BHARUCHA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     The respondent  instituted Title  Suit No.6 of 1974 for<br \/>\neviction of the appellant on ground of default in payment of<br \/>\nrent. That suit was dismissed on 31.1.1978. The first appeal<br \/>\npreferred  by  the  respondent\tbefore\tthe  District  Judge<br \/>\nsucceeded vide\tjudgment  and  order  dated  31.3.1979.\t The<br \/>\nappellant filed\t second appeal\tin  the\t High  Court,  being<br \/>\nSecond Appeal  No. 404\tof 1979. During the pendency of that<br \/>\nappeal, landlord  &#8211; respondent\tfiled an  application  under<br \/>\nSection 15  of the  Bihar Building  Control Act (hereinafter<br \/>\nthe Act)  for deposit  of arrears of rent accumulated during<br \/>\npendency of  the appeal\t and future rent during the pendency<br \/>\nof the appeal. An order came to be made by the High Court on<br \/>\n25.9.1979 to  deposit the arrears of rent by 15.11.1979. The<br \/>\nappellant,  however,   deposited  the  arrears\tof  rent  on<br \/>\n9.2.1980 and  that amount  was subsequently withdrawn by the<br \/>\nrespondent &#8211;  landlord. While  the second appeal was pending<br \/>\nin the\tHigh Court, the respondent instituted Title Suit No.<br \/>\n100 of\t1980 seeking eviction of the appellant on the ground<br \/>\nthat during  the pendency  of the  appeal in  the High Court<br \/>\narising out  of the  earlier suit,  the\t appellant  had\t not<br \/>\ncomplied with the direction of the High Court to deposit the<br \/>\nrent mad  eon 25.9.1979, in the application under Section 15<br \/>\nof the\tAct within  the prescribed  time  and  was  thus  in<br \/>\ndefault in payment to arrears of rent and, therefore, liable<br \/>\nto be  evicted. The  appellant contested the suit and in his<br \/>\nwritten\t statement  inter-alia\traised\tthe  plea  that\t the<br \/>\ndefault in the deposit of rent pursuant to the orders passed<br \/>\nby the High Court in the application under Section 15 of the<br \/>\nAct within  the prescribed  period could not be a ground for<br \/>\nhis eviction.  It was also averred that since the respondent<br \/>\nhad withdrawn  the rent\t amount, we  had waived her right to<br \/>\ncomplain about\tthe delayed deposit of rent. The trial court<br \/>\ndecreed title  suit No.\t 100 of 1980 on 29.3.1985. An appeal<br \/>\nfiled  by  the\tappellant  before  the\tDistrict  Judge\t was<br \/>\ndismissed on  10.5.1990. His second appeal failed before the<br \/>\nHigh Court on 6.2.1991. Hence this appeal by special leave.\n<\/p>\n<p id=\"p_1\">     We have  heard learned counsel for the parties and gone<br \/>\nthrough the  records. The consequence of non-compliance with<br \/>\na direction made under Section 15 of the Act is contained in<br \/>\nSection 15(1)  of the Act. The court could order the defence<br \/>\nagainst ejectment  to be  struck off and to place the tenant<br \/>\nin the\tsame position as if he had not defended the claim to<br \/>\nejectment in  the matter or cause in which the direction was<br \/>\nmade. For  non-compliance of  the direction  in\t the  second<br \/>\nappeal, recourse could not be had to seeking ejectment under<br \/>\nSection 11  of the Act. Delay in the deposit of trend is not<br \/>\ncovered by  Section 11\tof the\tAct, particularly  after the<br \/>\nrent was  withdrawn without demur by the landlord. The trial<br \/>\ncourt, the  first appellate court and the High Court fell in<br \/>\nerror in  not noticing\tthe distinction between the remedies<br \/>\navailable under\t Section 11  of the  Act and those available<br \/>\nfor non-compliance  with the  directions under Section 15 of<br \/>\nthe Act.  The courts  below ought to have held that the suit<br \/>\nfor eviction  was not maintainable on the ground of delay in<br \/>\ndeposit of  rent in violation of the directions given in the<br \/>\nsecond appeal  arising out  of Title Suit No. 6 of 1974. The<br \/>\nimpugned  order,   under  the\tcircumstances,\t cannot\t  be<br \/>\nsustained. Consequently,  we allow this appeal and set aside<br \/>\nthe impugned  order.
