Balachandran, J.\n            --------------------------\n             W.P.(C)No.30668 of 2008 A\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">    Petitioner, who is the judgment debtor in E.P.<\/p>\n<p>No.132\/07 pending on the file of the Sub Court,<\/p>\n<p>Palakkad, has sought to get set aside the order<\/p>\n<p>dated 18.9.2008 in the said EP.        Order dated<\/p>\n<p>18.9.2008 reads thus:\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">        &#8220;Today no payment. Repeat arrest<br \/>\n        warrant to the respondent.&#8221;\n<\/p>\n<p id=\"p_3\">\n<p>From the above order, it can be understood that<\/p>\n<p>warrant had been issued earlier and some payments<\/p>\n<p>were made and it is for reason of not making any<\/p>\n<p>payment on subsequent posting date that arrest<\/p>\n<p>warrant was ordered to be repeated.\n<\/p>\n<p id=\"p_4\">    2.  It is contended before me by the learned<\/p>\n<p>counsel for the petitioner that even while ordering<\/p>\n<p>warrant in the first instance, there was no order<\/p>\n<p>passed by the execution court pursuant to the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 30668\/08              2<\/span><\/p>\n<p>objection of the petitioner regarding no means.<\/p>\n<p>According to him, no order issuing warrant could<\/p>\n<p>have   been  passed  without  an  order  entering a<\/p>\n<p>finding in favour of the petitioner\/judgment debtor<\/p>\n<p>regarding his means. The records produced along<\/p>\n<p>with this writ petition show that on 11.8.2006, the<\/p>\n<p>petitioner    has     deposited    Rs.80,000\/-   in<\/p>\n<p>Thathamangalam Service Co-operative Bank, which is<\/p>\n<p>the   decree   holder  bank;   that  thereafter   on<\/p>\n<p>3.9.2008, just after three weeks, he has made a<\/p>\n<p>deposit of another Rs.24,000\/- and that on the very<\/p>\n<p>next day, namely on 4.9.2008, he made two deposits<\/p>\n<p>respectively of Rs.20,000\/- and Rs.10,000\/- and<\/p>\n<p>those are evidenced by Exhibit P4 series photostat<\/p>\n<p>copies of receipts. These itself would show that he<\/p>\n<p>is one who is having means.   If at all there is any<\/p>\n<p>serious contention raised by the petitioner that at<\/p>\n<p>present he has no means, viz., after 4.9.2008 or<\/p>\n<p>even earlier to those deposits, he should have<\/p>\n<p>stated the reasons as to why Exhibit P4 series do<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 30668\/08               3<\/span><\/p>\n<p>not evidence his financial affluence and why he<\/p>\n<p>contends that he is having no means to discharge<\/p>\n<p>the balance debt. If at all the petitioner files<\/p>\n<p>objection before the execution court explaining all<\/p>\n<p>these, the court may enter a finding as regards<\/p>\n<p>his means before issuing warrant.       Till such an<\/p>\n<p>objection is filed, petitioner is not entitled to<\/p>\n<p>any relief.     If such a detailed objection is filed<\/p>\n<p>and   that    appears  to  have  any  merit  on   the<\/p>\n<p>application of the petitioner, the execution court<\/p>\n<p>may withdraw the warrant and conduct an enquiry<\/p>\n<p>into the plea of &#8220;no means&#8221; and pass appropriate<\/p>\n<p>orders.
