A re&#8217;sume&#8217; of facts absolutely necessary and germane for the disposal<br \/>\nof this second appeal as stood exposited from the records could be portrayed<br \/>\nthus:\n<\/p>\n<p id=\"p_2\">\tThe respondents herein filed a suit in O.S.No.632 of 1987 on the file of<br \/>\nthe Additional District Munsif, Tirunelveli, praying to declare them as the<br \/>\nabsolute owners of the immovable property described in the schedule of the<br \/>\nplaint and for delivery of possession and other consequential reliefs.\n<\/p>\n<p id=\"p_3\">\t3. The quintessence of the case of the plaintiffs is that one Malaiyandi,<br \/>\nin respect of the suit property executed a settlement deed dated 11.11.1960 in<br \/>\nfavour of his paternal grand son Shanmugasundaram, so to say, the son of the<br \/>\ndefendant Paradesi.  The first plaintiff happened to be the wife of the deceased<br \/>\nShanmugasundaram, the second plaintiff is their minor daughter.\n<\/p>\n<p id=\"p_4\">\t4. It is the case of the plaintiffs that during the life time of<br \/>\nShanmugasundaram, the settlement deed came into force and it was acted upon.<br \/>\nHowever subsequent to the untimely death of Shanmugasundaram, the defendant<br \/>\nherein having some disagreement with the first plaintiff usurped the suit<br \/>\nproperty.  Hence, the suit.\n<\/p>\n<p id=\"p_5\">\t5. Per contra, denying and disputing, refuting and challenging the<br \/>\naverments\/allegations in the plaint, the defendant filed the written statement<br \/>\non the main ground that the alleged settlement deed is void ab initio as it<br \/>\ncannot be taken as a legal document for want of acceptance on behalf of their<br \/>\nminor Shanmugasundaram.  Various other points also were raised including the<br \/>\npecuniary jurisdiction.\n<\/p>\n<p id=\"p_6\">\t6. The trial Court framed various issues.  During trial, on the side of<br \/>\nthe plaintiffs, P.W.1 and P.W.2 were examined and Exs.A.1 to A.6 were exhibited<br \/>\nand on the side of the defendant, D.W.1 to D.W.3 were examined and Exs.B.1 to<br \/>\nB.8 were exhibited and ultimately the trial Court decreed the suit.\n<\/p>\n<p id=\"p_7\">\t7. Being aggrieved by and dissatisfied with, the Judgment and Decree of<br \/>\nthe trial Court, A.S.No.34 of 1996 on the file of Principal Sub Court,<br \/>\nTirunelveli, was filed reiterating the grounds as found set out in the written<br \/>\nstatement of the defendant.\n<\/p>\n<p id=\"p_8\">\t8. The appellate Court confirmed the Judgment and Decree of the trial<br \/>\nCourt as against which the present Second Appeal has been filed reiterating the<br \/>\nsame law point relating to the validity of the settlement deed.\n<\/p>\n<p id=\"p_9\">\t9. At the time of admitting this second appeal, my learned predecessor<br \/>\nframed the following substantial questions of law:<br \/>\n\t&#8220;1.When the settlement deed is not accepted by the donee during the life<br \/>\ntime of the donor and being thus void, are the Courts below correct in decreeing<br \/>\nthe suit on the basis of this settlement deed?\n<\/p>\n<p id=\"p_10\">\t2. Are the Courts below correct in decreeing the suit on the basis of<br \/>\nsettlement deed Ex.A.1 which was executed in favour of a minor without being<br \/>\nrepresented by a guardian?\n<\/p>\n<p id=\"p_11\">\t3. Are the Courts below right in decreeing the suit on the basis that no<br \/>\naction has been taken by the defendant to set aside the settlement deed which is<br \/>\na void document?\n<\/p>\n<p id=\"p_12\">\t4. Are the Courts below correct in decreeing the suit when the suit is not<br \/>\nmaintainable before the District Munsif Court, Tirunelveli for want of pecuniary<br \/>\njurisdiction?&#8221;\n<\/p>\n<p id=\"p_13\">\t10. Heard both sides.\n<\/p>\n<p id=\"p_14\">\t11. The learned Counsel for the appellant by placing reliance on the same<br \/>\nlaw point agreed that even though the impugned settlement deed dated 11.11.1960<br \/>\nwas nomenclatured as settlement deed, yet in stricto sensu, it was a donation<br \/>\ndeed and accordingly, it was bad for want of acceptance on behalf of the then<br \/>\nminor beneficiary Shanmugasundaram.  The learned Counsel for the appellant would<br \/>\nsubmit that he is not particular in pressing for the law point relating to<br \/>\npecuniary jurisdiction.\n<\/p>\n<p id=\"p_15\">\t12. Per contra, the learned counsel for the respondents\/plaintiffs would<br \/>\ncontend that a mere perusal of Ex.A.1 would demonstrate and convey the fact that<br \/>\nit is a settlement deed and not a donation deed.\n<\/p>\n<p id=\"p_16\">\t13. Perused the Ex.A1, which would show that it was written only as a<br \/>\nsettlement deed and registered also as such and there is nothing to show that it<br \/>\nhas to be treated as a donation deed under the <a href=\"\/doc\/515323\/\" id=\"a_1\">Transfer of Property Act<\/a>.\n<\/p>\n<p id=\"p_17\">\t14. <a href=\"\/doc\/108111388\/\" id=\"a_1\">Section 2(24)<\/a> of the Indian Stamp Act, 1899, is extracted here under<br \/>\nfor ready reference:\n<\/p>\n<p id=\"p_18\">\t&#8220;2(24).Settlement.- &#8220;settlement&#8221; means any non-testamentary disposition,<br \/>\nin writing, of movable or immovable property made &#8211;\n<\/p>\n<p id=\"p_19\">\t(a) in consideration of marriage,\n<\/p>\n<p id=\"p_20\">\t(b) for the purpose of distributing property of the settler among his<br \/>\nfamily or those for whom he desires to provide, or for the purpose of providing<br \/>\nfor some person dependent on him, or\n<\/p>\n<p id=\"p_21\">\t(c) for any religious or charitable purpose;\n<\/p>\n<p id=\"p_22\">and includes an agreement in writing to make such a deposition [and, where any<br \/>\nsuch disposition has not been made in writing, any instrument recording, whether<br \/>\nby way of declaration of trust or otherwise, the terms of any such<br \/>\ndisposition.]&#8221;\n<\/p>\n<p id=\"p_23\">\t15. Ex.A.1 is covered by sub-clause (b) cited supra.  Indubitably and<br \/>\nindisputably, incontrovertibly and admittedly, Shanmugasundaram happened to be<br \/>\nthe son of the defendant herein and accordingly, he is the paternal grand son of<br \/>\nthe settler and in such a case, it could rightly be taken that he was the close<br \/>\nrelative of the settler and in such a case, as per <a href=\"\/doc\/108111388\/\" id=\"a_2\">Section 2(24)<\/a> of the Act, no<br \/>\nacceptance is required as the said section does not contemplate any acceptance<br \/>\non behalf of the minor.  The distinction between donation deed and settlement<br \/>\ndeed is obvious.  Settlement could be between close relatives and dependants,<br \/>\nwhereas donation could be between any two persons.  The very definition of<br \/>\nsettlement would warrant an interpretation that the settler irrespective of<br \/>\nsettlee&#8217;s willingness or acceptance could thrust the benefit on the latter.\n<\/p>\n<p id=\"p_24\">\t16. Both the Courts below after considering the evidence arrived at the<br \/>\nconclusion that the said Ex.A.1 was acted upon and in such a case, I am of the<br \/>\nconsidered view that no interference with the concurrent findings of the both<br \/>\nthe Courts below, is warranted.\n<\/p>\n<p id=\"p_25\">\t17. In the result, this second appeal is dismissed.  However, in the facts<br \/>\nand circumstances of the case, there is no order as to costs.
