Challenge in these appeals is to the judgment of a Division Bench of<\/p>\n<p>the Allahabad High Court directing acquittal of the respondents.<\/p>\n<p>Respondent Sanjay Vishwakarma was convicted for offence punishable<\/p>\n<p>under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Section 302<\/a> of the Indian Penal Code, 1860 (in short the `<a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>&#8216;)<\/p>\n<p>whereas the other two accused persons were tried and convicted for the<\/p>\n<p>offence punishable under <a href=\"\/doc\/1560742\/\" id=\"a_2\">Section 302<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_3\">Section 34<\/a> IPC.\n<\/p>\n<p id=\"p_3\">2.    Learned Additional Sessions Judge, Basti had convicted the<\/p>\n<p>respondents who preferred three separate appeals before the High Court. By<\/p>\n<p>the impugned judgment the High Court directed their acquittal.<\/p>\n<p id=\"p_4\">3.    Prosecution version in a nutshell is as follows:\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      On 21.11.1998 Radhey Shyam Pandey was at his house situated at<\/p>\n<p>Avas Vikas Colony District Basti and his son Ajay Kumar alias Pintu<\/p>\n<p>returned back home from the city and told him that a scuffle took place<\/p>\n<p>between him on one hand and Sanjay Vishwakarma, Atul Singh and Brij<\/p>\n<p>Kishore Singh alias Dimple on the other in front of A P N Degree College;<\/p>\n<p>and at that time he was accompanied by Vikas Singh and Sunil Kumar<\/p>\n<p>Verma and that his opponents were in search of him in order to kill him.<\/p>\n<p>Then Radhey Shyam Pandey along with his son Ajay Kumar alias Pintu<\/p>\n<p>accompanied by Vikas Singh and Sunil Kumar went from his house in order<\/p>\n<p>to make a complaint to the principal of APN Degree College. When they<\/p>\n<p>reached near the PCO in the pavement leading to the main road accused<\/p>\n<p>Sanjay Vishwakarma, Brij Kishore Singh alias Dimple and Atu1 Singh<\/p>\n<p>sighting Ajay Kumar exhorted that he should be killed. Thereupon, Ajay<\/p>\n<p>Kumar intended to run away by turning, but Sanjay Vishwakarma fired at<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><br \/>\nhim with country made pistol and on receiving firearm injury Ajay Kumar<\/p>\n<p>fell down and all the three miscreants ran away on the motor cycle parked<\/p>\n<p>nearby. At that very time one Dina Nath Pandey and Udai Shankar Shukla<\/p>\n<p>reached there and tried to catch hold of the miscreants but they succeeded in<\/p>\n<p>making their escape good. Immediately thereafter Radhey Shyam Pandey<\/p>\n<p>and his wife Smt Anirudh Kumari took their injured son Ajay Kumar in a<\/p>\n<p>Jeep to the District Hospital, Basti. But by the time they reached the<\/p>\n<p>Hospital, injured Ajay Kumar succumbed to fatal injuries `sustained by him<\/p>\n<p>in the said incident. Then Radhey Shyam Pandey, father of the deceased<\/p>\n<p>went to the Police station Basti Kotwali, District Basti and lodged an FIR of<\/p>\n<p>the occurrence with the Police there at about 12.30 p.m. The Police<\/p>\n<p>registered a crime against the accused under <a href=\"\/doc\/1560742\/\" id=\"a_4\">section 302<\/a> IPC and started the<\/p>\n<p>investigation. After completing the investigation the Police submitted charge<\/p>\n<p>sheet against the accused accordingly.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">      As accused pleaded innocence, trial was held.\n<\/p>\n<p id=\"p_9\">\n      Prosecution examined eleven witnesses to further its case.         The<\/p>\n<p>respondents examined three witnesses to substantiate their claim of<\/p>\n<p>innocence. The trial court placed reliance on the evidence of Radhey Shyam<\/p>\n<p>Pandey (PW1) who was an eye witness and directed conviction.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      3<\/span><br \/>\n       In appeal the High Court primarily relied on four circumstances to<\/p>\n<p>direct acquittal.\n<\/p>\n<p id=\"p_10\">\n<p id=\"p_11\">       (1)    The presence of Radhey Shyam Pandey (PW1) was not<\/p>\n<p>established. If he was really an eye witness then in the hospital records the<\/p>\n<p>name of his wife Anirudh Kumari could not have been shown as the persons<\/p>\n<p>who brought the deceased to the hospital. Being an advocate, he was<\/p>\n<p>expected to be at his place of practice and not at home. (2) As he claimed<\/p>\n<p>that he was going to meet the principal at a distance of 1= K.M., he could<\/p>\n<p>not have needed a rickshaw for going to the college. Deceased was not a<\/p>\n<p>student of APN Degree College and therefore there was no question of<\/p>\n<p>making a grievance before the principal. (3) The site plan did not show the<\/p>\n<p>place from where he allegedly saw the occurrence or the place from where<\/p>\n<p>the shot was allegedly fired. (4) In the inquest report name of the accused,<\/p>\n<p>the nature of the weapon and the name of the assailants were not specifically<\/p>\n<p>mentioned. With these findings the direct acquittal was directed.<\/p>\n<p id=\"p_12\">4.     In support of the appeal learned counsel for the appellant stated that<\/p>\n<p>the reasonings indicated by the High Court to say the least are based on<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                      4<\/span><br \/>\nsurmises and conjectures. The law relating to the particulars to be indicated<\/p>\n<p>in the inquest report and the evidentiary value of the site plan have been<\/p>\n<p>completely lost sight of. The conclusions are contrary to the evidence on<\/p>\n<p>record.   It was specifically stated by PW1 that because the date of<\/p>\n<p>occurrence was on Saturday and there was a strike in the court, this aspect<\/p>\n<p>has been completely lost sight of. The mother of the deceased had also<\/p>\n<p>accompanied PW1 to the hospital and merely because her name is stated, it<\/p>\n<p>cannot be a ground to doubt the presence of PW1 at the spot of occurrence.<\/p>\n<p id=\"p_13\">5.    Learned counsel for the respondent-Sanjay submitted that the High<\/p>\n<p>Court has analysed the evidence.        The inherent inconsistencies in the<\/p>\n<p>evidence of PW1 and the relevant features which clearly established that he<\/p>\n<p>could not have been an eye witness. In the aforesaid position the impugned<\/p>\n<p>judgment does not warrant interference.\n<\/p>\n<p id=\"p_14\">6.    Learned counsel appearing for Dimple alias Brij Kishore Singh and<\/p>\n<p>Atul Singh submitted that these accused persons were convicted by<\/p>\n<p>application of <a href=\"\/doc\/37788\/\" id=\"a_5\">Section 34<\/a> IPC. The High Court has noted as to how <a href=\"\/doc\/37788\/\" id=\"a_6\">Section<\/p>\n<p>34<\/a> has no application to the facts of the case.\n<\/p>\n<p id=\"p_15\">\n<p><span class=\"hidden_text\" id=\"span_3\">                                       5<\/span>\n<\/p>\n<p id=\"p_16\">7.    We find ample substance in the plea of learned counsel for the<\/p>\n<p>appellant that the conclusions of the High Court are based on surmises and<\/p>\n<p>conjectures and hypothesis.      Mere non-mention of the names of the<\/p>\n<p>assailants or the nature of the weapon in the inquest report, cannot be a<\/p>\n<p>ground to discard the evidentiary value of PW1&#8217;s evidence.<\/p>\n<p id=\"p_17\">8.    Merely because the eye-witnesses are family members their evidence<\/p>\n<p>cannot per se be discarded. When there is an allegation of interestedness, the<\/p>\n<p>same has to be established. Mere statement that being relatives of the<\/p>\n<p>deceased they are likely to falsely implicate the accused cannot be a ground<\/p>\n<p>to discard the evidence which is otherwise cogent and credible. We shall<\/p>\n<p>also deal with the contention regarding interestedness of the witnesses for<\/p>\n<p>furthering the prosecution version. Relationship is not a factor to affect<\/p>\n<p>credibility of a witness. It is more often than not that a relation would not<\/p>\n<p>conceal actual culprit and make allegations against an innocent person.<\/p>\n<p>Foundation has to be laid if plea of false implication is made. In such cases,<\/p>\n<p>the court has to adopt a careful approach and analyse evidence to find out<\/p>\n<p>whether it is cogent and credible.\n<\/p>\n<p id=\"p_18\">\n<p><span class=\"hidden_text\" id=\"span_4\">                                      6<\/span>\n<\/p>\n<p id=\"p_19\">9.    <a href=\"\/doc\/1487227\/\" id=\"a_7\">In Dalip Singh and Ors. v. The State of Punjab<\/a> (AIR 1953 SC 364) it<\/p>\n<p>has been laid down as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             &#8220;A witness is normally to be considered independent<br \/>\n             unless he or she springs from sources which are likely to<br \/>\n             be tainted and that usually means unless the witness has<br \/>\n             cause, such as enmity against the accused, to wish to<br \/>\n             implicate him falsely. Ordinarily a close relation would<br \/>\n             be the last to screen the real culprit and falsely implicate<br \/>\n             an innocent person. It is true, when feelings run high<br \/>\n             and there is personal cause for enmity, that there is a<br \/>\n             tendency to drag in an innocent person against whom a<br \/>\n             witness has a grudge along with the guilty, but<br \/>\n             foundation must be laid for such a criticism and the mere<br \/>\n             fact of relationship far from being a foundation is often a<br \/>\n             sure guarantee of truth. However, we are not attempting<br \/>\n             any sweeping generalization. Each case must be judged<br \/>\n             on its own facts. Our observations are only made to<br \/>\n             combat what is so often put forward in cases before us as<br \/>\n             a general rule of prudence. There is no such general<br \/>\n             rule. Each case must be limited to and be governed by its<br \/>\n             own facts.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_20\">10.   The above decision has since been followed in <a href=\"\/doc\/674898\/\" id=\"a_8\">Guli Chand and Ors. v.<\/p>\n<p>State of Rajasthan<\/a> (1974 (3) SCC 698) in which <a href=\"\/doc\/406841\/\" id=\"a_9\">Vadivelu Thevar v. State of<\/p>\n<p>Madras<\/a> (AIR 1957 SC 614) was also relied upon.\n<\/p>\n<p id=\"p_21\">11.   We may also observe that the ground that the witness being a close<\/p>\n<p>relative and consequently being a partisan witness, should not be relied<\/p>\n<p>upon, has no substance. This theory was repelled by this Court as early as in<\/p>\n<p>Dalip Singh&#8217;s case (supra) in which surprise was expressed over the<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                      7<\/span><br \/>\nimpression which prevailed in the minds of the Members of the Bar that<\/p>\n<p>relatives were not independent witnesses. Speaking through Vivian Bose, J.<\/p>\n<p>it was observed:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             &#8220;We are unable to agree with the learned Judges of the<br \/>\n             High Court that the testimony of the two eyewitnesses<br \/>\n             requires corroboration. If the foundation for such an<br \/>\n             observation is based on the fact that the witnesses are<br \/>\n             women and that the fate of seven men hangs on their<br \/>\n             testimony, we know of no such rule. If it is grounded on<br \/>\n             the reason that they are closely related to the deceased<br \/>\n             we are unable to concur. This is a fallacy common to<br \/>\n             many criminal cases and one which another Bench of<br \/>\n             this Court endeavoured to dispel in &#8211; `<a href=\"\/doc\/1420504\/\" id=\"a_10\">Rameshwar v.<br \/>\n             State of Rajasthan<\/a>&#8216; (AIR 1952 SC 54 at p.59). We find,<br \/>\n             however, that it unfortunately still persists, if not in the<br \/>\n             judgments of the Courts, at any rate in the arguments of<br \/>\n             counsel.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_22\">12.   Again in <a href=\"\/doc\/32790580\/\" id=\"a_11\">Masalti and Ors. v. State of U.P<\/a>. (AIR 1965 SC 202) this<\/p>\n<p>Court observed: (p. 209-210 para 14):\n<\/p>\n<blockquote id=\"blockquote_2\"><p>             &#8220;But it would, we think, be unreasonable to contend that<br \/>\n             evidence given by witnesses should be discarded only on<br \/>\n             the ground that it is evidence of partisan or interested<br \/>\n             witnesses&#8230;&#8230;.The mechanical rejection of such evidence<br \/>\n             on the sole ground that it is partisan would invariably<br \/>\n             lead to failure of justice. No hard and fast rule can be<br \/>\n             laid down as to how much evidence should be<br \/>\n             appreciated. Judicial approach has to be cautious in<br \/>\n             dealing with such evidence; but the plea that such<br \/>\n             evidence should be rejected because it is partisan cannot<br \/>\n             be accepted as correct.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_6\">                                        8<\/span><\/p>\n<p id=\"p_23\">13.   To the same effect is the decisions in <a href=\"\/doc\/313314\/\" id=\"a_12\">State of Punjab v. Jagir Singh<\/a><\/p>\n<p>(AIR 1973 SC 2407), <a href=\"\/doc\/1829378\/\" id=\"a_13\">Lehna v. State of Haryana<\/a> (2002 (3) SCC 76) and<\/p>\n<p><a href=\"\/doc\/137587\/\" id=\"a_14\">Gangadhar Behera and Ors. v. State of Orissa<\/a> (2002 (8) SCC 381).<\/p>\n<p id=\"p_24\">14.   The above position was also highlighted in <a href=\"\/doc\/1033267\/\" id=\"a_15\">Babulal Bhagwan<\/p>\n<p>Khandare and Anr. v. State of Maharashtra<\/a> [2005(10) SCC 404] and in<\/p>\n<p><a href=\"\/doc\/1429015\/\" id=\"a_16\">Salim Saheb v. State of M.P<\/a>. (2007(1) SCC 699).\n<\/p>\n<p id=\"p_25\">\n<p id=\"p_26\">15.   So far as the non-mention of the name of PW1 who was<\/p>\n<p>accompanying the deceased to the hospital aspect is concerned, it is<\/p>\n<p>interesting that defence witness A.K. Singh (DW1) the Chief Pharmacist has<\/p>\n<p>clearly stated in his cross examination by the prosecution that in case an<\/p>\n<p>injured is accompanied by several persons to the hospital, only one&#8217;s name<\/p>\n<p>is recorded who is most close to the injured. He has also stated that besides<\/p>\n<p>his mother and others may have accompanied the deceased to the hospital.<\/p>\n<p>The presumptuous conclusion that merely because the name of the<\/p>\n<p>deceased&#8217;s mother was recorded in the medical records, PW1&#8217;s presence is<\/p>\n<p>ruled out is indefensible. Similarly PW1 has categorically stated that he did<\/p>\n<p>not go to Court because it was a Saturday and the lawyers were on strike for<\/p>\n<p>a particular reason. There was no cross examination even on this aspect.<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                      9<\/span><br \/>\nThe High Court&#8217;s conclusion that he was expected to be at the place of<\/p>\n<p>practice on the face of this stand shows non application of mind. The<\/p>\n<p>evidence of PW1 is credible, cogent and, therefore, the acquittal of Sanjay<\/p>\n<p>Vishvakarma as recorded by the High Court cannot be sustained and is set<\/p>\n<p>aside. So far as the other two persons are concerned, the High Court after<\/p>\n<p>analyzing the evidence of PW1 has categorically held that <a href=\"\/doc\/37788\/\" id=\"a_17\">Section 34<\/a> has no<\/p>\n<p>application.\n<\/p>\n<p id=\"p_27\"><a href=\"\/doc\/37788\/\" id=\"a_18\">Section 34<\/a> has been enacted on the principle of joint liability in the<\/p>\n<p>commission of a criminal act. The Section is only a rule of evidence and<\/p>\n<p>does not create a substantive offence. The distinctive feature of the Section<\/p>\n<p>is the element of participation in action. The liability of one person for an<\/p>\n<p>offence committed by another in the course of criminal act perpetrated by<\/p>\n<p>several persons arises under <a href=\"\/doc\/37788\/\" id=\"a_19\">Section 34<\/a> if such criminal act is done in<\/p>\n<p>furtherance of a common intention of the persons who join in committing<\/p>\n<p>the crime. Direct proof of common intention is seldom available and,<\/p>\n<p>therefore, such intention can only be inferred from the circumstances<\/p>\n<p>appearing from the proved facts of the case and the proved circumstances.<\/p>\n<p>In order to bring home the charge of common intention, the prosecution has<\/p>\n<p>to establish by evidence, whether direct or circumstantial, that there was plan<\/p>\n<p>or meeting of mind of all the accused persons to commit the offence for<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                      10<\/span><br \/>\nwhich they are charged with the aid of <a href=\"\/doc\/37788\/\" id=\"a_20\">Section 34<\/a>, be it pre-arranged or on<\/p>\n<p>the spur of moment; but it must necessarily be before the commission of the<\/p>\n<p>crime. The true contents of the Section are that if two or more persons<\/p>\n<p>intentionally do an act jointly, the position in law is just the same as if each<\/p>\n<p>of them has done it individually by himself. As observed in <a href=\"\/doc\/673120\/\" id=\"a_21\">Ashok Kumar<\/p>\n<p>v. State of Punjab<\/a> (AIR 1977 SC 109), the existence of a common intention<\/p>\n<p>amongst the participants in a crime is the essential element for application of<\/p>\n<p>this Section. It is not necessary that the acts of the several persons charged<\/p>\n<p>with commission of an offence jointly must be the same or identically<\/p>\n<p>similar. The acts may be different in character, but must have been actuated<\/p>\n<p>by one and the same common intention in order to attract the provision.<\/p>\n<p id=\"p_28\">16.   The Section does not say &#8220;the common intention of all&#8221;, nor does it<\/p>\n<p>say &#8220;and intention common to all&#8221;. Under the provisions of <a href=\"\/doc\/37788\/\" id=\"a_22\">Section 34<\/a> the<\/p>\n<p>essence of the liability is to be found in the existence of a common intention<\/p>\n<p>animating the accused leading to the commission of a criminal act in<\/p>\n<p>furtherance of such intention. As a result of the application of principles<\/p>\n<p>enunciated in <a href=\"\/doc\/37788\/\" id=\"a_23\">Section 34<\/a>, when an accused is convicted under <a href=\"\/doc\/1560742\/\" id=\"a_24\">Section 302<\/a><\/p>\n<p>read with <a href=\"\/doc\/37788\/\" id=\"a_25\">Section 34<\/a>, in law it means that the accused is liable for the act<\/p>\n<p>which caused death of the deceased in the same manner as if it was done by<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                      11<\/span><br \/>\nhim alone. The provision is intended to meet a case in which it may be<\/p>\n<p>difficult to distinguish between acts of individual members of a party who<\/p>\n<p>act in furtherance of the common intention of all or to prove exactly what<\/p>\n<p>part was taken by each of them. As was observed in <a href=\"\/doc\/865810\/\" id=\"a_26\">Ch. Pulla Reddy and<\/p>\n<p>Ors. v. State of Andhra Pradesh<\/a> (AIR 1993 SC 1899), <a href=\"\/doc\/37788\/\" id=\"a_27\">Section 34<\/a> is<\/p>\n<p>applicable even if no injury has been caused by the particular accused<\/p>\n<p>himself. For applying <a href=\"\/doc\/37788\/\" id=\"a_28\">Section 34<\/a> it is not necessary to show some overt act<\/p>\n<p>on the part of the accused.\n<\/p>\n<p id=\"p_29\">\n<p id=\"p_30\">17.   In the instant case, the High Court has rightly held that the evidence is<\/p>\n<p>not sufficient to bring in application of <a href=\"\/doc\/37788\/\" id=\"a_29\">Section 34<\/a> IPC. Therefore while<\/p>\n<p>allowing the appeal qua Sanjay Vishvakarma, the appeal is dismissed for the<\/p>\n<p>other two accused respondents.
