At the request of the learned advocate for the<br \/>\npetitioner, the matter is taken up for final disposal today to which<br \/>\nMr Pandya for the respondent has no objection.\n<\/p>\n<p id=\"p_2\">2.\tHeard<br \/>\nlearned advocate Mr I.A. Patel for the petitioner in all these<br \/>\nmatters and learned advocate Mr Yogen N Pandya for the respondents.\n<\/p>\n<p id=\"p_3\">3.\tThe<br \/>\npetitioner-Kalapi Restaurant, through its proprietor, is before this<br \/>\nCourt being aggrieved by the judgment and award dated 13.4.2010<br \/>\npassed by the learned Judge, Labour Court No.1, Ahmedabad in<br \/>\nReference (LCA) No.53 of 2005 whereby the learned Judge was pleased<br \/>\nto partly allow the reference and order reinstatement on the original<br \/>\npost with 25% backwages.\n<\/p>\n<p id=\"p_4\">4.\tThe<br \/>\nmatter was heard at length and the learned advocate for the<br \/>\npetitioner was given time to consult his client to find out an<br \/>\namicable settlement of the matter.\n<\/p>\n<p id=\"p_5\">5.\tLearned<br \/>\nadvocate Mr I.A. Patel produced a tabular statement showing the<br \/>\namount payable to each of the workmen. Learned advocate for the<br \/>\npetitioner invited the attention of the Court to the fact that one of<br \/>\nthe workmen has died. It goes without saying that the amount will be<br \/>\npaid to his heirs.\n<\/p>\n<p id=\"p_6\">6.\tLearned<br \/>\nadvocate Mr Pandya appearing for the respondent-workmen submitted<br \/>\nthat this amount  the workmen are entitled to get as per the order<br \/>\npassed by the learned Judge of the Labour Court. The learned advocate<br \/>\nfor the respondent-workmen also submitted that for agreeing to<br \/>\nsettlement, the petitioner-management must pay something in addition<br \/>\nto the amount payable.\n<\/p>\n<p id=\"p_7\">7.\tOn<br \/>\nlong drawn consultation with the petitioner-management by the learned<br \/>\nadvocate for the petitioner, the petitioner-management has come<br \/>\nforward with a proposal to pay Rs.10,000\/- in addition to the amount<br \/>\npayable as mentioned in the tabular statement. The learned advocate<br \/>\nfor the petitioner requested that the petitioner-management be<br \/>\ngranted some time and the facility of making the payment in<br \/>\ninstallments.\n<\/p>\n<p id=\"p_8\">8.\tThe<br \/>\nlearned advocate for the respondent-workmen submitted that looking to<br \/>\nthe ensuing Diwali festival, it would be in the fitness of things, if<br \/>\nthe petitioner-management is directed to pay the amount before<br \/>\nDiwali.\n<\/p>\n<p id=\"p_9\">9.\tTaking<br \/>\ninto consideration the rival submissions made by the learned advocate<br \/>\nfor the parties, it is deemed proper that the time as prayed for is<br \/>\ngranted of six weeks to the petitioner-management to pay the entire<br \/>\namount in two equal installments. It is directed that the<br \/>\npetitioner-management shall pay the first installment before Diwali<br \/>\ni.e. on or before 24th October 2011.\n<\/p>\n<p id=\"p_10\">10.\tWith<br \/>\nthese directions, the judgment and award dated  13.4.2010 passed by<br \/>\nthe learned Judge, Labour Court No.1, Ahmedabad in Reference (LCA)<br \/>\nNo.53 of 2005 is modified. The petition is disposed of with no order<br \/>\nas to costs. Rule is made absolute to the aforesaid extent.\n<\/p>\n<p id=\"p_11\">11.\tAt<br \/>\nthe request of learned advocate Mr Pandya for the respondents,<br \/>\nliberty is reserved in case of difficulty. At the request of Mr I.A.<br \/>\nPatel for the petitioner, it is clarified that this payment will be<br \/>\nin full and final satisfaction of the award.\n<\/p>\n<p id=\"p_12\">\t\t\t\t\t\t(RAVI<br \/>\nR.
