Shri Nikil J.\n<\/p>\n<p id=\"p_1\">Joshi, learned advocate appearing for  Shri Pradeep Patel, waives<br \/>\nservice of rule on behalf of the opponent.\n<\/p>\n<p id=\"p_2\">2.\tWith the consent of the<br \/>\nlearned advocates appearing for the respective parties, the present<br \/>\nMiscellaneous Civil Application is taken up for final hearing today.\n<\/p>\n<p id=\"p_3\">3.\tThe present Miscellaneous<br \/>\nCivil Application is filed by the applicant-original respondent to<br \/>\nmodify the order passed by this Court dated 28\/07\/2008 in Special<br \/>\nCivil Application No. 1207\/2008 to the extent directing the<br \/>\napplicant-original respondent to remain present before the leanred<br \/>\ntrial Court on 11\/11\/2008 for cross-examination by the respondent<br \/>\nherein as ordered by this Court in the aforesaid order.\n<\/p>\n<p id=\"p_4\">4.\tShri S.P. Majmudar, learned<br \/>\nadvocate appearing on behalf of the applicant has submitted that as<br \/>\nsuch even prior to the order passed in the aforesaid Special Civil<br \/>\nApplication, the applicant, who is to be cross-examined, has left<br \/>\nIndia and has gone to Canada and he is likely to return  to India on<br \/>\nor before 30\/10\/2008 and, therefore,  it is requested to modify the<br \/>\naforesaid order.\n<\/p>\n<p id=\"p_5\">5.\tConsidering the above, now<br \/>\nthe applicant-original respondent is directed to remain present<br \/>\nbefore the learned trial Court on 11\/11\/2008 for cross-examination by<br \/>\nthe respondent herein instead of 13\/08\/2008 as directed by this Court<br \/>\nin the aforesaid order.  Shri S.P. Majmudar, leanred advocate<br \/>\nappearing on behalf of the applicant to  inform the   applicant<br \/>\naccordingly with a clear understanding that no further time shall be<br \/>\ngranted and the applicant has to remain present before the learned<br \/>\ntrial Court on 11\/11\/2008 for his cross-examination.\n<\/p>\n<p id=\"p_6\">6.\tThe order passed by this<br \/>\nCourt dated 28\/07\/2008 in Special Civil Application No. 1207\/2008 is<br \/>\nmodified to the aforesaid extent.
