Justice P.Q.BARKATH ALI\n\n Dated :16\/06\/2010\n\n O R D E R\n            A.K.BASHEER &amp; P.Q.BARKATH ALI, JJ.\n            =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n                   M.A.C.A.No. 428 of 2004\n            =~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=~=\n           Dated this the 16th day of June, 2010\n\n                         JUDGMENT\n<\/pre>\n<p id=\"p_1\">Barkath Ali, J.\n<\/p>\n<p id=\"p_1\">      In this appeal under <a href=\"\/doc\/147367599\/\" id=\"a_1\">section 173<\/a> of the Motor<\/p>\n<p>Vehicles Act claimants in O.P.(MV) No.917\/1994 of the<\/p>\n<p>Motor Accidents Claims Tribunal, Mavelikara challenge the<\/p>\n<p>judgment and award of the Tribunal dated July 4, 2003<\/p>\n<p>awarding a compensation of Rs.1,69,000\/-         for the loss<\/p>\n<p>caused to them, on account of the death of Chellappan Nair<\/p>\n<p>in a motor accident.\n<\/p>\n<p id=\"p_2\">      2. The facts leading to this appeal in brief are these:-<\/p>\n<p>Deceased Chellappan Nair was aged 45 at the time of the<\/p>\n<p>accident and was earning Rs.2,000\/- per month as a Ticket<\/p>\n<p>Collector in a Cinema Theatre and also as an Agriculturist.<\/p>\n<p>On February 28, 1994 he was travelling in a Mini bus<\/p>\n<p>bearing registration KL-4\/A 7504 along National Highway<\/p>\n<p id=\"p_3\">47.   At about 8.45 a.m. when the bus reached near<\/p>\n<p>Karuvatta, it collided head on with a tanker lorry bearing<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA428\/2004                  2<\/span><\/p>\n<p>registration No. KL-8\/B 774. Chellappan Nair sustained<\/p>\n<p>serious injuries and he succumbed to the injuries sustained,<\/p>\n<p>while undergoing treatment in the Medical College<\/p>\n<p>Hospital, Alappuzha on the same day. The claimants are his<\/p>\n<p>wife, children and mother. According to the claimants, the<\/p>\n<p>accident occurred due to the negligence on the part of the<\/p>\n<p>first respondent, driver of the offending bus. The first<\/p>\n<p>respondent as the driver, second respondent as the owner<\/p>\n<p>and third respondent as the insurer of the offending bus are<\/p>\n<p>jointly and severally liable to pay the compensation to the<\/p>\n<p>claimants, who are the dependents and legal heirs of the<\/p>\n<p>deceased. Respondents 4 to 6 are owner, driver and insurer<\/p>\n<p>respectively of the tanker lorry involved in the accident. The<\/p>\n<p>claimants claimed compensation of Rs. 3,50,000\/-.<\/p>\n<p id=\"p_4\">       3. Respondents 1 and 2, driver and owner of the<\/p>\n<p>offending bus, filed a joint written statement, admitting the<\/p>\n<p>accident, but contended that the accident occurred due to<\/p>\n<p>the negligence on the part of the driver of the tanker lorry.<\/p>\n<p>Respondents 3 and 6, insurer of the bus as well as that of<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA428\/2004                  3<\/span><\/p>\n<p>the tanker lorry,    filed written statement admitting the<\/p>\n<p>policy of the respective vehicles. Respondents 4 and 5, the<\/p>\n<p>driver and owner of the tanker lorry involved in the<\/p>\n<p>accident, remained absent before the Tribunal.<\/p>\n<p id=\"p_5\">       4. PWs.1 and 2 were examined and Exts. A1 to A9<\/p>\n<p>were marked on the side of the claimants. No evidence was<\/p>\n<p>adduced on the side of the respondents. The Tribunal, on an<\/p>\n<p>appreciation of the evidence, found that the accident<\/p>\n<p>occurred due to negligence of first respondent, driver of the<\/p>\n<p>offending bus, and awarded a compensation of Rs.1,69,000\/-<\/p>\n<p>with interest at the rate of 9% p.a. from the date of petition<\/p>\n<p>till realization against respondents 1 to 3. The claimants<\/p>\n<p>have come up in appeal, challenging the quantum of<\/p>\n<p>compensation awarded by the Tribunal.\n<\/p>\n<p id=\"p_6\">       5. During the pendency of the O.P. fourth respondent,<\/p>\n<p>mother of the deceased, died. Her legal heirs were<\/p>\n<p>impleaded as Addl. respondents 7 to 9.\n<\/p>\n<p id=\"p_7\">       6. Heard the learned counsel for the appellants and<\/p>\n<p>the learned counsel for respondents 1 and 3.<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">MACA428\/2004                   4<\/span><\/p>\n<p id=\"p_8\">      7. The accident is not disputed. The finding of the<\/p>\n<p>Tribunal that the accident occurred due to the negligence<\/p>\n<p>on the part of the first respondent, driver of the offending<\/p>\n<p>bus, is not challenged in this appeal. Therefore, the only<\/p>\n<p>question, which arises for consideration, is whether the<\/p>\n<p>claimant is entitled to any enhanced compensation ?<\/p>\n<p id=\"p_9\">      8. The Tribunal awarded a total compensation of<\/p>\n<p>Rs.1,69,000\/-. Break up of the compensation awarded is as<\/p>\n<p>under:-\n<\/p>\n<pre id=\"pre_1\">      Pain and suffering               :    Rs. 15,000\/-\n      Funeral and transportation       :    Rs.     6,000\/-\n      Expenses.\n      Loss of consortium and           :    Rs. 18,000\/-\n      loss of love and affection.\n      Total pecuniary loss suffered.   :    Rs.1,80,000\/-\n                                            ------------------\n          Total                        :    Rs.2,19,000\/-\n                                            ========\n\n<\/pre>\n<p id=\"p_10\">      9. The learned counsel for the appellants mainly<\/p>\n<p>sought enhancement of compensation awarded by the<\/p>\n<p>Tribunal for the loss of dependency.\n<\/p>\n<p id=\"p_11\">      10. The Tribunal took the monthly income of the<\/p>\n<p>deceased as Rs.2,200\/- and after deducting 1\/3 for his<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">MACA428\/2004                   5<\/span><\/p>\n<p>personal   expenses,   took    Rs.1,500\/-  as   his  monthly<\/p>\n<p>contribution to his family and adopted a multiplier of 10<\/p>\n<p>and awarded a compensation of Rs.1,80,000\/- for loss of<\/p>\n<p>dependency. Ext.A6,certificate issued by the proprietor,<\/p>\n<p>K.R. Talkies, shows that the deceased was given a salary of<\/p>\n<p>Rs.2,000\/- per month. Therefore, the Tribunal is perfectly<\/p>\n<p>justified in taking his monthly income as Rs.2,200\/- and<\/p>\n<p>after deducting1\/3rd for his personal expenses, taking<\/p>\n<p>Rs.1,500\/- as his monthly contribution to his family.<\/p>\n<p>Deceased Chellappan Nair was aged 49 at the time of the<\/p>\n<p>accident. Therefore, the proper multiplier that has to be<\/p>\n<p>adopted in this case is 15. Thus for the loss of dependency,<\/p>\n<p>the claimants are entitled to the compensation of<\/p>\n<p>Rs.2,70,000\/- (Rs.1,500\/- x 12 x 15). Thus, on this count, the<\/p>\n<p>claimants are entitled to an additional compensation of<\/p>\n<p>Rs.90,000\/-. As regards the compensation awarded under<\/p>\n<p>other heads, we find the same to be reasonable and,<\/p>\n<p>therefore, are not disturbing the same. The apportionment<\/p>\n<p>fixed by the Tribunal will stand.\n<\/p>\n<p id=\"p_12\"><span class=\"hidden_text\" id=\"span_4\">MACA428\/2004                  6<\/span><\/p>\n<p id=\"p_13\">      11. In the result, the claimants are entitled to an<\/p>\n<p>additional compensation of Rs.90,000\/- with interest at 9%<\/p>\n<p>p.a. from the date of petition till realization with<\/p>\n<p>proportionate costs. The third respondent Insurance<\/p>\n<p>Company shall deposit the amount within two months from<\/p>\n<p>the date of receipt of a copy of this judgment with notice to<\/p>\n<p>the claimants.
