He further submitted that the<br \/>\nage of the victim is 19 years and therefore as recorded in the<br \/>\nimpugned order of the Sessions Court, the bail may be granted. He<br \/>\nsubmitted that because of his young age the applicant tried to escape<br \/>\nfrom the hospital which was considered for rejection of the bail.<br \/>\nTherefore, considering this aspect subject to any condition, present<br \/>\napplication may be allowed.\n<\/p>\n<p id=\"p_3\">4.\tLearned<br \/>\nAPP Mr. Shivang G. Shukla resisted the application and submitted that<br \/>\nthe applicant has tried to escape from the hospital.\n<\/p>\n<p id=\"p_4\">5.\tHaving<br \/>\nheard the learned Advocate Mr. Shah for the applicant as well as<br \/>\nlearned APP and having considered the nature of offence, the manner<br \/>\nin which it is alleged to have been committed, role attributed and<br \/>\nconsidering the statement of the victim and other evidence, this<br \/>\nCourt is of the opinion that the present application<br \/>\ndeserves to be allowed subject to the conditions hereinafter.\n<\/p>\n<p id=\"p_5\">\t6.\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with the F.I.R. being CR<br \/>\n\tNo.I-78\/2010 has been registered with Limbayat Police Station,<br \/>\n\tSurat, on his executing a bond of Rs.5,000\/- (Rupees Five Thousand)<br \/>\n\twith one solvent surety of the like amount to the satisfaction of<br \/>\n\tthe lower Court and subject to the conditions that he shall:\n<\/p>\n<p id=\"p_6\">(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p id=\"p_7\">(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p id=\"p_8\">(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p id=\"p_9\">(d)\tmaintain<br \/>\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n<p id=\"p_10\">(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 PM till<br \/>\nthe trial commences;\n<\/p>\n<p id=\"p_11\">(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p id=\"p_12\">(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p id=\"p_13\">7.\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be  free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_14\">8.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p id=\"p_15\">9.\tRule<br \/>\n\tis made absolute to the aforesaid   extent.
