2. The appellants were the sons of the plaintiff in a suit<\/p>\n
for declaration  to the rigl\u00e9 of way over the defendant’s<\/p>\n
property and the defendant in turn had \ufb01ied a suit'”—-for<\/p>\n
injunction restraining the appeiiants herein from..interfe1s-iifigii” <\/p>\n
with the suit properties. There was no dis_p:_:te_:<\/p>\n

appeiiants were only seeking’i_’punderiiianiiagreenaenjt:nfhsaiei
\nwhere by they had been grantediiiipossessioni. “H.Qw_ei”ver, the
\ntriai court did not so  as there was
\nno controversy’iinififespectgoif:iposses_s.i:on  parties. The
\n a road as ciaimed by
\nthe  property. The trial court
\nhad, on  of the pieadings and the<\/p>\n
evigierice, found that apart from a stray entry in the record of<\/p>\n
.i ‘rights existence of a road which was in different ink<\/p>\n
‘-from  entries, there was no othet document to<\/p>\n
support the existence of a road which had been formed over<\/p>\n
“ii i.the*defendant’s property. In this regard, the Deputy Tahsildar<\/p>\n
__who was a witness in the case as PW.~4, had deposed that<\/p>\n
even if the entry is to be accepted as being genuine, there are<\/p>\n
no supporting documents, such as a Survey Sketch and the<\/p>\n
S<\/p>\n
Village Map, which would re\ufb02ect the existence of thee-toad<\/p>\n
over the defendant’s property. Further, the ernpha,tic.i” <\/p>\n
the appellant was that it is not in dispute that_the_ife..is  <\/p>\n
land in existence over the defendant_’s p-ropiertiyp and–itti  i .i<\/p>\n
kharab which forms a road or’-?eI’\u00ab-..the suit  Thep triali<\/p>\n
court however, has opined that_a’e.sencei of  iniclication
\nas to the nature of the’ the absence of
\ndescription ofithereof over the
\n description of the road
\nnameljfl    existence of the road
\non  evident or clear, it would be<\/p>\n
dangerous to gra_nt’sucl’i relief in favour of the appellants and<\/p>\n
, ‘has, on i,r1f1rrnities in the pl_ainti.ff’s case, dismissed the suit.<\/p>\n

theiiappeali by the lower appellate court. It is that which is<\/p>\n
