner, thereafter, filed a complaint under <a href=\"\/doc\/763672\/\" id=\"a_10\">Sections 148<\/a>\/<a href=\"\/doc\/1947545\/\" id=\"a_11\">448<\/a>\/<a href=\"\/doc\/162506\/\" id=\"a_12\">447<\/a>\/<a href=\"\/doc\/838469\/\" id=\"a_13\">452<\/a>\/<a href=\"\/doc\/1243353\/\" id=\"a_14\">342<\/a>\/<a href=\"\/doc\/222396\/\" id=\"a_15\">427<\/a>\/<a href=\"\/doc\/839778\/\" id=\"a_16\">380<\/a>\/<a href=\"\/doc\/180217\/\" id=\"a_17\">506<\/a>\/<a href=\"\/doc\/999134\/\" id=\"a_18\">149<\/a> IPC on 31.1.2002 in which after recording preliminary evidence, respondents No. 2 &amp; 3 have already been summoned vide order dated 19.4.2002 and the case is still pending before the Magistrate. For the reason that the allegations made by the petitioner at the time of lodging FIR against respondents No. 2 &amp; 3 were found to be false and after investigation, cancellation report submitted by the police was accepted by the Court, the kalendra was prepared under <a href=\"\/doc\/534484\/\" id=\"a_19\">Section 182<\/a> IPC against the petitioner on 9.4.2002 and submitted before the Illaqa Magistrate.\n<\/p>\n<p id=\"p_3\">3. Keeping in view the fact that respondents No. 2 &amp; 3 had already been summoned in the private complaint filed by the petitioner, the petitioner on 5.7.2002, filed an application before the learned Chief Judicial Magistrate for dropping the proceedings initiated against him under <a href=\"\/doc\/534484\/\" id=\"a_20\">Section 182<\/a> IPC. While considering the application, vide order dated 15.11.2002, learned Magistrate clubbed the proceedings under <a href=\"\/doc\/534484\/\" id=\"a_21\">Section 182<\/a> IPC and also the complaint filed by the petitioner specifically recording that the private complaint filed by the petitioner on the same allegations is already pending in which respondents No. 2 &amp; 3 had already been summoned and the case was fixed for pre-charge evidence at that time and it could not be finally decided as to whether the offence under <a href=\"\/doc\/534484\/\" id=\"a_22\">Section 182<\/a> IPC had been committed by the petitioner or not.\n<\/p>\n<p id=\"p_4\">4. Keeping these facts in view, it was further opined that the kalendra cannot be proceeded with independently and the same was ordered to be clubbed with the complaint filed by the petitioner. With this observation, application filed by the petitioner for dropping the proceedings initiated against him under <a href=\"\/doc\/534484\/\" id=\"a_23\">Section 182<\/a> IPC was disposed of.\n<\/p>\n<p id=\"p_5\">5. Learned Counsel for the petitioner submitted that as the private complaint filed by the petitioner for the same offence is still pending, at this stage, it could not be opined that any offence under <a href=\"\/doc\/534484\/\" id=\"a_24\">Section 182<\/a> IPC had been committed by him for which he should be proceeded with on presentation of kalendra by the police. He relied on a judgment of this Court reported in <a href=\"\/doc\/95407049\/\" id=\"a_25\">Ramti Devi v. State of Punjab<\/a> 1998(1) RCR (Criminal), 385.\n<\/p>\n<p id=\"p_6\">6. Learned Counsel for the respondent submits that the kalendra prepared by the police is not being proceeded with as vide order dated 15.11.2002 passed by learned Magistrate, the same has been ordered to be clubbed with the complaint filed by the petitioner and shall be considered finally at the time of decision of the complaint.\n<\/p>\n<p id=\"p_7\">7. I have heard learned Counsel for the parties.\n<\/p>\n<p id=\"p_8\">8. In my opinion, in the facts and circumstances mentioned above, no case for quashing of kalendra is made out as the learned Magistrate is conscious of the fact that respondents No. 2 &amp; 3 have already been summoned in a private complaint filed by the petitioner and the kalendra against the petitioner under <a href=\"\/doc\/534484\/\" id=\"a_26\">Section 182<\/a> IPC is not being proceeded with independently and the same has already been clubbed with the complaint. The petitioner, under these facts, cannot have any grievance against the kalendra.\n<\/p>\n<p id=\"p_9\">9.
