Suit No. 4832\/82 before the<br \/>\nSmall Causes Court, Ahmedabad for possession on various grounds<br \/>\nincluding the ground of sec. 12(3)(a) as well as sec. 13(1)(k)<br \/>\nregarding non-user.  The Small Causes Court, Ahmedabad, vide judgment<br \/>\nand order dated 30.1.1989 decreed the suit on appreciation of<br \/>\nevidence and defendant No. 1-petitioner herein was directed to hand<br \/>\nover possession.  Regular Civil Appeal No. 51\/89 came to be preferred<br \/>\nbefore the Appellate Bench of the Small Causes Court by the<br \/>\npetitioner herein, original defendant No. 1 (tenant). The said appeal<br \/>\ncame to be disposed of by the Appellate Bench of the Small Cause<br \/>\nCourt vide judgment and order dated 15.7.1997 confirming the order<br \/>\npassed by the trial court observing that the petitioner, original<br \/>\ndefendant No. 1 had not used the premises for more than six months<br \/>\nimmediately preceding the date of filing of the suit without any<br \/>\nreasonable cause and the evidence has been found to that effect. It<br \/>\nis also observed that there is no reason to disturb the findings<br \/>\ngiven by the trial Judge in respect of sec. 13(1)(k) of the Bombay<br \/>\nRent Act and there is a discussion based on the evidence with regard<br \/>\nto other aspects which have been confirmed by the Appellate Bench.\n<\/p>\n<p id=\"p_2\">3.\tThough<br \/>\nlearned counsel Mr. Gandhi appearing for the petitioner has made an<br \/>\neffort to submit referring to the judgment of both the courts below<br \/>\nthat they have failed to appreciate with regard to non-user, he<br \/>\nsubmitted that both the courts have misdirected considering the case<br \/>\nunder sec. 13(1)(k). He submitted that if it was a case of<br \/>\nsub-letting, then the question of non-user would not arise and both<br \/>\nthe courts below have failed to appreciate this aspect. He has also<br \/>\nreferred to the judgments and submitted that the documentary evidence<br \/>\nis also not appreciated. He submitted that the evidence of Yogeshbhai<br \/>\nthat somebody else is using the premises is accepted. Even in that<br \/>\ncase, it would be a case of subletting and not non-user and therefore<br \/>\nthis evidence has not been appreciated properly.  He submitted that<br \/>\neven with regard to non-user, both the courts below have failed to<br \/>\nappreciate that the small room was occupied and used by Bhagyoday<br \/>\nCotton Company and it cannot be said that there is any non-user. He<br \/>\nsubmitted that there was an agency for which business was carried on.\n<\/p>\n<p id=\"p_3\">4.\tThough<br \/>\nthe submissions have been made, in view of the clear findings on the<br \/>\nissues raised including the non-user which has been confirmed by the<br \/>\nAppellate Bench of the Small Causes Court which has been discussed in<br \/>\ndetail, there is no reason to interfere with the concurrent findings<br \/>\nof fact given by both the courts below with detailed discussion about<br \/>\nthe evidence.  Therefore, without any further elaboration,<br \/>\nconsidering the fact that the concurrent findings are given on<br \/>\nappreciation of evidence, which cannot be said to be perverse or<br \/>\nillegal or resulting into miscarriage of justice, the present<br \/>\nrevision application cannot be entertained.\n<\/p>\n<p id=\"p_4\">5.\tIt<br \/>\nis well-accepted that the scope of exercise of revisional<br \/>\njurisdiction is very limited.  The concurrent findings arrived at by<br \/>\nboth the courts below cannot be said to be perverse or illegal<br \/>\nresulting in any kind of irregularity or miscarriage of justice and<br \/>\ntherefore the present revision application deserves to be rejected<br \/>\nand accordingly stands rejected. Rule is discharged with no order as<br \/>\nto costs. Interim relief stands vacated.\n<\/p>\n<p id=\"p_5\">(Rajesh<br \/>\nH.
