Tripathi, learned Counsel for the petitioner<br \/>\nand Mr. Anil Saran, learned Standing Counsel.\n<\/p>\n<p id=\"p_1\">      The grievance of the petitioner is that the suspension order<br \/>\nhas been passed by the appointing authority, without applying his<br \/>\nmind and that too, at the instance of the State Government,<br \/>\ncontained in Annexure No. 4 to the writ petition.\n<\/p>\n<p id=\"p_2\">      In nutshell, the case of the petitioner is that the petitioner<br \/>\nwas initially appointed on the post of Junior Clerk in the year 2003<br \/>\nand since then, he is performing his duties very diligently and<br \/>\nhonestly on the said post. Petitioner had worked at different<br \/>\nplaces and lastly, on 17.11.2008, the petitioner has been posted<br \/>\nat Boock Sirauli Gauspur, District Barabanki. Though there is<br \/>\nnothing   adverse against the petitioner, while working on the<br \/>\naforesaid post, the Child Development Project Officer called<br \/>\nexplanation from the petitioner on 2.7.2009, to which the<br \/>\npetitioner tendered his reply. Subsequently, by the order dated<br \/>\n7.10.2009, the attachment of the petitioner was cancelled and he<br \/>\nwas directed to report for his duty at Trivediganj, District<br \/>\nBarabanki. Even, the ex parte relieving order was passed on<br \/>\n8.10.2009. By the impugned order dated 18.11.2009, the<br \/>\npetitioner has been placed under suspension on frivolous and<br \/>\nvexatious allegations that he is not taking interest in the work of<br \/>\ndepartment and other allied grounds.\n<\/p>\n<p id=\"p_3\">      Learned Counsel for the petitioner while submitting his<br \/>\nsubmissions has attributed mala fides to the impugned order, as<br \/>\nit has been passed on the basis of direction\/order given by the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          2<\/span><\/p>\n<p>Special   Secretary    to   the    Director\/opposite         party    No.2     on<br \/>\n7.10.2009. Therefore, the impugned suspension order is not<br \/>\ntenable in the eyes of laws. Further, the same is passed without<br \/>\napplication of mind and also in violation of Uttar Pradesh<br \/>\nGovernment Servants (Discipline and Appeal) Rules, 1999.\n<\/p>\n<p id=\"p_4\">      In support of his submissions, learned Counsel for the<br \/>\npetitioner has relied upon the judgment dated 7.3.1994 passed in<br \/>\nSpecial Appeal No. 8 (SB) of 1994 Dinesh Kumar Srivastava and<br \/>\nWrit Petition No. 9112 (SS) of 1993 Dinesh Kumar Srivastava<br \/>\nVersus State of U.P. and others. In the said judgment, it has been<br \/>\nobserved that there was kind of clear direction on the part of<br \/>\nhigher authorities to place the petitioner under suspension<br \/>\nimmediately.\n<\/p>\n<p id=\"p_5\">      Learned Standing Counsel was granted time to fetch<br \/>\ninstructions twice, but the instructions are not available with him.<br \/>\nUnder these circumstances, I proceed to hear the case finally.\n<\/p>\n<p id=\"p_6\">      In the instant case, the appointing authority of the<br \/>\npetitioner is Director. Though the Director has passed the<br \/>\nsuspension order, but it has been passed on the basis of the letter<br \/>\nwritten by the Special Secretary dated 7.10.2009, contained in<br \/>\nAnnexure No.4 to the writ petition. Further, the opposite party<br \/>\nNo.2, without applying his mind, has passed the suspension order.<br \/>\nIt is settled law that normally, when an appointing authority or the<br \/>\ndisciplinary authority seeks to suspend a delinquent employee,<br \/>\npending inquiry or contemplated inquiry or pending investigation<br \/>\ninto grave charges of misconduct or deflection of funds or serious<br \/>\nacts of omission and commission, the order of suspension would<br \/>\nbe   passed    after   taking     into       consideration   the     gravity   of<br \/>\nmisconduct sought to be inquired and nature of evidence placed<br \/>\nbefore the appointing authority and the authority concerned<br \/>\nshould consider all aspects and decide whether suspension is<br \/>\nexpedient or not and the same not be in an administrative routine<br \/>\nand automatic manner.\n<\/p>\n<p id=\"p_7\">      In view of above discussion, the writ petition is allowed and<br \/>\nthe suspension order dated 18.11.2009, passed by the Director\/<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                3<\/span><\/p>\n<p>opposite party No.2 is quashed.
