Goyal, Advocate for the petitioners.\n<\/p>\n<p id=\"p_1\">            Navjeet Singh, Advocate for the respondent.\n<\/p>\n<p id=\"p_2\">                                &#8230;.\n<\/p>\n<p id=\"p_3\">RAJIVE BHALLA, J (Oral)<\/p>\n<p>            Prayer in this petition, filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of<\/p>\n<p>Criminal Procedure is for quashing of a complaint filed under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a><\/p>\n<p>of the Negotiable Instruments Act, 1881, and the summoning order dated<\/p>\n<p>15.6.2005 passed thereon.\n<\/p>\n<p id=\"p_4\">            Counsel for the petitioners submits that petitioner no.1&#8217;s bank<\/p>\n<p>statement clearly establishes that prior to the filing of the complaint, he has<\/p>\n<p>paid the amount of the offending cheque and as the ingredients of an<\/p>\n<p>offence under <a href=\"\/doc\/1823824\/\" id=\"a_2\">Section 138<\/a> of the Negotiable Instruments Act are not made<\/p>\n<p>out, the complaint and the summoning order be quashed. It is further<\/p>\n<p>submitted that during the pendency of this petition and pursuant to orders<\/p>\n<p>passed therein, petitioner no.1 has deposited a sum of Rs.10,000\/- before<\/p>\n<p>the trial Court. It is, therefore, prayed that in view of the aforementioned<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Crl.Misc.No.M-40964 of 2005                                           2<\/span><\/p>\n<p>facts, the present petition be allowed and the summoning order and the<\/p>\n<p>complaint be quashed.\n<\/p>\n<p id=\"p_5\">              Counsel for the respondent, however, submits that whether<\/p>\n<p>petitioner no.1 has or has not paid any amount, prior to the filing of the<\/p>\n<p>complaint, is a plea to be raised by the petitioner, in his defence before the<\/p>\n<p>trial Court. The respondent, however, emphatically denies that any amount<\/p>\n<p>was received before the filing of a complaint. It is, therefore, prayed that<\/p>\n<p>as argument addressed by counsel for petitioner no.1 relates to his defence,<\/p>\n<p>the present petition be dismissed.\n<\/p>\n<p id=\"p_6\">              I have heard learned counsel for the parties, perused the<\/p>\n<p>complaint, as also the impugned summoning order.<\/p>\n<p id=\"p_7\">              The petitioner&#8217;s   assertion that prior to the filing of the<\/p>\n<p>complaint, he has paid the entire amount referred to in the cheque, falls<\/p>\n<p>within the domain of his defence and should, therefore, be raised and<\/p>\n<p>adjudicated before the trial Court. The deposit of Rs.10,000\/- by petitioner<\/p>\n<p>no.1, pursuant to orders passed by this Court, would be taken into<\/p>\n<p>consideration by the trial Court, while deciding the complaint.            As<\/p>\n<p>argument raised by counsel for the petitioners relates to his defence, no<\/p>\n<p>ground is made out to quash the complaint and the summoning order in the<\/p>\n<p>exercise of     jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a> of the Code of Criminal<\/p>\n<p>Procedure.
